Meet Crystal Mason, the Black Texas Mother Facing 5+ Years in Prison for Voting in the 2016 Election

  • democracynow.org - We look at the shocking case of a Texas woman sentenced to five years in prison for illegally voting, who could now have even more time added to her sentence. Crystal Mason cast a provisional ballot in the 2016 presidential election despite having a past felony conviction for tax fraud that prevented her from voting. In March, she was convicted of illegal voting; she says she did not know that she was barred from casting a ballot in Texas due to her criminal record. Her supporters argue her conviction was racially biased, and point to the case of Terri Lynn Rote, a white woman in Iowa who was convicted of the same crime after she tried to vote for President Trump-twice. Rote was sentenced to two years’ probation and fined $750. Crystal Mason joins us along with her attorney, Kim Cole. Mason has a federal court hearing in Fort Worth, Texas, tomorrow, and if she loses the hearing, she will be heading to prison. We also speak with Marc Mauer, executive director of The Sentencing Project, about how policies restricting the voting rights of convicted felons disenfranchise more than 6 million people.

    The appellate court overturned the case and she didn't have to serve time. The algorithm brought this to me 3/31/2024. I'm thankful this nightmare is over for this woman, now rebuilding her life again

    This is insane! We have a Criminal so called President that is calling a real Criminal a good guy. That he’s no threat to society, Now how is this woman a threat to society? This is what our tax dollars are going to. This is unbelievable and sickening. Yes, they don’t want minority’s to vote in Texas. I live here and the Justice system is all about going after minority’s. Absolutely a case of unjust punishment just don’t count the vote and move on. Ridiculous. If she were white and I’d be willing to bet nothing would have happened. I’d also be willing to bet there were white people that tried to vote or did the same thing in Fort Worth and not a damn thing happened.
    This is a waste of tax money, this is a complete injustice and people need to stand up and tell these crooked judges and DA’s enough is enough. This makes me sick!

    Once you served your time, you should be allowed to vote again. And even if you think that somebody should not, this is too much. Especially since she didn't even knew that she broke the law. And I know that ignorance of the law protects you from being punished for breaking it, but it should play a role in deciding how to punish somebody for it. So, not only is this crime something that should not be a crime, she didn't even knew that she was breaking the law, hence they should leave it be and simply give her a flick on the wrist. A fine and if she can't pay that, community service, nothing more. Any time served in prison for this is too much.

      True, I agree. Once you serve time you paid your dues. Why does anyone who served their sentence have to branded over and over again. What is it about beating people's sense of dignity to the pulp? It's a cynical way of corrective strategies. Peace! Love! Hope! Unity! Forgiveness!

      But she haven't yet served her time. She was still serving her previous 5-year sentence for tax fraud. She was on supervised release. (A tiny little detail they just forgot to mention by accident in this non-biased inteview.)

    This is a waste of taxpayers money. She shouldn't go to prison for this especially since her vote did not count ultimately, and the election site staff gave her notice that it wouldn't if there were any issues.
    Ms. Mason final statement is one I can agree 💯 and 👍 to DN for giving her an opportunity to speak out publicly.

      In Sweden the voter has to be on an " electoral roll " for the area where I can vote, and that´s it! If you are not on it you can not vote. In Sweden this thing can not happen. I read about this case with Mason. When she found out that she was not in the register, they said that she could use a " provisional ballot ", but first she had to fill in an "Affidavit " on where she claimed that she had the right to vote. Looking on that form it says clearly that if she was a fellon and was on probation she could not vote! Mason says she missed that because she was doing the form together with someone working there, which St John the judge did not believe she had not seen. St John conceded though that a five year sentence that Mason got on the 30 of March was way to much. Mason have other things on her criminal records before and this thing together with earlier things led to this. On the 31st of Aug 2018 she got ten months in jail and 2 year and 2 months probation. Mason must have been unaware of the danger of signing the Affidavit and casting a vote!? I think, its hard to believe she did not see the warning on the Affidavit that a fellon and a person on probation were not allowed to vote. Anyway..why have this system of voting? use an electoral roll, like in Sweden, and this can not happen at all.

