I-Team: Hertz customers claim company knowingly files false theft reports

    ATLANTA - Hertz, the car rental giant, faces mounting allegations that it filed false car theft reports against its customers resulting in arrests and jail time. Victims told the FOX 5 I-Team this is not a one-off but rather a systemic issue.
    These customers ranged from people using one of the Hertz companies to rent a vehicle after a car accident, some for vacation travel, some as part of a Lyft driver program. But none expected to be arrested, much less at gunpoint.
    Paul-Anthony Knight was headed to work in the morning rush hour. He was traveling through the congested connector. Behind him police cars were weaving through traffic, coming up quickly along the shoulders.
    All of a sudden, there are three police cars behind me. I looked up. They were after me," he said.
    And they had weapons, pointed at him.
    We watched Mr. Knight looking at the dashcam video for the first since his November 2019 arrest.
    Visibly upset he said, "This moment changed my life. I was told this vehicle has been reported stolen. I was in a stolen vehicle."
    He was charged with felony theft of the rental car he was driving. He was cuffed, put into the police car, then went to jail.
    "One very long week," he said.
    Julius Burnside rented a car through Hertz, extending it several times, after a car accident.
    He told the FOX 5 I-Team the rental was paid for and had been returned already. Still, a warrant was issued for his arrest for theft by conversion, a felony. He turned himself in April 2018.
    "They said I stole the car. I had proof I didn’t, which was bank statements, receipts from Hertz that were emailed to me," said Julius Burnside who at the time lived in Gwinnett County.
    Both men are among more than 260 people who’ve filed similar false arrest claims against Hertz as part of the company’s bankruptcy filing.
    Their attorney Francis Malofiy, "Hertz knows they are filing false police reports with false payment information, false return dates, false contact information and providing very misleading reports to the police they are relying on.
    The FOX 5 I-Team reached out to Hertz which also owns the Thrifty and Dollar car rental brands.
    In an email, we were told, "Hertz cares deeply about our customers, and we successfully provide rental vehicles for tens of millions of travelers each year. Unfortunately, in the legal matters being discussed, the attorneys have a track record of making baseless claims that blatantly misrepresent the facts."
    They went on to say, "The vast majority of these cases involve renters who were many weeks or even months overdue returning vehicles and who stopped communicating with us well beyond the scheduled due date."
    Paul-Anthony Knight said he had just moved to Atlanta from Charlotte for a job. He had been driving for Lyft and had gotten the car from Lyft’s rental program. He was arrested two days before he was scheduled to return the car.
    "You’ve lost your job because of job abandonment, and everything seems to snowball at that point," he recalled.
    Mr. Burnside had receipts that show he paid $2,343 for the returned rental. Court records show that he thought the matter was settled. He moved to Mississippi where he lives today. But, he was wrong. The case was not closed and he was re-arrested. He was jailed for nearly seven months.
    He told the FOX 5 I-Team he finally pled guilty after his daughter begged him to do so.
    "I got out the day before her graduation."
    A judge later tossed out Mr. Burnside’s conviction and the theft charges were dismissed. His claim says "Hertz was notorious for losing rental extensions and filing false police reports."
    After two, long years in legal limbo, prosecutors dismissed Paul-Anthony Knight’s case, too.
    Hertz reports, since 2016, it’s filed annually more than 3,365 theft reports. Over a six-year period, that’s 20,190 cases. The company writes the FOX 5 I-Team that false arrest claims are "very rare."
    "Hertz must be held accountable for overturning my life and the life of so many others when they’ve done absolutely nothing wrong," said Paul-Anthony Knight.
    Attorney Francis Malofiy added, "If they have been told the information is false if they understand or learn that it’s misleading, they will not correct it.

    It does not matter if they are "very rare" - even one false arrest is unacceptable, but to falsely arrest the same person twice, with a false conviction? Absolutely unforgivable. I will never be using Hertz or any of their subsidiaries ever again. The trust has been permanently lost. Someone who works at Hertz needs to go to jail for allowing this to happen.

      I have so many points with Hertz, but I barely want to even use them. Our company required us to use them until recently. It's not just this, but their service has declined since the bankruptcy. They never have cars available. I rented with them for a week then needed a car to get home after Frontier stranded us 1800 miles from home. They had no cars so I had to go to budget. I'm done with Hertz and Frontier.

