SB9 Tear Down - Are ADUs Next?

  • SB 9 got hit hard in the courts, and a lot of people incorrectly say it’s dead. And that leads a lot of people to worry that ADUs might suffer the same fate.
    I get it… there are cities out there like Redondo Beach which are lawyering up and finding ways to successfully fight the laws that make it easier to build housing all over the state of California.
    Laws like SB 9 got a lot of attention when they first passed, so it’s understandable that people are worried.
    BUT in a few minutes, you’ll understand that rumors of the death of SB 9 are a bit exaggerated - I’ll give you the script in case somebody in your city tells you it’s dead.
    We’ll also talk about why ADUs should be resistant to this specific challenge -

    I have the grant in escrow but I live in Beaumont and the price per sqft to construct an ADU is $250-450 a sqft. Nothing is happening at the moment cost is outrageous.

    I have few questions and I like to ask you to address them in your next video.
    1. Can SB9 and ADU be combined in the one detached structure ? Another words one building with 2 units , one being ADU and one SB9.
    2. Can SB9 be built in the back of the lot with no alley and driveway going to the back as a passage which is only 8ft wide?
    3. I know there is a owner occupancy requirement with SB9 but the question is : Is this requirement applies to all SB9 es or SB9 split situations.
    4. Is there any special requirement to have fire sprinklers in the SB9 units ?
    5. Can detached garage be converted in to SB9 or it has to be newly built ?

    Ryan in my city they require the homeownr to provide rent receipts to prove the adu tenant is paying below market rate. Is that typical practice?

      Only if you have some sort of affordability requirement, usually in a deed restriction. These sorts of “inclusionary” zoning requirements are not uncommon, but they aren’t supposed to be enforced with ADUs or SB9 units (unless maybe they are required for the primary too??)

    How about Sacramento 2040 General Plan and Maximum Floor Area Ratio (FAR)? Took effective date March 28, 2024?

      Sacramento is generally pretty friendly to ADU development and I think they've been okay with SB 9 as well. Percentage based limits like Floor Area Ratios are generally only enforceable on ADUs that do not fit the statewide exemption ADU definitions. So for example, if you are converting an existing structure into an ADU or building an ADU under 800 sq ft within the proper setbacks and height limits, you may be exempt from FAR limits in Sac to some degree. But if you're trying to take advantage of Sac's multiple ADU city ordinance, or building over that size limit, or closer to the setback, then you will also have to respect other Sac rules. It's a bit of a complicated one because there are two paths you can go down and they're both good in different ways. And I don't know how it will overlap with SB 9.
