This is a lost art - the strategy of staging your questions to put the witness at ease whereby they might let something slip. Many lawyers nowadays just attack at the outset of questioning and guarantee a sealed shut witness. Anyone remember the Raymond Burr “Perry Mason”? He would go through a series of questionings and in the fourth or fifth time questioning the witness he would seize upon something the witness said earlier or something the prosecutor got the witness to say and re-ask the witness about it again and catch the witness in a lie or inconsistency in their story. No but the questions are what's weak. I like Kennedy a lot but this was just political theatre. If he wanted answers he could've framed the better, easily. But he just wanted to ask questions for the sake of it & for camera. Ofc Ray isn't gonna answer, he can't. And they don't even if they can, but Kennedy's question made sure he can't. For example, he could've simply asked "how could on what criteria could an outsider get an FBI access badge?" That answers the question of how Sussman got it, atleast a possibility of it. So he chose to go for a no answer from Ray rather than some answer. It's just drama.

This is a lost art - the strategy of staging your questions to put the witness at ease whereby they might let something slip. Many lawyers nowadays just attack at the outset of questioning and guarantee a sealed shut witness. Anyone remember the Raymond Burr “Perry Mason”? He would go through a series of questionings and in the fourth or fifth time questioning the witness he would seize upon something the witness said earlier or something the prosecutor got the witness to say and re-ask the witness about it again and catch the witness in a lie or inconsistency in their story. That is where I see similarities with Kennedy.

The most painful part of this is knowing that Christopher Wray is smart enough to know that saying, "yes, Senator, Mr. Sussman did have an access badge to enter the FBI and it is my understanding from the news that his law firm, Perkins and Coye were working with Sec. Clinton in some manner". Wray can say that he just wants to stay away from an ongoing case but the fact is these questions are not new or stunning information and as Sussman is charged only with misleading the FBI the answers would not do diddly squat to undercut the current case.
