Dr Ralph Wilde Webinar: How Britain broke international law to stop Palestinian independence

  • The 29th of September marks the centenary of when the League of Nations ‘Mandate Agreement’ for Palestine entered into force in international law. This legal instrument purported to put the commitment to establishing a Jewish homeland in Palestine made by Arthur Balfour in the eponymous Declaration of 1917-then merely a non-legally-effective statement-on a sound international legal footing. It paved the way for how the UK administered the Mandate. The Agreement purported to bypass the legal obligation in Article 22 of the League Covenant to provisionally recognize statehood of and for the inhabitants of the Mandate-people who were overwhelmingly Arab Palestinians-at the time the Mandate commenced. And it purported to permit the UK to maintain its administration, for what turned out to be a quarter of a century, so as to enable Jewish migration to, and Jewish institutions of self-government to be established in, what could then be proclaimed the state of Israel, as happened, covering part of the territory of the Mandate, in 1948. In international law, then, the key date for the supposed legal basis for all that happened in that period is 1923, not 1917.
    On the eve of the centennial anniversary of that date, this lecture will present a new argument, challenging the received wisdom about the legal effectiveness of the Mandate Agreement. For the first time it will be explained that the body adopting the Agreement-the League Council-did not have the legal power to modify the obligations in the League Covenant, and, as such, the requirement to implement provisional statehood in Article 22 remained the operative legal obligation binding on the UK. Consequently, by failing to enable Palestinian statehood a century ago, the UK breached international law, and this can form the basis for a claim for reparations by the Palestinian people today.
    The lecture is based on Dr Wilde’s article published in the Journal of the History of International Law, ‘Tears of the Olive Trees: Mandatory Palestine, the UK, and accountability for colonialism in international law’.
    Ralph Wilde is a member of the Faculty of Laws at UCL, University of London. He is an expert in international law. His current writing focuses on extraterritorial human rights, migration and refugee protection, and international law and the Palestinian people. His previous work on the concept of trusteeship over people and territorial administration by international organizations includes his book International Territorial Administration: How Trusteeship and the Civilizing Mission Never Went Away(OUP), awarded the Certificate of Merit of the American Society of International Law. He previously served on the Executive bodies of the American and European Societies of International Law, and the International Law Association, and is the past recipient of the UK Philip Leverhulme Prize and the Peace Fellowship of the Åland Peace Institute. He also provides legal advice and representation to states, international organizations, and NGOs, and is currently acting as Senior Counsel and Advocate representing the 22 states of the League of Arab States in the Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem Advisory Opinion case before the UN International Court of Justice.

As I heard Dr. Wilde's presentation of February 24th., I experienced two distinct emotions. First I felt vindicated that my heart and my intuition were correct - the Balfour Declaration is an invalid piece of RUBBISH with ZERO VALIDITY at International Law!! Second, I was once again angered and dismayed that The United Kingdom and the U.S.A. both diabolically participated in this COLONIAL GENOCIDAL "LAND GRAB" at the great expense of the lives of many hundreds of thousands of innocent Palestinian men, women, teenagers, toddlers, and infants. I feel embarrassed concerning our home grown corrupted politicians who stuff their pockets with "legal bribe money."

    Dr. Wilde, your recent presentation at the ICJ was simply brilliant. I had a good grasp of the political nature of the matter and his argument helped to crystallise the legal context of not just the occupation, but also the legality of the process leading up to the establishment of the state of Israel.
    The only clarity I need in respect of your presentation to the ICJ this year (2024) is whether the UN’s ignoring the provisions of the League Covenant by recognising Israel nullified or amended the Covenant. If not, on what basis in law (customary or established law) is the UN’s decision not lawful?
    Once again, this was the best argument I’ve heard in many decades of following this struggle of the Palestinian people.

