    Bait and switch isn't unusual in new developments. Happened to me. I sold out and moved before property values dropped due to the rezoning. I'd never buy again in a community that isn't fully built out because you never know what you're going to end up with.

      This is not a bait and switch. Unless it is restricted by deed, you do not have control over neighboring land. Tomorrow, there might be 8 lane highway or a large apartment complex next to you. The developer sells what is there today, not what there might be tomorrow.

    Unless the open space is in the contract, it doesn't matter what the home owners were told when they bought. Although, I personally am shocked that a salesperson would lie.

      This goes against the national Association of realtors code of ethics not only should be realtors be held responsible who marketed that way, but should should NAR!!!!!!

    The problem is if it's not in a contract, it's not enforceable. Also if you don't own it, you don't get to determine what's done with it. Do I think these people were mislead, yes, but that's you have things put in the contract, not take some company at its word

    I have lived here for fifty years. Just imagine the views and open area I have seen lost. No one cares. It's all about more and more and more people and their dollars. Gone are the days of Colorado beauty and serenity and hello to greed and corruption.

    That's a classic Karyn look. Imagine, vacant land you don't own next to your million dollar home getting developed is your biggest problem in life. And you expect someone to feel bad for you or empathize with you

    Unless the open space is stipulated on the deed of the home owner's property or the land is permanently zoned as open space, the home owners have little standing.
    I had purchased some property some thirty years ago that had been seized from a developer for back taxes. The land was sold to a real-estate company with a clear title and then sold to me with a warranty deed, yet the landowners in the development insisted that they had standing and still occasionally make noises when I work on the property, even though I have kept it as a green space. Do your due diligence when purchasing undeveloped property near or next to a development, especially if there is a HOA involved.

    a developer develops, your open space ends at your property line.
    Get together with your neighbors and make an offer to buy the acreage......or stop whinning