      Agree, I remember years back I rented a car from them. I paid or $500 just for the to keep my card info and charge me a another $500 (without notifying me) overnight for a false claim of me passing a bus stop or something like that. Ridiculous, then they said they'd keep my card info for any additional charges. I cancelled my card that day. Thanks God my bank reimbursed my funds after I filed a dispute. I will never do business with them again.

      The guy was constantly extending the rental period for nearly 3 years. At that point its cheaper to buy a car than rent a car and he did not pay the money every month for what he signed the agreements to. In his own words he admits that he did not pay for several months. He gave a good excuse of he lost his job and well sense he lost his job and did not have the money to pay for the car then he should have returned it and explained that he did not have the money to rent the car instead he kept driving for 6 months without paying a dime to the rental company and Hertz went well sense you borrowed the car and are not paying to borrow it the car is stolen which is fallowing the law. The judges did not throw out the cases but instead these people served their time in prison. The cases are still on their records as being petty car theft because its non payment but they served their time in prison. These people are pissed off they got charged for not paying for a car they rented and did not pay for which is theft.

    Hertz needs to be sued into oblivion. Every single person that was arrested needs to go after Hertz and the other companies owned by Hertz. The people making the false theft reports need to be arrested for filing a false report, false arrest, theft, and anything else they can stick them with.

      should there be restrictions in place to prevent a company form declaring bankruptcy to keep from paying off plaintiffs in a lawsuit. i think there should be. a company shouldn't be able to protect its money cause they do some shady crap that cause a ton of problems for unsuspecting people

      @@bamm3967 : Shareholders of a public company going bankrupt typically lose the total value of their shares. Criminal prosecution seems the proper path to justice. But that would sadly require more resources than many law enforcement agencies are prepared to spend since it would be hard to recoup them from a bankrupt enterprise.
      Meanwhile, I surely won't be renting from any Hertz company again, ever.

      the problem is the prosecutors that put these men in jail, while ignoring the evidence that these men have in the form of rental receipts.

But Hertz lied to the police and said that yes they were paid, but that the car was never returned or returned late. And as far as Hert'z insurance - they wont pay either as hertz committing fraud violates their contract most likely. This is just sad all the way around. Im glad the judge tossed the conviction - but that dude lost 7 months of his life.

      We may not hear about it, cause it very likely will be settled out of court.
      It won't make up for his time in jail, but I'll guarantee you he is, or already has a lawsuit, or a settlement.
      He's fortunate (if you want to call it that) to have the media bring attention to his situation and there's no way he walks away with nothing.

    I had a hertz rental for 30 days, paid for by my automobile insurance company which they covered due to a car accident. Two weeks into the rental I received texts, emails, and certified letters looking for payment even though my insurance company arranged direct payment directly with Hertz. Hertz has a collection department that runs away with themselves. Even had a tow truck show up my home at 2 am three weeks after the 30 day rental was returned to Hertz. That's one fxxked up company.

      What's worse is that he spent 7 month in jail awaiting trial, just for being accused of not returning a rental car. It's insane that the police will take the word of a faceless corporation over a person and throw a guy in jail without even bothering to establish some basic facts.

      I am surprised the state has not stepped in to investigate. This has happened more than once. The car is fully paid for but Hertz reports to police and fills claim for insurance.

      When Hertz stops calling the police to report an assumed theft. Hertz are to blame for keep calling the cops, they’re just doing their job and they don’t know if a person renting the car is right or wrong. But till Hertz stops accusing their customers they’re stealing their cars or aren’t turning in the rental car on the due date, they’ll keep calling the police. The police don’t know if the rental car is stolen or not, unfortunately the renter has to go to jail until he or she is proven innocent.

They have enough proof with that receipt to let it go to court with out an arrest. That's like walking out of a store with something you just paid for and prove it my the legal means a receipt in this country.. but yet you still get arrested. Only difference is cops get credit for felony arrest. That's why they still do it and they don't when it's a store. The store is no a arrest they get a pat on the back for.

And started that years ago when I heard this for the 100th time.. now its a few hundred cases.. soo how do I help companies like this? Or why am I the reason for companies like this? I can't arrest anyone nor any company, only way I can do anything is by voice and.not spending my money with them to able them. Now police know its fake theft and still choose to make hertz money by acting like its a real stolen car.. the police should start charging hertz if they were going to care.. it's business fraud and iam sure there's many crimes in there they should be charging them with. Not the guy with the receipt.. you one of those cops?

    Happened to us, we called them daily to confirm we were extending the rental, they gave it the go ahead every call. Show up at the airport and drop it off and they say they reported it stolen, luckily not ever pulled over driving across the country.