Majority Muslim Arab states did not expel their Jewish citizens until the new state of Israel forced them to do so because it wanted its own Jewish population to significantly outnumber the indigenous population of Palestine - Muslims, Christians, Druze, Jews etc. And those Arab Jewish communities were just fine where they were and had been for centuries, so they weren't going to move country of their own volition. Hence the Zionist Israeli colonisers upped their violent ante in the early 1950s until the Arab Jews you refer to had no other choice than to join them. Once in Israel, these Mizrahi Jews were treated as second-class citizens for being Arab. Still are mostly.

    If you will recognize the rights of all these people to self-determination then of course it must apply to all peoples there indiscriminately. It doesn't say anywhere that a single state must be established somewhere. In fact there were multiple mandates and different countries founded from them at different places.
    If you are going to recognize the right to self-determination then it must also include the possibility for a peaceful and dignified coexistence for all these people.
    But even when the first small national home for the Jewish people was introduced, immediately a military conflict broke out. The UK had the mandate to administer mandatory Palestine, did so, but were violated not by the Jews but by the Arabs. There was nothing dishonorable done by the UK or illegitimate, the dishonor lies with the slave-trading done by the Arabs until about the 1960's and their oppressiveness. It's been the Arabs all along.

    There was a legitimate successor state on the ground of ottoman palestine. The arab kingdom of syria. France and Britain smashed that kingdom to rule over the region. Thats the first.
    Second they put a mandate over palestine. But what does mandate mean?
    The term mandate in international law in the broader sense refers to the order given to a state or confederation of states to represent the state and international law interests of a specific foreign territory.
    So the britains either had no mandate, because what they did was not in the interests of that specific territory or they misused their mandate over palestine. And both needs to be reparated

    Britain was given a mandate and refused to create a Palestinian state noting that until 1960 Jews were called Palestinians including in the British army in the Jewish brigade and Arabs were called arabs

      @@myblighters the Arab revolts of 1929 and 1936 were based on dar el Islam ie no non Islamic rule on past Islamic rule land local Arabs objected to British rule rejected the concept of Palestine or naming them Palestinian and wanted caliphate or local Arab rule only the Jews accepted the Palestinian mandate under Britain until the gates were closed to those fleeing the Nazis
      The same motivation as today

    If the Jews saw that Isreal was their ancestral home, then it’s down to the Jews to take responsibility, before the Second World War, Germany sent load’s of Jews to palatine too! As the Jews have always maintained that is their ancestral home! Therefore Balfour agreement or not, the Jews have to take responsibility!!! Using modern values on the past is highly dubious at best!!!

      We can’t lump Jews into one bloc. Not all Jews are Zionists, not all Zionists are Jews.
      The UK government should have made reparations in the original case. The fact that they have avoided this duty is down to the UK government. The longer they leave it, the worse it will get.

      Indeed and using the analogy of 'actions speak louder than words' we see that besides allowing greater Jewish immigration in the 20's and 30's Britain did nothing itself to facilitate the Jewish state's creation while at the same time it clashed with Zionist forces in its roll as protector of non-jewish people

    This man is actually arguing for imperialism because the Jewish people are the indigenous people of Israel. They were there when the Pharaohs ruled ancient Egypt and they remained there and in the wider middle east during the past 3000 years. The Romans invaded and took their lands into the Roman empire, they even invented the name "Palestine" and it remained part of a succession of empires all the way through history to the British empire who then returned it to the Jewish people. Islam began 2000 years after the first record of the Jews. There was never, ever an independent Muslim Palestine but now this man is trying to use "law" as a way of forcing the people of Israel to surrender their land. He would be better asking international law to investigate the fate of non-Muslim communities in Muslim counties like Turkey, Iraq, Iran, Syria, etc, etc.

      So the Zionists who came from thousands of miles away and had no ancestors born in Palestine for 1800 years were indigenous but the people living in the country at the time it was “liberated” from the Ottomans and whose ancestors had lived there for untold generations were not indigenous 😂

Whenever you say the word 'Palestinian' you are unknowingly referring to Jews, especially around the time of the Balfour Declaration. The people who refer to themselves today as "Palestinians" did not refer to themselves as "Palestinians at that time. You would do better entering a Pee-wee Herman look-alike contest.
