If you didn't run up debt on your mom's account or co-sign a loan for her, you are NOT RESPONSIBLE for her debt. Pure and simple.
Consumer protection attorney’s make a good living suing companies that make these harassing phone calls; over $1,000 per phone call.
Mentioning that you’re recording it and sending it to an attorney will end it.

If she’s panicking while on the phone with these people the mother may even be giving the daughter’s number out to give her a reprieve.
They may have even researched it. The amount of data that is out there now is unbelievable.

@P Maitra Not necessarily. I once got a collection call for my ex husband. I had been remarried for 6 or 7 years, and I'd moved 6 times (across the country!) by then. I had never in any way been connected to that bill. The bill collector KNEW that, and still called me!!!

I have no debtors calling me...but would be fun with the scam callers.
I had this issue two years ago when my roommate was placed in a nursing home because of some issues. Before she was committed to a nursing home , she ran up thousands of dollars of debt and kept getting phone calls regarding her debt. I told them that I'm not responsible for the debt that she ran up and to stop calling me or I'll sue them because they were in violation of both connecticut state law and federal law. I haven't heard from them since.
I'm shocked Dave never asked her the $64000 question...."Did you co-sign any of these loans?"......most likely she didn't then everything Dave said was perfect. Dave, this one was kinda sloppy.

The woman said she was careful with her money. Co-signing isn’t being careful.
Years back a credit card company lady told me she "really disappointed" that I couldn't pay them that day - I knww immediately it was psychological warfare and I was livid. Unless your my wife or the good Lord, I don't give a rats arse if a stranger on the phone is "disappointed". Can't say I blame her though, I'm sure that was her training, on a recorded line and she was required to say that.
Record the convo? I would act nice and ask them to send/email details of the loan to you so you can look at sorting out the problem. They don't know that "sorting out the problem" is suing them based on the fact they divulged details of someone else's loan to you. The email becomes proof and evidence.

The one vital question that Dave did not pose to this caller is whether she and/or her husband co-signed or guaranteed the mother's loan......
Facts. If she cosigned or her husband at all. It's over.
There is also collateral contacts you must put down on a loan application. The mother is just borrowing without thought to the poor daughter. Mom needs her parent card ripped. 💳

Well, the collectors had called other people too. They can't all have co-signed so either way, the collectors are breaking the law.

Her mom could have forged her signature to secure some of that debt. She better make sure she is not part of the debt before she blows them off or threatens them with legal action. Her mom could end up in prison.
Foreal check that credit
For loans, they ask for collateral contacts in case it goes awry. That's why they are calling her daughter. The daughter is just an innocent victim. The the thing is, they cannot attempt to collect debt from anyone but the mother. It happens a lot. They will also try to tack a debt that isn't yours on you and then call you about it to try to get someone to pay it. They don't care, they just want anyone to pay money. Some are ruthless.
Yeah, if I ever found out that my narcissistic mother signed me up for any debt or provided my SS # to my sister for that, one or both are going to do time and I don’t care that my mother is 75. If you’re still smart and coherent enough to know how to do that, you should do time.

To all the people who say is she may have co-signed on something remember that she said that she and her husband have been careful with their financial affairs so I doubt the would have co-signed on anything.

Man this might be my favorite Dave video yet. I had a similar situation with a debt collector calling about a debt my father had. I was pleasant at first, told him I would inform my dad they were trying to reach him. When the calls continued I told him right off and he never called back. I agree with Dave 100%, if you don't want to be a scumbag don't work in debt collection.

Air horn alternative : just put the phone down and walk away. Don't hang up just put the phone down and tie up their phone line. They can't make any money if they can't make calls.
Copious amounts of TMI works as well.

The line will free up in about a minute. The air horn is MUCH more effective, trust me. The WON'T call back. Used it when scammers were harassing my parents in -law. Worked like a charm, lol.

Dave definitely missed this simple question, which is unlike him. The likelihood they called and just started stating her mother’s information 1. Without the daughter being a co-signer or 2. The daughter lied and said she was the mother is highly unlikely. She’s not telling the full story it seems.

I've had calls from collectors for delinquent family members who, without my permission, gave my info as a reference/contact when they applied for the loan. Interesting that they not only called her, but her husband and his parents. And, at approximately 1:49, she says the said they tried to tell her that she needs to take over the bill.
@@darlar.9043 I suppose they likely didn't cosign the loans if they're contacting anyone related. Just desperate companies trying to get their money back by any means.
I used to get these kind of calls from my ex-wife's creditors - I just said "wrong number" and hung up.
terry waller depends on how the divorce papers were written. Divorce papers include who is responsible for what debt.

