  • The plaintiff says she hired the defendant to do some bathroom renovations, but he kept making excuses about licenses and didn’t complete the work. She’s suing to get her deposit balance back. The defendant claims the plaintiff is to blame because she never got the correct renovation approvals from her landlord. He’s countersuing for lost wages.

      I agree with the second one but the first one makes sense in an odd way.
      His silliness is a common thing of workers (especially journeymen) who follow their dream of branching off on their own focused only on their abilities. They often get hit with the tidal wave of business management and drown as they grasp at straws of information, leading to more problems than they know what to do with.

      @@arinalis3130 absolutely! I 100% agree. But I am adding the tidbit that this is a common result when a journeyman with no business management skills decides to start their own business.
      All skills in the work, but they drown in stupidity when it comes to management and additional expenses they cheap out on. (hence why there is a degree for thosr skills)

      @@Maninawig Yes I was getting quotes for a fence and was having trouble finding someone available soon as another contractor led us on for months then backed out at last minute. One told me about a guy who had branched out on his own and was available. I got a quote hand written on foolscap paper like kids use at school and he took photos to send to me.The quote was nearly twice the price of others. I knew immediately why he was available when the others weren't. He had no idea about professionalism and thought he could charge what he wanted. If he couldn't give me a quote in a professional way, I could imagine how the fence would end up.

      Absolutely, totally agree with you. I wish she would allow the litigants to speak and stop yelling at them. She asks a question, then answers for them and when they're able to respond, she yells at them because their responses don't correspond to her liking. Judge Milian is so arrogant, she needs to be humbled.

      Back in grade school there were still a couple of families who were so poor they gave their kids " Bowl " haircuts, but then most people grow up and get a job and pay a barber to give them a grown up haircut. I don't get why an adult would humiliate themselves like that if they didn't have to.

    Judge Milian, when you bark at a litigant, ”Stop talking over me!” and the litigant has not been permitted to say THREE WORDS since you sat down, you lose all credibility with me. The poor plantiff! You berated her, and she wasn’t even at fault (as you rightly found in the end).

      @@Rats1991 There is a time limit, Judge Judy asks specific questions and won't let them go off on a tangent. Same scenario. She needs certain info, it is a waste of her time if they keep rambling. but regardless of that, it is rude to speak over someone speaking especially a Judge

      Why did the plaintiff need to keep trying to interject comments when the Judge got it and was already on her side? She did that at least 3 times before the Judge told her to stop. Sometimes you just need to shut up and let things unfold. Especially when it’s clear, and it was clear, things are going your way. And I’m sure the Judge will spend night after night, tossing and turning over losing credibility with you. Are you that important? Sheesh, get over yourself!

    From experience as a contractor. This construction industry is ravenous. A good salesman who don't know the difference of a hammer from a nail can get a contract for $10,000.00 that I cant get for $5,000.00.

    Yes. I'm a woman. I've been doing my own home repairs and improvements for many years, like replacing drywall, interior & exterior painting, refinishing ceilings, removing & installing new light fixtures, installing flooring, removing old toilets and faucets and installing new ones, building shelving, etc.....but some things I can't do by myself, like replacing an exterior door. I don't have the upper body strength to lift that thing (I'm not very big), and I don't own a truck that I can use to transport it from store to house.
    Contractors I've spoken to treat me like I'm stupid. Like I don't know that the door I purchase has to fit. Like I don't know the cost of materials or the labor involved.
    I also would like new flooring in part of my house, and I've researched it extensively. I've done flooring myself in the past. I have internet access, and I'm not an idiot. But they treat me like one. They double the price of the flooring (like I can't look up how much it costs), they explain patiently (like I'm a child) that they will charge for labor (duh), they tell me that I must purchase the flooring (duh). I'm so tired of contractors treating me like an idiot and trying to over-charge me for materials that although I've got the money to pay someone & I'd rather not do it myself because it's going to kill my knees, I'm going to just do it myself anyway.

