How was he set up. He went to the bar, he admitted to drinking at least two beers, he then drove without a license, he was driving with no license, no insurance, crossing the line, almost hit another car, speeding and had an open cup and lied to officers. Additional that bottle was in his car BEFORE the stop was not planted. He put that bottle in his car not the officer. Jurors all voted GUILTY.

Not exactly ... but, close. They lied under oath and thus, got caught lying or falsifying police reports. It was up to jurors to care or not about incompetence or corruption. They also stated other factors ... his driving all over the road, bloodshot eyes and slurred speech. And, none of that was shown to jurors. Speech sounds fine. Why not show his driving - dash cam video? Ask for bar receipts from the bar? Defense and or Prosecutors should have before trial. No idea if he was drinking or not while driving or under the influence of alcohol. Wasn't shown. Jurors were asked to believe what the officer(s) smelled. Could be indicative of driving with an open container. (Illegal) But, one lied in a police report (took for granted what one officer stated as fact) and or lied on the witness stand and the other officer broke the law to create false evidence for the arrest; to help ensure an arrest, and or just broke the law in general; tampering with a potential crime scene. But, the officer who alleged to smell alcohol (she may have - he admitted to drinking 2 beers) is not the same officer who poured out alcohol and then placed an empty bottle next to a drink in the console. A drink of what? No idea. (Nor, how old?) But, he can't have or poor alcohol into the drinking cup. And, the officer stated she didn't know what was in the cup. She made a presumption/assumption based off of the empty bottle SHE witnessed; after the fact, after tampered with by the other officer. That's a problem. Because juror can't smell liquor after the fact (and 2 beers admitted to) Why not show his driving before pulled and bar receipt. Under the influence or not ... surprising jurors would not need or ask or require any proof of such. More so with such misconduct (or attempt to frame) shown. That's the jurors call or poor judgement. Or, maybe biases. (He had a suspended license.) But, also why not get a blood test to prove ABL. But, can't if arrested. All one can do is hope alleged observations were accurate (true and correct). But, don't understand why hidden. Or, why judge didn't allow the evidence. But, also don't wish police misconduct to cause him to drink. 🎉 Embarrassing and or potentially dangerous. Had the one cop not smelled alcohol (in the car) Thus, trying to frame or set up for a different arrestable offense by emptying the bottle and then placing back inside the car? No to be clear you saw the story someone wanted you to see. The Jury saw the whole trial and they decided that there was other evidence of his guilt beyond the empty bottle. They the jury of his peers were the ones who convicted the man. Had the whole bottle fiasco not taken place perhaps he would have been given a breath test? He refused the field test. It is also not uncommon for a prosecutor to throw out a lesser charge to make it look like they are not vindictive to the jury. Clarity is not something you will get from one persons video on the matter.

The point is that the cop broke policy and procedures when she spilled out evidence, you can't go into someones property and start opening closed bottles. This is just another example of how poorly laws, policies are followed by the same people that enforce them.

Appeal and Sue. Then, an independent investigation needs to be done to determine if this Police Dept. (not just the individual officer) has had any other complaints of wrongfull arrest or false claim arrest. This issue sound systematic' from the police officers to the judges.

The stop was for: 1. speeding 2. driving with no lights on 3. crossing the line. Any lawful stop as it was can lead to other violations such as DUI and no license.

@@Asidebar A jury is not permitted to assume guilt because the person refused a field test. There’s plenty of evidence that these field tests are not uniformly administered. A reasonable person would refuse to take such a test. If someone refuses such a task, the officers can get a warrant for a blood draw and then that blood test can be used as evidence. The officers did not do that.

You were pretty close, but an unopened bottle of liquor is not evidence. What the cop did was create evidence by breaking the seal and dumping out the contents, then tossing the bottle back in the car and claiming later she found it in the car. So, she created evidence and then planted it. This could be a basis for an appeal, for sure, but it also could be a basis for criminal charges against the officer. Then there’s the matter of the judge allowing the emptied bottle to be entered into evidence. That could be a basis for removing the judge from the bench.

