    It’s interesting that J. Kagen says that the court just cannot make things up but lays out an argument permitting just that, a soup du jur interpretation of the document. I think SCOTUS has, on balance, caused more harm than good over time with its interpretations about race, gender, reproductive rights, etc…the weakness in the constitution is that it does not provide an easier method for making amendments.

    I have learned something from J. Kegan and J. Sotomayor, but pretty rarely come out on the same side of a case as them. I have been giving a good deal of thought to an idea of Sotomayor regarding the need for geographic diversity on the court and diversity of institutional representation on the court. I don’t believe that all Harvard and Yale grads are better suited for the job or that our nation benefits from having Ivy League grads filling most of the top policy jobs.

      It was because those institutions required a far greater demonstration of intellectual prowess and rigorous effort to get accepted then pushed the limits of intellectual prowess and rigor to graduate therefore making a selection from those institutions' alumni a near sure bet.
      Now it's all a toss-up. The criteria to get accepted has fallen far from the demonstration of intellectual prowess and rigorous effort. And graduation is being considered as a right.
      Few Ivy League schools have their credibility still. Harvard has dropped to Ohio State level or below. It's a shrug diploma now.

      The fight was never red vs blue. It was always rich vs poor. Briboholics do not have a cure. Party politics is for the uninspired. Real politicians know both sides rich and poor must be lied to to keep their support. Get money out of politics legally so we can call "donations" what they are really; Bribes. Judge shopping is not justice.