    In Texas _ex fellons CAN vote_ but she was not YET eligible to vote (under supervision, so a technicality). She did not know that, took the advice of the ballot worker, filled out the provisional cast. So her defense that she was not AWARE she was not eligible is quite plausible given that the general knowledge (of non lawyers) is: in Texas you can vote when you served your time.
    And she got the MAXIMUM time. As opposed to a woman that voted TWICE for Trump got 2 years on probation and a fine. Which in her case was lucky because she cannot claim, she didn't know what she was doing.
    5 years prison cost A LOT, it of course will severely impact her life, and what with children or dependent elderly relatives. If non prison punishment is possible (or you can give them a pass for being mistaken) and the person is obviously not a DANGER to society - why lock them up.
    Does that judge have connctions to the for profit prison industry ?
    Now, if probatition officiers would be remind ttheir clients to be careful with voting (there is a time when they do not yet have that right again) THAT would be a reasonable line of action.
    This is obviously a technicality so it would not change the outcome of the election (She may have been well eligible to vote next time).

I don't think race has anything to do with it... but in my opinion, she should be sentenced to community service and probation... not a draconian sentence of 5 years... that's ridiculous.

Around the same time that ideology started becoming more important to people than economic policy, the Koch Family started the Federalist Society, an organization that recruits conservative law students and grooms them for government positions like Congress & the Supreme Court in order to create & impact policy decisions.       Because of the way the nation's government is structured in levels of jurisdiction between federal, state, county/parish, and municipal government levels with the states being the building blocks of the nation, which is why the nation is named United States, the states retain some independence while at the same time cooperating to form a federal national government.

    Amy Goodman was incorrect to state that this case is similar as the Rote case. Rotes case is intentional, she voted then traveled to another precinct to vote. Here, she was uninformed by her case manager since Texas gives right to vote to those that has felony. So this goes down to the Texas system inadequacies not hers. But Texas judicial system is a known bias system so there's that.

      I sort of agree. If she was given bad advice, then I can understand. However, the document that she was given explicitly stated that a person in her situation could not vote. She signed it and voted anyway. I'd like to see if you put down on the affidavit that she was under supervision. Jail time is stupid, but she did break the law, which violated her terms of release. Her case is nothing like the Rote case, but not in her favor. The Rote case happens all the time. Like that lady who admitted to voting for Obama 7 times in one election.

    It says on the provisional ballot that she couldn't vote if she was still on supervised release, which she was.
    She said if there was a sign up on the wall she wouldn't have voted! There was a whole section on the ballot itself!
    No, she wasn't convicted of the same crime as the woman in Iowa. One woman had priors and one did not!

    This is so wrong. I remember her case and others. The people of color have definitely been treated differently for voting mistakenly versus the white people who voted deliberately extra times for tfg. It angers me to no end to see this prejudice in the system, in the people who were supposed to trust to uphold the law, not use it to persecute.

    So she filled out the form which states in short "Yes by voting I affirm that I am not restricted by law to vote, or I have been pardoned". Plus she claims she pays taxes, which Tax Evasion is why she went to Prison. She did not finish her sentence, she had to report to a probation officer, which comes down to asking what she should and should not do before heading out into the world. Or and she owes the Federal government 4.2 million in restitution. And she's somehow not at fault?

    A woman who claims that 'since she pays taxes' (who, not so coincidentally went to jail for evading
    paying multi-millions of dollars worth of federal taxes on behalf the clients of her's and her husband's
    fraudulent income tax service business), and who couldn't be bothered to read the bold-faced typed
    warning to current and former felons right at the top of the election ballot which clearly stated that she must complete ALL of her sentence relating to the crimes that she committed, including probation, who now attempts to submit a therefore illegal election ballot, wants to blame the system and claim "voter

      It's federal court. As long as they don't get the judge that she saw earlier then there's a chance plus there's appeals. However, the Fed prosecutor has to make sure they have all the elements of law sewn up. It looks like they don't, on elements of law of course. But in this judicial system?! Well, you never know.

    Therefore if a citizen is serious about remaining within the Law in his/her daily life that same citizen must know by 'heart' the thousands of Laws, by-laws and statutes which are in effect and which relate to their current activity at all times, whether it is simply crossing the street or entering into a Contract or they run the very real risk of being labelled a criminal by the state and 'paying' the price.     I love how everything now-a-days is predicated on racial biasness, and not on facts; for starters, the opening argument compared Crystal Mason from Texas with Terri Rote from Iowa. The commentator stated both women were involved with illegal voting, but Terri Rote received probation; whereas, Crystal Mason is facing a prison sentence. Honestly, the first thing I noticed was the state that the women reside in; unfortunately, voting regulation is state regulated, and each state has their own penal code. Basically, it's not based on race, but criminal code and geography, huh.

