    Like upsc , there should be judges selection process. Every judge should come through this selection process. No mid level entries should be allowed. There should be entry at bottom most level and grow up the ladder upto Supreme Court.

      The UPSC itself is a flawed system. That's why the lateral entry system for policy advisory & formulation was brought about. If the judiciary adopts that, it's 10 steps back. At least right now, the appointment of HC judges is still better than that.

      BJP once tried to abolish Collegium system of judges appointing judges but Supreme Court nullified it, unreasonably perhaps unwilling to lose it's supremacy.

      @@rajendranv9732My suggestion is Collegium is to be expanded to include PM, FM, HM, Attorney General, and Solicitor General and attorney or solicitor to recommend the names to PM and in turn to President for appointment of both HC and SC judges. In the process merit is ensured . Everymonth one day Govt pick the persons of integrity, fully scrutinized by Intelligent Bureau and forward this govt. In case of adverse remarks, that person should not be made. The authority vests with HM for thorough scrutiny. Considering the voluminous cases pending, I suggest who ever comes to power can create SC for Constitutional Matters, SC for Economic Offences including money laundering, SC for Civil disputes and SC for criminal cases. This will reduce the burden. So also for HC. Once the verdict is pronounced, if the case is on appeal to SC , no stay order is to be given and it must be referred to trial for SC. Listing of cases must be with another person appointed by Govt and he must ensure that quick disposal of listing. If need be Govt can consider retired judges to speed up the trial. Moreover Central agencies must be given full powers to enter any state and if the agencies are attacked by the people in the state , Delhi police can take suo motto of this incident and States have no role to play. In my NJAC can be introduced again with the modifications and it must be final where in Court can make suggestions only . If anything is wrong , pl make comment without involving any political colours. I feel that the burden can be reduced. Govt cdn also scrutiny of legal system in other democratic countries and embrace the clauses.

    Thank you Mr. Salve speaking the core truth on our justice systems. To me it looks like justice inconsistency is actually a question to be heard on true justice scale by those who are not biased and punitive under the contempt of court rule. Justice is where the true balance is in balance without any bend.

    -We need accountability for IAS officers.
    - We need to support free speech and demolish laws against that are against free speech like section 295 A erc.
    -We need judiciary reforms(By hiring more judges+ dividing IPC into different Category and then also assign judge based on different category.)
    -We need educational reforms(We need to add CIVIC duties and basic ECONOMICS in our Primary education)
    - We need to do economic reforms(Decreasing excise duties on raw material, Providing more security of business etc.)
    - We need to add petrol and Diesel into GST( so that people don' t have to pay VAT and Excise duties on it).
    - We need make Farming a business( by Privatization of the industry) not a social service, this itself can push Indian into a middle income economy.
    - Gov needs to decrease the size of Government and increase the size of Governance(We have so many unnecessary amount of Ministries).
    - Gov needs to do a lot of social reforms(Wakf act+ Place of worship act+ implementing UCC and CAA and NRC etc.)
    At last there is many more thinks that needed to be done and my faith in BJP is decreasing Day by Day specially regarding the social reforms.

    Also working schedule and timings must be adopted, no extra special holidays.
    With time limit for disposal of cases. RTI act too for public scrutiny.

      If they don't like politician choosing judges then allow people to choose the judge but then we will have election for every thing.
      So the best democratic solution is to allow elected politician to choose the judges.
      This will happen when people of India become more aware about their voting rights and choose good politician.

    Great interview. The present system of judges appointments made by other judges is like the examiner and student are the same!
    The judiciary in India has been elevated to the highest position of ‘My Lords’ representing The Lord on earth. Being representatives of The Lord , they have allowed themselves the power not to declare their assets, have opaque appointments system ( where as they want transparency for everyone else) , want to be on every committee conceivable which appoints people to highest positions in the land( next they may want the power to appoint the president and prime minister)
    The judiciary in India is harming democratic society by their judgements and eroding the trust in the government in the eyes of foreign governments
    The first next government should completely remove the corrupt judiciary and replace with a system which is suitable for India and send the present self appointed judges to their homes

    Woonderful talk. As he pointed out, it is high time now that our entire judicial system is revamped to suit the changed times. Precious time of SC is now spent on cases which could be deliberated at High Courts. Bail applications coming up at SC are examples. Such cases could be heard and disposed by HCs, based on the set directions of the SC. Clear-cut demarcation needs to be set regarding the limits of Parliament, Executive and Judiciary, and each wing to ensure to avoid inference. Initiative in this direction from the Hon'ble Top Court will be well-appreciated.

      What he says about Hindi in courts is correct. Majority of the litigants do not know English and the judiciary does not transact in Hindi. Entire working of is in English in majority of the courts. Court working should be keeping with the changing times. The outdated system won't be able to deliver. Appointment of judges should be as per the global practices.

    From Slave to British 🇬🇧 made judicial System to Congress/ Communist party Slaves our Judicial Independence is under scrutiny of public & mind you the people of Bharat 🇮🇳 understand everything.
    Collegium System has TO END & CONSTITUTION NEEDS TO BE RESPECTED BY JUDGES OF SUPREME COURT OF INDIA 🇮🇳 FIRST AND FOREMOST.

    Mr. Harish Salve is a force to reckon with! A great lawyer and a great human who fought for his birth country, Bharat, for one Rupee!
    And, though I’ve marched for Arnab’s release from jail, I don’t like his hyperactive behaviour! He needs to mellow down and stop the noise in his shows!!

    Vested interest comes into play when a group of veteran judges appoint top judges of the country.While institutions elected by the people just keep looking on. Helplessly.

    Harish salve himself has given very good reasoning why collegium system is must needed. He himself said that it was introduced because of the excessive interference of that era goverments in the institution of law. If previous goverments has done that in the past, who will ensure it will not happen again in the future, even if we agree that its not possible in modi government, but who will ensure that it will never happen in the future, say in 15 or 20 years from now.
    Its very straight and clear, the collegium system was introduced because goverment can easily influence any court of law without this system.

    It is high time to reform the selection of Judges to the High Courts and Supreme Courts. Selection of judges by Judges is to be aɓolished and an innovtive method to select judges is to be evolved .
