- Disgraced Hollywood mogul Harvey Weinstein's 2020 rape conviction in New York has been overturned, on the basis that he did not receive a fair trial.
The New York Court of Appeals said prosecutors in the pivotal #MeToo case called witnesses whose accusations were not part of the charges against him.
The court said that meant he was unfairly tried for past behaviour, and ordered a new trial.
Weinstein, 72, will remain in prison for a separate conviction for rape. He
denies the allegations from Ashley Judd.

Yeah, I remember from what little I know about law. You can't do what the first judge allowed. I'd be looking at that judge rather than the judges who now have to overturn it.
I mean, you get tried for what you are getting tried for. You can't then bring up other crimes to try and slander the person you have on trial. Have to ask why they allowed that?

Eye witness testimony is largely unreliable because it's not evidence - so it shouldn't be presented as such. Let alone cases not related to the trial itself.
"Anti-Prosecution judge". How is that okay? If a judge has a known bias then they shouldn't be a judge. This is lunacy.

All judges have certain biases, they're human after all. They're supposed to disqualify themselves in a case where he or she is biased and to hear all cases where he or she is not biased. But obviously it doesn't happen often, and it's very hard to prove actual bias.
Basically a judge must be shown to be *so* committed to a particular outcome that evidence and arguments presented will _never_ alter that outcome.
It's very delicate to actually prove...
Everyone in jail/prison knows which judges are fair and which one are hardcore headcases, but "everyone knows" isn't proof...
Precedent rulings aren't proof either, nor is a general predisposition. It's tough.

Tarantino said he confronted Weinstein. He banned him from contact with Thurman for the remainder of the film's production.

While Weinstein is most likely guilty, the judge who allowed random people to make statements against him for unrelated crimes to the one he was in court for is absolutely in the wrong.
He needs to be released on health grounds.

The judge in the original trial needs to go to prison for not doing his job properly. If not then it portray's the image to the rest of the world that the American legal system is falling apart.
