As you correctly pointed out the current 51(xxvi) is discriminatory in breach of the Treaty and Act 1975 but when one looks at the question posed in 1967 there in lies the problem. If a proper question had of been applied in 1967 section 51(xxvi) should have been repealed along with section 127.
s51(xxvi) = a potential charte blanche to Nuremberg Laws or apartheid type of legislation...it all depends on political circumstances. An enormous constitutional shame.