No trouble. Contact me. As a CPA, I had a similar problem with my Mom. I sent certified letters telling them, and that was the end of it. Our attorneys helped too. Once the collectors know whom they're dealing with, they go away,

As a debt collector, odds are they’re just calling to find her number. Tell them you want your number on the do not call list. Keep track of the company name so they don’t violate. Odds are they won’t. Because collectors can be personally sued.
Debt collectors are not subject to the do not call list.
@@radolfkalis4041 they are with each individual company. If you tell company ABC not to call your number anymore, they cannot. Doesn’t mean they can’t call any other number of yours or send notices in the mail. But that number is now DNC - do not call.
@@omgitsyelhsa13 I THINK you have to notify them in writing not to call you again. Just the no call list will not keep them from calling you, just like it will not keep your bank from soliciting you.

I understand there is a schedule to keep and more people on the line waiting to have their call answered, but I feel a bit bad for the people he cuts off when they are still trying to say something or to ask another question.
Could sign their number up for 50k robo calls a day plus the Indian IRS scammers. Send em all to them.
Yeah I had people calling me and my Mum about a brother's debt. They also tried to talk us into signing for the debt or "taking over the debt" (and of course we dont know how much it was but wouldn't consider it no matter how small it was). As if we're stupid enough to make ourselves legally responsible for any debt, especially with no knowledge of how much it is. They do try though...
I had a co-worker who used to pretend he had just murdered his family seconds before. It made the callers hang up quick. Of course, in these more "sensitive" times, I wouldn't recommend his strategy. Probably bring out the national guard nowadays.

And also, they didn't specify where the money was owed- student loans actually can reach to the other people whom the student listed as contacts if they could not get a hold of them when signing the promisery note.

Clearly, Dave hates debt collectors. We don't know if she cosigned from this clip. The easiest thing to do is block the number, and don't accept calls you don't know who they are.
Well she said they were calling her husband's parents about the debt too, so either she didn't cosign or they're breaking the law by telling them.
Mr. Ramsey sounds really different on CZcams vs. on my AM radio (KSFO 560 AM).
I wouldn't even waste my time talking to them but it seems like their scare tactics must work or they wouldnt take the risk to do it.

Collectors call debtor's places of employment nowadays. I use to get calls all the time for some of our employees I would tell them to quit calling. We had people quit their jobs because of these Harrassing phone calls. We even had them calling after the employees quit these were non garnishable Harrassing non stop calls. I don't work their anymore but know that this lady is telling the truth.
I'm a debt collector. It is not against fdcpa to call 3rd parties. It is illegal to call 3rd parties and disclose what you're calling about (ie: telling them you're a debt collector, telling 3rd parties what amount is owed. Etc) .
A lot of times we are calling 3rd parties to get in Contact with borrowers who will not answer their phones.
Also, its important to speak to debt collectors (depending on the type of debt) because we can usually work out something to avoid us garnishing your paychecks(which can be upto 15% of your paycheck).
I hate the negative connotation that debt collectors have.

the easiest way to deal with this is dont pick up the phone if you dont know the phone number i dont pick up any phone calls unless i have the number programmed in my contacts
I would personally answer, record, tell them I am NOT the debtor, state my name, ask for them to email details to my email address (set up just for this) and when they call back, state you never got the email, have them do it again, then turn each debt collector "files" to the mother and let her sue for $3k each. She can offer to drop the charges for written acknowledgement that they will mark the payment as paid in full, not resell the debt, and remove the "account" from the credit reports. Keep that documentation forever.
They don't like to be sued over federal violations because they are less likely to be hired as a third party collector on behalf of larger collection agencies, like portfolio.
The problem with the air horn, whistle or any loud noise they don't work as well over a cell phone as it use to in a landline .
true. they dont do much, if anything, over digital lines which is 99.9% of what the world uses these days. the dynamic range is highly compressed so the lows and highs have very little range in between them.
How would they even get her number. Mom putting her number on forms. Moms going to sue them when she's in debt ha. I hate scam callers but sorry if you get in debt gotta pay the piper. But if she co signed the loan she is on the hook.

