In a public setting or arguably any setting with no reasonable right to privacy (perhaps photos from public into private property as an example) photos are %100 allowed with no permission needed. As far as use of those goes...depends. Could potentially be a violation of a copyright depending on the setting, action and what was taken. Waves looked fun! Nice job!
if you look at the waves, it's the same surfer keep sitting inside (it's not ideal to sit there ) and he shouldn't paddle to where the surfer is going. he should paddle the opposite way, it's basic surf etiquette.
