    My car was 30 day impounded. My license is suspended.... I was not pulled over... I walked to my car from a house. The cops said they impounded car because they had "seen" me driving. I'm homeless lived out of the car. The cops asked where the keys were and I said my pocket they said no so I said then I have no idea.... How do you drive with no keys ? My court dockets have no driving on suspended or v.c. charges on them...... I understand my license is suspended..... but I wasn't pulled over... I want my car back. This is complete bullshit .

    Mine was for a ticket I thought I paid off. There was only $26 left and the court did confirm they got returned mail since they were sending everything to a previous address. So I got my license reinstated immediately. Now I gotta convince a clerk/judge I wasn’t idiotic to knowingly risk getting a misdemeanor charge over $26…..

    hey man, I paid my fine for a public intoxication but still was suspended I’m guessing to many points?

      I wouldn't expect public intoxication to cause a suspension - there might be something else going on. I'd get a copy of your driving history (Driver License MVR) at servicearizona.com and see what is showing on there. Also, if there is a suspension related to a court case, like for non-payment of a fine, once the issue causing the suspension is fixed, MVD will still want a reinstatement fee to clear the suspension, so I would look at that too. The MVR should show what is still outstanding.

      Go read the public intox law youll find you had to have been disruptive or endangering yourself or others to be charged it requires more then you being drunk for public intoxication charges to be brought

    Why do they have the right to suspend your license for stuff that has nothing to do with driving why do motor vehicles have the right to ignore the double jeopardy clause of the fifth amendment and charge you twice for the same offense all motor vehicles wants is your money they provide no service they just want money

    What if you've never had a license the state of nc has taken my license that I've never had but I'm not traveling commerce ...so how are they able to do this Legally ..

      I can't speak to NY, but in Arizona, even if you do not have a license, the State can still suspend your "privilege to drive". For example, if a person got a ticket in AZ for not having a valid driver license, and then failed to pay the fine, this would create a suspension of the person's privilege to drive. They would need to clear up this suspension before they could obtain a license. These suspensions can bleed out to other states too.

    (6) Motor vehicle .- The term “motor vehicle” means every description of carriage or other contrivance propelled or drawn by mechanical power and used for commercial purposes on the highways in the transportation of passengers, passengers and property, or property or cargo.

      Thompson v. Smith comes to the conclusion that the states have the right to enforce drivers to be licensed to operate on public roads for any reason. This is why you always lose. You don't know how to read case law and you cherry pick paragraphs from findings of a court. You should be forced to wear a helmet to walk outside.

      Under the constitutional guarantee of liberty one may, under normal conditions, move at his or her own inclination along the public highways or in public places, and while conducting himself or herself in an orderly and decent manner, neither interfering with nor disturbing another’s rights, one will be protected, not only in his or her person, but in his or her safe conduct.1 For example, the right of a citizen to drive on a public street with freedom from police interference, unless he or she is engaged in suspicious conduct associated in some manner with criminality, is a fundamental constitutional right.2 However, the liberty of each individual in a public vehicle or public place is subject to reasonable limitations in relation to the rights of others.3 See Exhibit B 16A Am.       The Power of state to license or tax, Motor vehicle registration is a traditional government function.1 Because the operation of a motor vehicle is a privilege, 2 the legislature of each state may, in the exercise of the police power, enact reasonable regulations requiring the licensing or registration of motor vehicles,3 including the private motor carriers of property,4 and public or common 5 carriers of persons or property for hire.       In addition, a motor vehicle license or registration fee or tax based upon seating4 or load or carrying 5 capacity is not invalid when laid on motor carriers in interstate commerce, if there is no discrimination against them in contrast with those engaged in intrastate commerce.       In the absence of an Act of Congress covering the subject, a state may impose upon vehicles using its highways in interstate commerce nondiscriminatory regulations for the purpose of ensuring the public safety and convenience, and for the protection and conservation of the use of such highways.1 Generally speaking, highway regulation has been left to states and localities, and traffic laws they enact must be applied both to intrastate and interstate traffic.2 See Exhibit F 7A Am.       Licensing or registration enactments frequently are made applicable to motor carriers-that is, to vehicles operated for compensation or for hire. See Exhibit G 7A Am. Jur. 2d Automobiles § 85 Motor carriers. Because, the use of highways for the purpose of transporting persons or property for hire, is a special or permissive use, a privilege. See Exhibit C 7A Am.       A state may lawfully exercise its police power to protect the public health, safety, welfare, and morals by promulgating laws and regulations that reasonably regulate occupations.1 However, an overbroad statute violates substantive due process by depriving a person of a constitutionally protected interest through means which are not rationally related to a valid state objective because it sweeps unnecessarily broadly.2 The right of an individual to engage in any of the common occupations of life is among the several fundamental liberties protected by the Due Process and Equal Protection Clauses of the 14th Amendment.3 However, neither the federal nor any state constitution secures to any person the liberty to conduct a business so as to injure the public at large or any substantial group.4 A statute constitutionally can prohibit an individual from practicing a lawful profession only for reasons related to the individual’s fitness or competence to practice that profession. 5 Before the police power of the state is used to prohibit the conduct of an individual as unprofessional, offending actions that do not fall clearly within the scope of the proscription must be explicitly defined as wrongful.6 See Exhibit H 16A Am.
