    Very insightful. Mam, my query is- Whether in a will there can be a restriction on transfer of bequeathed Property subject to beneficiary attaining the particular age?

      Yes, there are restrictions on transfer of the property in such case. Succession planning for a minor child is recommended. In an unfortunate event of demise of both the parents and where there is a properly drafted will with appointed guardian procedure becomes less complicated.
      In the absence of Will or if the Will is silent with respect to guardianship, court will appoint the guardian.
      The guardian cannot sell, transfer, gift or mortgage immovable assets without the permission of court and court grants such permission only if it is necessary for the best interest of the child.

    Not necessary to file for probate within three years if Will states beneficiary is an unborn grandchild and probate to be taken when first grandchild attains majority. Also, what will be jurisdiction of court if eg: testator died in Calcutta and 1 of 3 Willed properties is under jurisdiction of relevant District Court and other two properties lie in two other states. Does Indian Succession Act lay down clearly any clause or section where it says District Court has jurisdiction in such case??

      Hi ,
      So , section 371 of the Indian Succession Act reads as - Court having jurisdiction to grant certificate.-The District Judge within whose jurisdiction the deceased ordinarily resided at the time of his death, or, if at that time he had no fixed place of residence, the District Judge, within whose jurisdiction any part of the property of the deceased may be found, may grant a certificate under this Part.

      Hi ,
      When a division or a partition happens in a joint Hindu family, it becomes “self-acquired" property in the hands of a family member who has received it. For example ,if the ancestral property had been partitioned between your father and his brothers, his share in such property granted to him at partition would be regarded as his self-acquired property.
      So , he can write .
      Self acquired property can be distributed/ gifted / shared as a person wants.

    Can we execute part of a WILL? For example, I'm one of the beneficiary in the WILL and I wish to complete the registration of my share in the property to my name, can I do that or should the entire WILL need to be executed? Cos, few family members do not have money to afford expenses to execute the entire WILL and I wish to execute my part to avail a loan for education. Please advise with reference if possible.

      If you're the beneficiary.. then you must appoint an executor.. who will ensure that will be executed as per the terms and conditions. For registration of will... the whole will must be registered. There are no separate things you can specially register to your name.

      Hello ,
      There are some points about probate in the Indian Succession Act .
      1. Probate can be granted only to the executor appointed by the will .
      2. Section 264: District judge shall have jurisdiction to grant / revoke probate .
      3. Sec 264 will apply in all cases except in cases - means - no court in any local area beyond the limits of the town of Calcutta , Bombay , Madras where the deceased is a Hindu , Muhammadan, Buddhist ... sikh or Jain, shall receive application for probate until state government by notification authorises .
      Please check if you are barred by any of the given above criteria according to the Succession Act .

      The section basically deals with Grant of Probate and Letters of Administration.
      Section states that -
      If the deceased has died intestate and was a Hindu, Muhammadan, Buddhist, Sikh or Jaina or an exempted person, administration of his estate may be granted to any person who, according to the rules for the distribution of the estate applicable in the case of such deceased, would be entitled to the whole or any part of such deceased's estate.
      So, it talks about who will administer the estate after the death of the person.

Adopt Karne ke baad mere Dada ki death ho gayi, property khasra mein meri Dadi ka naam lag gaye. Jab meri dadi ka naam khasra mein laga tab tak mera birth ho chuka tha par mere younger brother ka birth nahi hua tha.Dadi ki death ke baad khasra mein mere papa ka naam lag gaye aur mere papa ne puri property ki registered will mere younger brother ke naam par kar di. Abb mere pita ki death ho chuki hain. Abb mein Kya Karu.

      Execution of a will by the father in favour of his son for taking care of him and his wife during their old age, excluding other sons or daughters on the ground that they had neglected him during his last days will not draw an inference of suspicion or invalidate the will, the Supreme Court has held.
      So , if the will has been drafted properly and there is no suspicion as such in the draft . Court will not invalidate the will merely on the ground of exclusion of legal heirs.
      Please note my word “ suspicion “

      According to the law, the beneficiaries of your Will should not be the attesting witnesses of the Will (otherwise the bequest in their favour would be void).

      Causal selection of the witnesses to the will should be avoided as it may create difficulty in proving the execution of the will in future. It should be kept in mind that the attesting witnesses may on some future occasion be required to appear as a witness in the Court to prove the execution of the will.
      The attesting witness as well as his wife or her husband must not be a beneficiary under the will because the bequest in their favour would be invalid. (Sec. 67 of the Indian Succession Act, 1925.) However the validity of other bequests made under the will are not affected.
      The bequest would be invalid as such a scenario raises great suspicion in the draft of a valid will .
