Pesci just happened to play tony spilotro(Chicago gangster in Casino) and pesci played tommy Desimone in the movie goodfellas. While your correct spilotro was murdered in a based not a cornfield, They used the wrong clip from the wrong movie.

I’m not sure how this guy got around this law except that it was likely pretty easy to write the book in a way that made it more about setting his father up and all that entailed as opposed to simply listing all his crimes with the details etc etc. that’s my guess anyway.