    I use rental cars weekly when I travel for business. I usually use Hertz, not anymore. What they did wasn't a mistake, it's a travesty. No more Hertz, Thrifty, or Dollar rentals for this guy

      Same, started using Avis a while back (after one occasion when Hertz canceled a reservation I'd made months prior just days before my trip). Avis' service is way better. I'm glad I made the switch, and I will never even consider booking with Hertz ever again.

      One guy, they towed the damn car from him in the middle of the night. He called in the morning to report it stolen and they told him he was responsible for the cost of the car if it wasn't recovered. Then he remembered he left his toll pass in and might be able to at least track the general area the thieves took it to. The last checkpoint on the pass was a toll road to the airport. On a hunch, he went to the airport and checked the Hertz lot and what do you know?! His rental just drove itself back to Hertz when it got homesick! I think he later found a neighbor who got the tow truck on video, towing the car in the middle of the night.
      I'm so glad I never rented from Hertz. But after years of stories like this, I never will!

      I believe hertz is making fraudulent insurance claims by filing a police report. My theory is is that they file a police report to have “evidence” that the car has been stolen and use that to make an insurance claim. The insurance compensates Hertz for the “stolen” vehicle, but there is no stolen vehicle. I can almost guarantee that’s what’s going on. The feds need to get involved.

    I bought my two year old vehicle from Hertz in Atlanta and they tried to include a $1,500 warranty in the contract without my knowledge, which I had them remove. They were pissed. Despite an earlier promise that my car would be washed before I took possession, it was not washed and was even missing the owner's manual and even floor mats. This company is on my permanent sh*t list to avoid.

    I was a police investigator working auto theft cases, if I got a case like this I would investigate and when I found they were at fault I would try to file "filing a false police report" against them, it went to the county attorney and was never followed up on.as a police detective working fraud, I was assigned to some car dealerships that reported cars stolen due to their inventory screwups. In one case a man went to a dealer and looked at a car and test drove it, he was unsure whether he was going to buy it and left on Friday afternoon, on Saturday morning the "sales manager" brought the car to his home and insisted that he use it over the weekend with a free tank of gas. the man did so but decided to return it on Monday. When he went to the dealer to retrieve his car he was told his car was sold over the weekend. He was angry and the dealer told him it wasn't their problem. He left and they reported the car stolen. I got the case, investigated it and went to the county atty to discuss the case, I told the CA that the man didn't do anything wrong and the dealer was pulling a scam. The CA agreed and I went to a judge with a deputy CA and explained the case and the judge issued an order requiring the dealer to give the man the new car for the cost of his old car and ordered them to give him the title. Last laugh on the dealer.

      @EL ROBO I’m glad it worked out for the guy. The dealership really screwed up. Something kind of similar happened to my ex-husbands mom. She bought a new car and used her old car as a trade in. A couple of days later the dealership called her and told her she had to return the car because the deal didn’t go through with the finance company. She said she would bring the car back and she would be leaving with her old car. That’s when they told her they had sold her car. She told them she was not leaving the dealership without a car. They needed to get or old one back or she was keeping the new one. After a day and a few phone calls she ended up keeping the new car.

    I rented a Hertz car for a one-way trip lasting three hours. About an hour into the trip, I got a call on my cellphone from Hertz, wondering where their car was. I explained that I had just rented it and was on the way to my destination, where I was scheduled to drop off the car the following morning. The representative demanded I return it to the place I'd just left. I refused and hung up.
    I was so worried that instead of waiting the full 24 hours to return it, I returned it as soon as I arrived at my destination. Now I wonder if this wasn't a pressure tactic by Hertz to get me to give up the car a full 21 hours earlier than I was obligated to so they could re-rent it.
    Very unethical company. Won't rent from them again if I can help it.

      This is nothing compared to the video, but I once rented from hertz and they charged me $700 for cleaning the car after I returned it. Said I stained the seats, smoked in it, and got scratches on the outside. I called my credit card company and they got the charges taken off. I never smoked in, ate in, or scratched that car at all.

    I had a big problem with Hertz. I rented a van paid for 2 weeks in advance when I arrived at my place of business they gave me a call and said I need to bring the vehicle back because it needs an oil change. I told them where my location was and that I thought it would be fair for them to drive to me with a van that was properly maintained and then we could do the swap. They wanted nothing to do with it the whole thing ended up going to court. I had to hire a very expensive lawyer but I did not pay Hertz the additional monies that they wanted. To this day it ruined my perfect credit rating all because of this company. The problem with rentals is not only with Hurtz . I have dealt with a few companies that I had some problems with never had those problems years ago.

