    This was NEVER about it being private property, it was all about some people seeing something they didn't like and then abusing their power by ordering people to do what they say. They could have just ignored you and gone about their day and you would have left, but instead they take ANY chance to not do their actual job and instead abuse their power.

    if it is funded by the taxpayer then it is public property, even if it is a private premises that the police or government are renting, the second it becomes tax payer funded it becomes public, there is no trespass from a police station because it's public, every time the police eject or remove someone from police premises without an actual crime being committed they are the ones breaking the law, they can't just tell you you're trespassing on public property and use force.

      Last year the York Press posted a report about some guy who was fined heavily for refusing to leave the grounds of the police head quarters in Northallerton. His companion, who must have previous convictions, received a custodial sentence.

    11:20 Making up laws on the fly. Standard police procedure. The Criminal Law Act of 1977 does cover some trespass issues. But not at a police station. Only residential, embassies, with weapons or using violence. And reasonable force is never allowed to be used immediately unless the situation requires it to be used to protect persons or property.

      @@mikeel6074 You didn't read the legislation properly. Section 3 of the 1967 act is about the use of force to make an arrest. Not to remove someone from someplace. The 1977 act covers trespass. But in specific places. And with weapons.
      Section 117 allows a constable to use force in their course of their duty. That's when they are doing their job. Such as making arrest or keeping the peace. Not removing people from a place who are not doing anything more than using a camera.
      Section 76 is about the use of force in self-defence. Which would be valid in resisting any force used by a constable to move someone from a place without lawful reason.
      Article 2 is about the abolition of the death penalty. Are you seriously using that to defend the use of force by a constable?
      R v Griffiths is about reasonable use of force. So if someone is not using force and not doing anything more than holding a camera then the use of any force would be unreasonable.
      What an utter failure in your argument. Try harder. Much much harder. You sound like a cop who has been told a few things about the law but hasn't actually read up on it.

    What ever happened to people actually being able to engage in conversation without giving directives. Some years ago police would just ask if there is anything they could tell you about the station - especially about the memorials there to honour colleagues. Community policing has long gone.

    Only problem I have with more than one filmng is if your together you talk over each other even when there are more than one plod there and you talk to different plod you should have a camera person on the outside of the group so they can film at a distance so the plod pushing from different able when they push you and you show your body cam or hand held cam it looks deceiving so judges etc will side with plod more than members of public/ victim of abuse

    Hi Marti, I'm a huge fan, but Section 33 doesn't give you any right of access at all - it just defines a 'public place' specifically for the purpose of interpreting 1936 legislation - nothing else. It gives the public no rights at all.
    Luckily, all the sausages you encounter are too gormless to realise this, but I'm writing this because it's possible that one day one of them might, and they'd be correct!
    You're right of course about your implied right of access to open police land, but it can be removed by express instruction by someone it's reasonable to assume has authority to do so - not just by the landowner as your colleague says. Who such a person is isn't legally clear, I'd say definitely a Sgt though, and possibly a PC too. You have every right of course to dispute this removal to the person doing it, on the grounds of public transparency for example (and here because of you reasonably wanting to see the memorial chair, plus the signs being in your favour) - and the law does NOT require you to run away once some daft cop barks out an order - you have a reasonable time to question the order and then to leave.

      he's actually correct, we have the right to be on public land, and if section 33 defines what a public place is then it technically defines places we have the right to go, so yes according to section 33 he has the right to be on that land, marti is absolutely correct.

      Section 16 of the Public Order Act 1986 is probably more relevant than the 1972 Criminal Justice Act...
      "“public place” means-
      (a) any highway, or in Scotland any road within the meaning of the M2Roads (Scotland) Act 1984, and
      (b) any place to which at the material time the public or any section of the public has access, on payment or otherwise, as of right or by virtue of express or implied permission;

      @@25242824 Nope, its not public land, its private property, section 33 has nothing to do with it, it is an amendment to the 1936 POA section 9, that is worth a read, having pointed out to Marti several times that there is a section in there regarding private premises.
      " Private premises " means premises to which the public have access. (whether on payment or otherwise) only by permission of the owner, occupier, or lessee of the premises;
      But of course he ignores it, and anyway, is this an old vid as he is on a 5 year CBO banning him from police stations.

    Hi mate. Just after some advice if you can please mate. I was out doing my daily videos. I've not been auditing long. I was filming Middleton police station and went over to halfords they have a unit on a complex there. I spoke to a few business owners there at some unit's. When I was on my way out of the complex a member of staff engaged with me saying I'm not allowed to film on private property. I said I can film and the complex is publicly accessible. At which point he demanded I delete my videos. I said I'm not deleting any footage. So he got very aggressive he then grabbed my phone witch broke my gimbal and mic and took it into halfords with him. So I got the police they went and got my phone of them. But before the officer gave me my phone he went through it and then proceeded to delete my videos witch had evidence of the assault on me by halfords. I didn't get the officers numbers or the name of the one who assaulted me. I don't think that the police have the right to do that. What can I do. Have you any advice. Bye the way I watch your videos all the time. Love what you do. Could you please help me. My channel is lamsey laird audits. Any advice would be much appreciated. Thanks.

      Initially, you'll need to get some details (evidence) as you've got a decent civil claim against Halfords for the damages to your property and the Police need a court order to delete your footage so there may be another claim there (HNK?).
      --Are there any CCTV cameras where you were accosted? Find out who owns it and make a request.
      -Find out who the 2 cops are, get their numbers and put in a request for the Police's bodycams .
      -Deleted footage can be recovered-have you asked anybody who knows how to do this (Marti may know)?
      Get in touch, you were treated abysmally-there is no way anyone should have to put up with that level of abuse.

      If police were called, there will be an incident number a CAD. There will be a record of who was sent to the incident. From that you can get the details etc. As BB says Halfords will definitely have CCTV, put in a request, along with a report to the police for assault and potential robbery, taking your property. Good luck. As BB also said any footage on your phone can be recovered. Someone will help you.

      You should get a guardian app for your phone which prevents police access, watch Auditing Britains latest 3 parter, the police couldnt operate his phone and continued recording into the police station even after being siezed

    Hi Martin, police are seriously ignoring a criminal harassment saying it has to be reported and taken place in the last 6 months. This is over 500 unwanted awful emails, turning up at my home when removed any rights. Do you know my rights. Also police gave a opinion on a guarantor saying it wasn’t executed and wasn’t the guarantor because I never saw any tenancy agreements only the guarantor agreement. Any advice really appreciated X

      Summary Offences do have a 6 month limit but depending on the circumstances (eg Domestic Abuse) it may be different.
      Perhaps you can submit some details by email. It may be worth a visit to the CAB for further advice (although they usually say go and see a solicitor!)

      Just because it's funded by taxes does not make it open for the public to walk around at leisure.

    The police station is paid for by the public and the only private areas are those marked restricted or police personnel only. Why should we pay for buildings we cannot monitor! Why do they need all that grassland which could be utilised for the homeless etc. This is not a place for entertaining and e have to pay the upkeep of that wasted land!