However, in this case, it’s pretty clear than an unopened bottle is not evidence. The cop’s behavior indicated an attempt to create evidence where there was none. Her change of testimony also makes it clear that she knew what she was doing was wrong.
The trial was procedural, with no attempt to secure justice and hold parties accountable --this is very evident. The officer said she “did not” use the vodka bottle as evidence, today. But the deposition, from yesterday, which is the officer's sworn statement, notes she “did” use the vodka bottle for evidence. The officer blatantly lied and still won the case-no accountability. Black people in Florida should be mobilizing everywhere (I bet they’re clueless)-this is very dangerous.

There was NO misconduct. Calvin Riley was the person who committed misconduct by speeding, driving without lights, no license no insurance and admitting to drinking at least two beers. Officers did everything correctly.

Unless you make it hurt, there is no way to restore any balance, and no way to force positive change, which is clearly needed. Also, I am sure that once someone like the Institute for Justice sees this, they may sign on pro-bono, as this is right up their alley. This case is like a lawyer's wet dream and if I were one, I would love to work on the appeal.

No to be clear you saw the story someone wanted you to see. The Jury saw the whole trial and they decided that there was other evidence of his guilt beyond the empty bottle. They the jury of his peers were the ones who convicted the man. Had the whole bottle fiasco not taken place perhaps he would have been given a breath test? He refused the field test. It is also not uncommon for a prosecutor to throw out a lesser charge to make it look like they are not vindictive to the jury. Clarity is not something you will get from one persons video on the matter.

If someone refuses such a task, the officers can get a warrant for a blood draw and then that blood test can be used as evidence. The officers did not do that.

This could be a basis for an appeal, for sure, but it also could be a basis for criminal charges against the officer.
Then there’s the matter of the judge allowing the emptied bottle to be entered into evidence. That could be a basis for removing the judge from the bench.

Hate to say it but he was good to go but he kept talking. Also the female officer kept egging him on by asking question. He said he was answering no more question until he speaks to a lawyer that should had ended all conversations from that point on. Said it one more im.not speaking again until I receive my phone to speak to a lawyer.

The only reason is because the prosecutor and judge do not want him to be able to get a lawsuit! So they allowed this miscarriage of justice go to trial!!
I don’t see how this avoids a lawsuit. We now have a trial transcript, complete with video, showing the extent to which they violated this man’s rights.
@@SeanPat1001 It buys them some time, he will win his appeal, but it will take some time. Everyone is digging in their heels with a firm commitment to a miscarriage of justice. Changing course now would result in an even greater fallout, at least that's the way they probably look at it.
@@Mister_Terrific806 50 years ago, I was involved with a similar case and the judge pulled a similar trick. In the end, two state troopers were fired, one ended up in prison and the judge was removed from the bench.
This may be a bad gamble on their part

There was NO misconduct. Calvin Riley was the person who committed misconduct by speeding, driving without lights, no license no insurance and admitting to drinking at least two beers. Officers did everything correctly.
@@Asidebar you are right about a few things if he was speeding, and driving but without a drivers license, then he should’ve been written a ticket or his car impound because that the law is the law but if he was not drinking, and the bottle was seal, why is he charged for DUI?

We saw her get the bottle out of her cop car and open it pour out an amount and plant it in his car and tell her partner he had an open container and they committed purgery for all to see and he was still convicted…the judge should have stopped this…this is pure evil

Unless you make it hurt, there is no way to restore any balance, and no way to force positive change, which is clearly needed. Also, I am sure that once someone like the Institute for Justice sees this, they may sign on pro-bono, as this is right up their alley. This case is like a lawyer's wet dream and if I were one, I would love to work on the appeal.

He wasn’t charged with an open container. He was drinking and refused any tests. Still no evidence beyond a reasonable doubt that he was over the level. Bad jury unless they have dash cam footage of him swerving