      From what I understand, in many of the false reports, it comes down to a clerk entering information incorrectly into their computer system.

Some of these people are actually victims, but the majority are not. In another news segment they interviewed a hertz manager who was arrested for stolen car. He admitted he had the car past the return date and claimed it's not stolen because the rental agency knew who had the car. That's a perverse logic to justify actually stealing a car and having to be arrested and taken to court to get him to pay the late fees even though he worked for the company and knew what he was doing was illegal. Several of the people interviewed admit to having the cars and being past the return date. That technically DOES make it theft because the rental agreement has a specified return date and failing to adhere to that date might result in another person who reserved the car being unable to get the car they legally paid for. Two sides to every story, the media only tells you the one that makes you angry.

      @@orppranator5230 We have a law enforcement branch just for this reason and don't permit private corporations to seize property when it's overdue. It's specifically in the description of what Sheriffs are responsible for executing. Hertz is following the laws, even if you don't like them. Jurisdictions without a Sheriff assume that role as the price of cheaping out and not having two separate police forces with different responsibilities.

    Olmost the same thing happened to my friend here in Houston,Tx but she was never arrested. They tried to file a stolen car report but the cops did investigate it before arresting her and showed the cop her rental agreement and the receipt for the 3 weeks she had the vehicle. Hertz still says she never paid and owes all this money! Its sad that this company is doing this to all these people and ruining their lives! SMH

    I worked for Avis for 10 years and we only had ever gotten unauthorized driver claims filed mostly. And we had only ever done that after a car had been overdue or missing for a month or more.
    For Hertz to file a STOLEN CAR report TWO DAYS before return is absolutely crazy. If you cant be a responsible business where people rely on your product for their livelihoods, you need to shut the doors.

      There is a reason you have heard about it for years. Hertz filed for bankruptcy at the beginning of the pandemic. They tried to categorically include all liability for actions prior to the bankruptcy filing. The judge refused saying that the issue looked like it required a detailed review and held it for after the rest of the bankruptcy was completed.
      Now the rest of the bankruptcy is completed and the judge didn't allow the civil liability from consumers to be discharged, partly because of the vast number of victims.
      Hertz also caused a man to sit in prison for 7 years on a murder conviction. They were issued a subpoena for a rental contract and ignored it. Then they claimed to have lost the record. They were ordered to send someone to answer to contempt charges and they miraculously found the documents which proved the man in prison couldn't have been at the murder scene. He was released.

    This seems to have been happening a lot more since the pandemic. I did use Dollar and Hertz (both owned by Hertz) just before the pandemic and everything went fine, but at this time I am, like many others are hesitant to use their services now that these false arrests are happening, while severely disrupting innocent civilians. I am also a Lyft driver and here in Denver I am renting an EV directly from them, not from a rental company. Lyft no longer partners with Hertz for their rentals but Uber still does. Next time my personal car becomes inoperable and I need a rental...I basically already have one! My money won't go to Hertz or its subsidiaries anymore.

    Apologize? They need to be sued and I mean several million dollars each claim.. these people lost their jobs and their lives and sat in jails and prisons and their lives were threatened with death by police.. there can only be one remedy.. a huge financial compensation for their loss and threats to their lives..

      Yes it will. It’s not like they were put in jail for life to define who they are. They weren’t physically or mentally hurt. They’re angry and will make sure to be heard. Once they are found innocent and they are, they’ll most likely sue Hertz, win in court and move on. Other tragedies of innocent people have been falsely accused and sent to jail and spent up to thirty years in jail, that changes their life forever. As these reporters said, it happened to several other people, too. So Hertz car rental will have several lawsuits against them. Too many other people have stolen rental cars or didn’t turn back the rental car when suppose to. Some people even damaged or destroyed the rental cars, that’s why car rental businesses have all these different contracts that customers have to sign. Keep all the paper work in anything a person rents or buy’s.

