sir my doubt is that my father did 2nd marriage and after just 1.5 yr we came to know that she is having ocpd and she is very self centered behaviour and this relationship is hurting my fathers mental health and she has a daughter but the point about her daughter is there is no document that says that his new dad is my father because we tried many a times but they said it is not possible to change her father's name so can i get to know that if she ask for compensation in court for her daughter so can we counter her with this point that there is no such proof.

My doubt is about property division. Both partners were business professionals and they have joint assets (houses, cars and jewellery) in both their names. Married for 17 years and there are 2 minor children. Husband's ventures failed and he became extremely abusive, physically and verbally on wife and kids. Abuse went on for about 2 years, leading to wife filing for divorce. Husband has agreed for divorce after some struggle where it is agreed that both minor kids will stay with their mother. Wife is financially stable and has her independent business in which husband has no involvement. But will the joint assets / proceeds be divided equally between husband and wife or will it be divided in 4 parts considering that wife will be single handedly responsible for both minor kids? The joint assets in question were all made after marriage with joint income of the spouses.
