Order 22 Rule 3, also known as Order XXII Rule III, is a provision in the Civil Procedure Code (CPC) that deals with the abatement of a civil case in the event of the death of one of the parties involved in the case. Abatement refers to the discontinuation of the case due to the death of one of the parties, and it is important because a dead person cannot be a party to a case.
According to Order 22 Rule 3 of the CPC, if a party to a case dies, the court can order that the legal representative of the deceased person be brought on record as a party to the case. The legal representative can be any person who represents the estate of the deceased person, such as an executor or administrator of the estate.
If the legal representative is not brought on record within a specified period of time, the case may abate. This means that the case will be considered to be discontinued as far as the deceased party is concerned, and any order passed in the case after the death of the party will be null and void.
However, if the legal representative is brought on record within the specified period of time, the case can continue, and the legal representative will be considered to be a party to the case.
In summary, Order 22 Rule 3 is an important provision in the CPC that deals with the abatement of a civil case in the event of the death of one of the parties involved in the case. It ensures that the case can continue despite the death of one of the parties, provided that the legal representative is brought on record within the specified period of time.
