    • @amzarnacht6710
      @amzarnacht6710 Před rokem +3

      They were already existing rules that were too narrow in scope. The language should read 'at the time of entry' to cover situations such as this.
      I'm willing to bet some runner-up found this information and demanded that they be elevated in rank because of a rule violation. Losers do this every day.

    What a crummy thing to do… sorry Amanda. You deserve to retain your title and all benefits. You won fair and square, their mistake shouldn’t penalize you. You seem to be a lovely young lady. Be proud of what you’ve done. You’re a true winner!

  • @rocroc
    @rocroc Před rokem +51

    I read where the pageant officials said it wasn't there fault because it was a clerical error. That's BS. The pageant officials sent out a document which clearly stated if you were born in 2005 you were eligible to participate and that requirement was later changed to 2006. It doesn't matter who made the error, if there was one, or who changed the criteria and failed to notify contestants. Whoever is in charge of the pageant ostensibly approved her participation and the responsibility stops there. She should be given the title and whatever benefits are associated with it. She has reported that she would like to retain the title and would recognize that the second place contestant would go on to represent at the next level. Now, they have put her in a very bad position where some people may think she did the wrong thing or was a troublemaker because she wanted to retain the title. I think they should apologize and do exactly what she requested. Anything short of that should be handled by the parent organization and the whole local committee terminated. Although I don't generally advocate legal action, if this case isn't handled appropriately I would take it to court and make then pay accordingly - all expenses.

    THis is simple contract law. SHe signed a document stating 2005, pagent cannot alter the contract on a whim nor without her consent.
    She should sue, and she would win. pagent needs to learn the law and learn that there a financial and public repercussions for their unlawful actions

      Perhaps someone complained that the winner seemed too similar to the maturity and beauty level of a young Miss America contestant. I think they wanted to eliminate any crossover of eligibility between the teen and miss america pageant and also to ensure that the state winners would still be eligible for the national Miss Teen America pageant.

    Didn't they know her birthdate when she signed up for the competition? It's their fault if they accepted her, they should not be able to reverse it, next time they have to make sure THEY don't accept girls that are too old! It's their responsibility and job, to do their job, before the competition.

  • @skygunner777
    @skygunner777 Před rokem +26

    According to the eligibility document they wanted to make sure that the contestants were at least 13 years old at the time of the pageant and under 18 by the time of the conclusion so that there would be no crossover of eligibility between the miss teen pageants and the Miss America pageants. Ultimately, the scholarship is more important than the physical crown and sash but since Miss Giraldi stated that she wanted to keep the title for a period of time, she might have been better served by consulting her parents who may have gotten legal advice that could have justified a refusal to hand over the physical tiara and sash, especially since there is a copy of the document proving her eligibility at the date of her signature. Anyway, Amanda Giraldi is a princess and pageant winner to me.

    Sue them. It's utter 🐂. They allowed her to compete.
    The error lies with the competition itself on several levels:
    1. She was provided wrong information.
    A. Find out how many other competitors were allowed entry that also would have been disqualified.
    B. Find out if in fact any competitors are holding rules showing the age change that can be proved to have been in their possession before that Monday the change appeared on the website.
    C. This rule must have been decided upon via some governing body, make them provide proof of documentation with verifiable dates that match the March change. And besides, why would you wait until 3 months before the pageant to change eligibility requirements?
    2. The pageant didn't enforce the rule...
    A. ...upon entry of competition. I assume an application process is in place. And some member of pageant committee has to sign off on the girls applying. Find out if any girls got denied entry for any reason and what were they.
    B. ...other girls that fit her age description, you can bet, also did not get stopped from entry by the pageant.
    C. ...at some point during the event, especially as they are getting the field narrowed down, there would have to be a final check say at the final 10. Why have ineligible candidates within that group? That's also on them for NEVER revisiting the forms for compliance.
    D. ...when they allowed her to win. Again, at bare minimum, you would rule out all worst case scenarios before you tapped a winner.
    E. ...and if they never gave a darn about qualifications the whole way through, why AFTER it's over? Find out who made the call to update the website and why. What "qualifying girl's" family took the time to find out her birthday, then have enough pull to complain to officials and to seek Justice? And whoever it was, how petty?
    And lastly, what kind of example does this set not only for young women but anyone involved with this pageant? The moral here, according to their chosen outcome: Even if a mistake is CLEARLY your fault, take the lowest road possible in order to pretend to do the "right thing" and break this amazing young lady's heart, nullify her obvious victory, which could have career or opportunity ripple effects in a negative way. But you see if the pageant actually cared to do the right thing they would have been 💯 making completely sure everyone knew the recently changed criteria well before the end. Hmmm why? Well less contestants would have been involved. Less entry fees, less audience ticket revenue, less advertising revenue in the programs, less concessions sold, less parking sold...
    If they had any class, the only a few options would be:
    1. Too bad. She wasn't prevented and she did nothing wrong. Totally different if she was trying to get over on them, which she wasn't. Leave the title solely with her.
    2. Share the title. Just for one year, there are two equal winners.
    3. For next year only, let EVERY contestant who were the oldest possible without "breaking the new rule" compete again if desired, even if they then would be breaking the rules next year. Then, more, new rules back in place.
    I bet if she happened to be trans it would be fine to win, but not if you are a few months past the age. Months of time vs gender switching and somehow we know one is closer to not making sense in the spirit of the competition but we also know it wouldn't matter to the pageant.
    Hey kiddo, many are sorry for you. You are doing a good thing by sharing your experience.

If they made the mistake & still wanted to put someone else on the throne they better get a very wide chair because it would be the only year of two Miss Utahs. The pageant would loose money but they should never hurt a young teen how terrible,this is ridiculous. If they had two for this year they would have to work on the schedule but you can not take the title away because you made a mistake .
