  • Specific performance is a legal remedy. It's a court order requiring that parties to a contract fulfill the terms of their agreement.

    The glitch in this law lies in the key word “Unique”. Their definition of unique is, any object that cannot be replaced with money. Most of these lawsuits come from house flippers that are investing. Fact is, most investment homes ARE easily replaced and hardly proven to be “unique”. This is why this sorta lawsuit is rarely invested into by the buyer of a property. Not at all a wise gamble

    I'm still confused. What do you mean: buyer wants to buy that "special property" but the seller breached contract, so the buyer is asking for a specific performance (requesting the seller to sell it to him) because the property is unique and can't be replaced with money. YET the buyer is requesting to buy the property... with money. help me understand.