Facts you missed:
A) Was she a cosigner on the accounts?
B) Did they tell her any information about the accounts if she wasn't or wasn't authorized by her mom?
C) You can tell them to no call you anymore without getting rude or airhorn.
Makng a threat to them means nothing. She should file a complaint with the FTC who will follow thru and demand they stop calling and possibly even fine them. They can be fined for each violation of the Fair Debt collections act.
Not your debt so just hang up the phone or troll them. Pick one. xD
It's fascinating how Dave treats different callers differently. With women who are facing the consequences of their own bad decisions, his kindness and empathy is seemingly limitless, and when he does call them out it is very indirectly--something like "people who [do stupid thing that caller is doing] generally need to [do something totally opposite that]". But with women who have gotten in trouble because they let themselves get pushed around and manipulated by others, he is much less patient and much quicker to cut them off. It's almost like he's telling them to "stop acting like a wuss and BE A MAN!"
...except she probably put them down as a reference on the credit applications which gives them her permission to talk about this with those people.

@@WoWo37 no...the whole point of the references is to have someone to contact in case you default so they can try and find a way to get a hold of you. Just better to avoid loans altogether...then you don't deal with that nonsense in the first place.
I'd make sure you are not somehow involved. People have had their names forged. Less drastically speaking your name could have been given as a reference. True story ...... I friended a family member on Facebook I hadn't spoken to in years. I learned they were delinquent on their mortgage in less than 2 weeks.
I had one that kept calling my house phone looking for my mom. Funny thing was, they always called when I was at work. They would leave a message on my answering machine and it would say, "I'm looking for...I need her to call me at this number. If you're listening to this message, you're acknowledging that you are...You need to call me back at this number." I would laugh because I was thinking, "How am I acknowledging that I'm her by listening to a message on my answering machine?" Anyway, I never answered when they called and they finally stopped calling me. Then they tried to call my sister, who is a lawyer. She did answer her phone and the guy tried to tell her that she had to tell him our mother's phone number. She said that she didn't have to tell him anything. She didn't even have to tell him if she knew the person that he was calling about or not. Then, he got pushy. She told him that she's a lawyer and if he calls her again, she will sue him for harassment. That company never called my sister again. Neither one of us co-signed a loan for our mother, by the way. There are companies that can somehow find out information about your family members and start harassing them if you don't pay a debt. So it's highly possible that this woman never had anything to do with her mother's debt.
I'm going to try the sports air horn for spam callers.

He is not mad at the creditor. They have sold the debt off to a debt collector who buys the debt for 5-10 cents on the dollar and then tries to collect as much as they can. Usually the full debt plus trumped up fees, interest and late charges. He is mad at the debt collector.

Because they’re violating federal law and harassing people who are not at all involved with the debt they’re calling about
I actually do not know how you can spend $400,000 on credit. What would you buy short of a house, I just can't imagine.
If she co-signed then they can legit come after her for the debt.
But if they got her personal info any other way, they are in deep organic animal waste material.
All you have to say is "wrong number, please cease."
And, for the love of all that is holy, know the difference between a credit card collector/debt buying company and a customer service-focused debt collection agency. No need to be rude to someone who legitimately wants to help you and brainstorm flexible solutions to pay debt that you owe. A reputable agency will NOT divulge any information to anyone other than the debtor and will ask for more than one piece of verifying information to ensure they're speaking with the debtor.
I love Dave Ramsey but not all collectors buy debt and are out to get you. Some agencies will fire employees in a heartbeat for trying to strong arm people out of money instead of respectfully discussing manageable options. And certainly for breaking federal law.
What I've done, after one free notice that it's not my debt, is play the religious conversion card per se.
I pull out my best Southern Baptist accent, and I will seek to convert them. Using how Jesus died for your sin, and this job you are doing, is a constant dark Sin.
I tell him, You can stop this, right here. right now, get on your knees and pray with me for your forgiveness and then pray for the others to have the strength to walk upon the righteous path, forsaking the evil road. Perhaps a nice bible study at work.
If you push personal, hardcore conversation on them, they either get converted, or they never dial your number again.
I think Dave still has sone resentment over his past issues with debt collectors. He seems to be taking this too personal. Warning creditors is good idea. Getting nasty and blowing horns is not very nice or Christian. Debt collectors are people too.
When I take out a loan or apply for a credit card, I never mention family members. If they ask??, I just put single with no kids, parents past away.

They will just auto generate another number in a couple days. I keep getting scammers (IRS, etc.) calling, even my own phone number calling me. They will just find another way. They are nasty.
Dave doesn’t like collectors. But he is an employer and if he provides a service that doesn’t get paid, he will go to collections.