And if they got it wrong again and you say in prison, lost an eye ,and years of your life, maybe feared for your life a few times, you might get a couple mill that'll build you a mud castle that you get to see crumble before you die.       What's happening in these cases is a headless blunder. Incompetent staff losing paperwork and blindly following procedure. But what is more disturbing is the way the criminal justice system throws innocent people in jail for months awaiting trial, without anyone bothering to establish some basic facts.

      because they rack in money with collection fees even when you provide proof of terminated lease. see the collection dept often quote the law that allows them to run background checks on you ( for a large fee ) even though then grade another fee to the type of vehicle and the length of the lease and then of course the legal penalty on top and all the daily incremental fees if you respond and even when you don't .
      this is what makes it difficult to navigate the whole thing and that is when they haven't sent the police on your ass like they did with these gents.

    They did this to me, too. I rented the car, returned it at the time and place of _their_ choosing and within a few weeks, received a letter threatening me with legal action if I did not return the car immediately and that the matter would be referred to the district attorney. I immediately took the letter to the Hertz office (I happened to be near by) and the office rep not only said that the car was currently rented out to someone else, but thanked me for returning it to the alternate location _he_ requested (the county airport, for a discounted rate) because it helped him out. He took the letter and said he would take care of it. Apparently, he did because I never heard another word about it, but I do wish I had held onto it.

      I'm ex-law enforcement. Bro, you better make sure no wants/warrants are attached to your record in NCIC. There could be an active flag on you in the system, but you just haven't been pulled over by the police since the flag was pkaced on you.
      You can request a criminal history report be run on you through the FBI and by some local and state PDs. I've seen stuff like this spiral out of control; false positive hits in NCIC. I've since resigned over crap like this because the system just wouldn't fix itself. They don't care that lives get obliterated by this stuff.

      Cable company's do the simar thing when returning equipment when you have ended your contract or just going broadband only just so they can fine you for leaving (but doesn't usually end up with police turning up just debit collectors)

    7 MONTHS? That's time wasted away that he will NEVER get back. TIME that was stolen from him & his KIDS life. This situation should of been resolved the second the customer showed PROOF of rental purchased. How hard would of it had been after the person showed proof of purchase for the police to contact Hertz to confirm the receipt with them but instead locking away innocent people even when they have proof. Man I hope whoever had to do time get PAID, even those who didn't have to do anytime shouldn't have to deal with this type of bs.

    Funny, a few years ago I did a one way rental from the airport to a local Hertz rental place and a week after dropping the car off they sent a registered letter and had creditors calling claiming the car was not returned and overdue. That they had notified the police. I called the spot I dropped the car off, and they told me the car had been sitting there since I dropped it off... they had never sent anyone to pick it up. ALWAYS have recites/proof of drop off or rental agreement.

    Here’s an idea: The person filing the report must be personally responsible, so if it’s false, s/he goes to jail. If a person committed a crime and told the judge it was very rare, he’d be laughed out of court - and into a jail cell.

    My first thought is Boycott Hertz. I don't care if it's rare or not Hertz car company needs to be held responsible and they need to pay these gentleman for what they have lost in their lives. I knew something was wrong with the Hertz company but I wasn't sure what it was until now.

    This problem is with the Police, Courts and Herts. Why so much jail time even if they had proof and receipts for the rentals?? If I was the cops I would of gave them a citation for a court hearing towed the car, let the person go and let the courts decide the matter. That's ridiculous to still arrest them after showing proof of the rental smh

    Happens here in Winnipeg Canada too.
    If you book a car for say a week, with Sunday at 5pm the scheduled return time. But you ask what happens if you decide you need the car longer, they say it’s no problem since your credit card just gets billed.
    So my buddy rented a car. Car is supposed to be returned on a Thursday @ 5pm, but he knew his car wasn’t ready for pickup from the autobody shop, so he phones in on Wednesday to extend till Monday 5pm. Staff said no problem.
    Friday morning he gets stopped, the cars reported stolen, he’s arrested, cars towed.
    He gets charged for the stolen vehicle. The kicker is that the rental company had already billed his credit card till Monday AND the rental company forced a payment for the towing and lot fee onto his card.

    I never used Hertz here in Canada because they were always the most expensive and seemed elitist. I never had a problem with National Car Rental (no, I've never worked in the car rental business!). I rented cars on three separate trips to Great Britain and also never a problem there. Hertz should be embarrassed but large corporations are never embarrassed.

    The company should be shut down for a huge number of crimes:
    1. Filing false police reports
    2. Fraud
    3. Theft
    and finally, being criminally stupid to make over 20,000 false police reports of "stolen vehicles".

    A company that manufactures fake rental receipts and harass customers by putting them in jail is a severe offense. someone from the company must be put in jail with a huge monetary compensation.