    It is each American citizen's responsibility to know the law, or to learn the law if they don't already know, and to then follow the law. She was on supervised release after having broken the law. It's not unreasonable to expect that she ask about or do some research on whether she's allowed to vote. Ignorance of the law is not an excuse for breaking it. The law isn't on a case-by-case basis; laws are laws, period. For everyone hating on those who uphold the law, your anger is misdirected. If you don't like the law, change the law. It is not the fault of law enforcement that these laws exist in the first place. Before you say that they're evil or whatever for upholding such "unjust" laws, you'd hate to see what kind of country this would be without law enforcement, I guarantee. Law enforcement keeps order in society and promotes a baseline level of pleasant existence for all. Learn your rights under the Constitution. The very First Amendment affords you the right "...to petition the Government for a redress of grievances,” and that's just the beginning. Use the Constitution in your favor to spark the change you desire, and take some responsibility as a Citizen of the U.S.

    People have waived their inalienable rights to a corporate form of government, your birth certificate "Not record of live birth" but birth certificate and Social Security Card should have you asking the right questions. Get a blacks law dictionary 4th Edition preferably and look up the terms certificate and person!

    Your not a pee civil war citizen, rather you are under the Dread Scott v Sandford Supreme Court Case decision of 1856. The 13th amendment and 14th Amendment reconstruction policy makes this clear. Political status is the issue here

    While I have great empathy for Black struggles, I am poignantly aware of the lack of air/face time for our Native brothers and sisters who live lives of desperation confined to reservations and the grinding poverty there. I wish DN! would consider having regular content that brings our Native brothers and sisters to the table. For far too long, Native peoples have been marginalized with media black-outs. I believe their voices should be heard, too. Please stop ignoring our Native peoples. Their lives matter, also. When John McCain became governor of Arizona, one of the very first things he did was to close all of the Bureau of Indian Affairs offices. These offices were responsible for distributing government cheese, lard, and flour. Arizona is a desert state. Temperatures can start at 120 degrees at six o'clock in the morning. Indians are confined to their reservations and whatever conditions are there. The government cheese, lard, and flour form critical staples in the diet (frybread) of these people. To my knowledge, NO ONE has done anything to see to it that the Indians in Arizona have replacement foods for what John McCain took away from them. Another reservation that is in dire straights is Pine Ridge. About two years ago, Red Rover; a humane society for animals, had to go onto Pine Ridge and remove all of the domestic animals because the poverty there is so great that the Indians were eating their own pets. I wrote Obama incessantly about the Indians. He gave lip-service to helping them but all I ever saw was a few pictures from photo-ops he used to give the appearance of doing something concrete. I don't believe anything was ever done; I don't know; there's never any reporting on things like this. Please help. Indian lives matter, too.

    The affidavit she filled out to vote clearly stated she needed to finish her entire probation before voting. Her and her lawyer merely blaming people is not an excuse to voter fraud. Does she even pay taxes like she claims after having served time for tax fraud? She got exactly what she deserved

      If you are a felon, you know you are not supposed to vote. All felons are informed of these limitations. She should have checked before she voted. These laws are stupid to begin with, I know. I think felons should be able to vote. But we all have to fallow stupid laws until we fix them. I think the efforts of the lawyer and this woman are misdirected. If the law reads a certain way, then that is the way it is to be upheld. If it is not upheld properly then you appeal it. This isn't an issue of race, it's an issue of bad laws. The even compare her case in Texas to a case in Iowa. this is comparing apples to oranges.
      (Added later): This case is really screwy. I'm reading more and more about it and there seems to be some major miscommunication. The sentence is too extreme in my opinion. I think under the circumstances this should have been a probation sentence at the least. But because she was already on supervision, the sentencing has to go further.
      The laws are misleading for her situation, but she would still be claiming ignorance. Should the probation officer have informed her? Yes. Is the state supposed to inform every citizen of every law? No. It really is a difficult case. I think this case should have been dropped considering everything I've read and heard.

      I found her explanations not good in the beginning, it took too long to come to the point. Pussyfooting aournd the justice system and the red establishment in that county. - I wanted to know about the specifics of the case first. For instance the information that fellons CAN VOTE IN TEXAS was a crucial. It makes the defense - she honestly didn't know that she wasn't eligible to vote YET - plausible.
      Then comes the second information, that there is some prejudice going on.
      And yes she needs to know that the lipstick is distracting. It is part of the professional representation, likely it looks better live, but not on camera. - hope she is better rhetorically in court. (Not to take away from your accomplishments but being smart regarding the law is not enough, it must translate into the communication)

    Well after she does her 5 years maybe she will learn the law while in prison so she can learn the law for her voting in the future.
