    The double jeopardy argument is so stupid. An impeachment is not a criminal trial, its a political one to see if a person keeps their job. Arguing that is double jeopardy is like trying to say you can't be sued in civil court because you were tried in criminal court.

      Yes, because the only action impeachment can result in is removal from office. No other sentence can be handed down.

      EXACTLY and you know what else is STUPID?? Trump claiming the CRIMES he committed while in office are part of his role as president when your job as president is to UPHOLD the law. WTF is wrong with our court system and judges?? This is a no brainer - no, HELL NO a president is not immune to criminal prosecution and if the SCOTUS wants to claim that he is then if Trump wins Joe Biden should stay in office by any means necessary even if illegal, with the argument that he was defending the country/democracy from a demagogue and wannabe autocrat which would be part of the job.

      @@hardcastle4419 You missed the point: If Nixon had the immunity that some are trying to assert now, then he would have had nothing to fear once he left office. This means presidents do not have blanket immunity, and Ford pardoned him for more than just "their friendship."

      The issue is not just whether presidents have immunity (if that is the case, equal protection under law is just bull), but Trump is using this nonsense to delay the trial beyond the election date. If he is elected (it is now better than 50%), all bets off.

    It's written clear in the constitution how the Supreme court should rule on this;
    * Article 1, section 3 : -Clause 7 Impeachment Judgments
    Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

    SCOTUS should consider whether impeachment is the basis for double jeopardy very carefully. If the SCOTUS rules it is double jeopardy then future impeachments for insurrection and/or sedition would mean future presidents would have no deterrent for those crimes.

      And the appeal will still take months then their decision will be appealed to the Supreme Court. This won’t be resolved until June.     Even if the Senate trial had been a criminal trial, and if the charges had been the same (which they weren't), there would be no double jeopardy issue: It is routine for another trial to follow a hung jury. In the Senate trial, 57 out of 100 senators voted to convict.

    Double jeopardy is impossible because impeachment is a keep or lose a job issue, with no criminal penalty (jeopardy) attached. Also is impossible, self pardon, which in the presidential sphere, could be used to block and prevent the imposition of impeachment. American law has the aim and purpose of checks and balances, to prevent tyranny, and rot, in democracy. Law must conform to reason and right. Our education must be to engage it.

    If the Supreme Court intentionally rules in trump's favour or delays Jack Smith's request and the case never gets heard before the election, it will only make a lot more people more determined to vote to put Biden in office for a second term, and trump will have to face the consequences immediately after the 2024 elections. There is no escape for trump. He will be held accountable. He is toast.
