    Hi Ashika,
    I am applying for ILR VISA as Spouse of my husband who is a British citizen. He purchased a house in December 2020 and I live with him. I have been living with him since December 2017.
    I got my BRP on 23rd of November and I first arrived in UK on 6th of December 2017.
    There are three questions which I need help from you to answer
    Question 1
    Do you own or rent your home?
    Options are
    Own
    Rent
    Neither own or rent
    Question 2
    How much mortgage you pay each month?
    If you do not have mortgage enter 0
    Because of the matrimonial rights I have, should I answer I own the house. My husband pays all the mortgage and council tax bills. I do not pay the mortgage, so should I enter the mortgage amount my husband pays or should I enter 0.
    The third question I need help is
    How long have you lived in UK
    The answer option is as below
    Years_____ months______
    For Set M ILR application of spouse the period required is 5 years. However, you can apply the application 28 days before the date.
    I had BRP issued on 23rd of November 2017, entry clearance on 29th of November 2017 arrived UK on 6th of December 2017.
    So which date should I consider for 5 years?
    As it will be 4 years 11 months + 2weeks by the time I apply should I answer the question as below;
    How long you have lived in UK as
    5 years and 0 months
    or
    4 years and 11 months.
    Greatly appreciate if you can help answer these questions.

      Hi, since you can't apply for ILR on an ICT, you should consider listing yourself as a dependent on your wife's visa. That way, you both can apply for an ILR on her visa.

      Hi Sohag, thank you for the kind words. To be eligible for an ILR under most visas, you'd have to be in the country legally for 5yrs. So ideally, you or your wife would need to get a skilled worker visa to be eligible.

    - I was on T2 ICT long term visa for 2 years from Dec 2019 - Aug 2021 and then switched to Skilled worker visa in Aug -2021. To apply for ILR - should I stay continuously for 5 more years on Skilled worker visa or would my stay on T2 ICT visa count?
    - About the 180 days rule, if I stay outside the country from Aug 2022 to May2023 - will it be considered as more than 180 days and affect the application to ILR?

      - as far as I'm aware, no time you've spent on an ICT counts towards the 5 continuous yrs required for an ILR.
      - Yes, if you are applying for an ILR, you cannot be outside the country for more than 180 days in any 12 months (You must have spent no more than 180 days outside the UK in any 12 months - www.gov.uk/indefinite-leave-to-remain-tier-2-t2-skilled-worker-visa/time-uk)

    I have questions rgdng the ILR
    I have got skilled worker visa for 5 years but , unknowingly I have started my job one month late (because I was moving from a different country with the my spouse and 1 year old kid )
    Now In future in order to apply for ILR
    when I calculate it will be 4 years and 11 months of work and stay , and my visa expires after that ,and I am not reaching 5 years of work and stay in Uk .
    How can I extend the visa for couple of months ? Do I have to get sponsorship again ?

      Hi Vikas, to settle you'll have to move from an ICT visa to a skilled worker visa. You can't get an ILR on an ICT. You can switch from an ICT to a skilled worker visa from within the UK

I am going to apply for settlement ILR under the tier2 scheme and I know the earliest I can apply is 28 days before my 5 years fills & also before my current visa expires.       "You must have spent no more than 180 days outside the UK in any 12 months" so if you've been outside the UK for 2yrs it might be a problem.

    It seems to me that people just don’t know how to find the information from Google, or just don’t want to bother doing that, if someone else can find that out for them. Try to help yourself first. I am nearly 74, if I want to know something, I Google for the info.

      Hi Kishan, the UK investor visa no longer exists, but instead there is an Innovator visa (www.gov.uk/innovator-visa) and a start up visa (www.gov.uk/start-up-visa). You'll find all the information on these two links.

      Hi there. You need to be in the UK for 5yrs atleast in most cases for a PR. Which means in most cases you'd need to work after completing your course.
