  • The case is about a lawsuit for damages resulting from a warrantless wiretap authorized by a former Attorney General in 1970. The court is considering whether the Attorney General has immunity from suit for actions taken in the interest of national security, whether the finding of the District Court on immunity is appealable, and whether the District Court's ruling on qualified immunity was correct. The Supreme Court concluded that the Attorney General is not entitled to absolute immunity from civil damages actions arising out of his allegedly unconstitutional conduct, despite the fact that other officials have been afforded absolute immunity in certain circumstances.