      I so agree with you. And Its worse here in India...and there is no such thing as people's court. One is forced to be on one's feet supervising ANY job...or else they will cheat & be more than shoddy in the work.
      Can't leave your scooter or car in a garage...they may steal parts, replacing them with duplicates or spurious parts, then find 'problems' where there are none...in order to run up a huge bill...!
      Once trying to get an iron gate made and installed...two men quoted exhorbitant costs...when I asked "what guage for the thickness?" they were stumped. I found a third one that made a simple gate I needed for half the cost, and repaired a panel on another small gate in that included cost.
      One scooter mechanic dramatically stated "the rectifier needs to be changed, " when the good new scooter was barely 2 months old. I did not agree and found another one after a mighty search.. and all he did was clean the petrol filters( which was the only thing that was really needed) and of course I stood over him like a hawk while he was doing it...& thereafter I got the overhauling done only by him...always being present...for 14 long years!! Lot of time and energy in much anxiety has to be expended in getting any repairs done in India.I did many plumbing jobs I could do on my own. I learnt to go buy materials from shops myself so the carpenter or plumber or painter did not cheat!
      Its awful .... one has to drop all of 'one's ' own work just to supervise 'their' work. Just because you're a woman. They take even more advantage of any elderly woman who's widowed or with disability - any single woman in particular. In the material shops they look at you as if you're from another planet...since few women go buy hardware themselves. I once went to buy a 'cotton' rope and the guy went on and on about how a nylon rope is better etc. without knowing I knew exactly WHY I wanted a cotton rope!!

      Yes it's a shame that there are dishonest contractors out there that take advantage of people. But honestly I don't think it has anything to do with person's sex. I've met plenty of guys that ware taken advantage of as well, just because they are like a lawyer or computer programmer or something like that and don't really understand construction. I'm a contractor myself and I have had other "contractors" try to bullshit me (Like adding 15% mark up to materials & charging 3 hours to go get them at the same time, is a real common scam). This goes both ways though, when I was younger and just starting out in this business I've had few people take advantage of me as well, both men and women. Scope Creep is a very common scam, where a property owner hires someone to let's say paint a room for $100, while the person is there the owner asks just to do few more "small" jobs for them, but once these additional jobs are performed the property owner refuses to pay more than the original $100 arguing "that's what we agreed on". I've had that scam ran on me a few times.

And would take me home until he was happy. It was under the guise as take me out to have a look at a job ,which was out of town and an hour drive . We did have a history before that in high school, but i hadn't seen him for over 20 years in between. Wow that guy was nuts ...
      Yes there all all sorts of scammers out there that try to take advantage of anyone they feel they can. I've also been scammed by other so called contractors. Ive worked for guys that tell me its the customer that stiffed us all, and turns out it was the head contractor. 😞

    Golden rule of courtroom programs like this is, as a litigant you _DO NOT_ approach (or move toward) the bench with evidence; instead you hand it to the bailiff. Defendant with the 2nd grader haircut nearly failed at least once ( 3:35 ).

    The question becomes did the customer notify the contractor of the declined license? If not then customer is liable. There was no argument that the license could be declined. She failed at that point to properly go through the flow of red-tape. She signed anyway.

      I don't think he is incompetent, just inexperienced in business management. What he has shown in court, with his organization of actually having a contract although misworded, fumbling to explain his understanding, and consulting a lawyer without retaining one is a common sign of a hard worker who is trying to branch off on their own.
      Though I believe tradesmen should definitely strive for the excellence that you'd stake your name on your work, this is what results when that ambition is not met with the study or budget of what it takes to assume the management side they have yet to experience.
      Sadly, between the lack of knowledge in startup companies and the legal misunderstandings in circulation (most of which get slapped in court as his contract did), more companies fail before they get up on their feet.
      Sadder yet is that sharing such a desire with your employer before you leave can open up the doors to go from employee to subcontractor in order to gain that missing education.

    There was a small kitchen fire in April 2018. The contractor said it would take 3 to 4 months. At the most. Because it was just the stove , the cabinet & a small square in ceiling. IT TOOK THEM A LITTLE UNDER 3 YEARS TO GET WORK & PAYMENTS COMPLETE. They had all my house packed up & moved out within 1 week. Then NOTHING for 10 months. And AFTER MY INSURANCE ENDING PAYING MORE THAN WHAT I PAID FOR THE HOUSE. THEY SPENT OVER 200,000$. THE MANAGEMENT COMPANY WE WERE USING ENDED UP GUTTING MOST OF THE HOUSE. TO THIS DAY THERE IS STILL SO MUCH THAT HAS TO BE FIX/FINISHED. THE KITCHEN CABINETS ARE THE WRONG SIZE & WRONG SETUP, KITCHEN WALL WAS NEVER SEALED BEHIND CABINETS & STOVE. SO THERE IS AN INCH OF OPEN SPACE. THEY RIPPED OUT MY HALLWAY CLOSET TILE TO TRY & FIX BUT YOU CAN STILL SEE IT. BOTH BATHROOM PAINT JOB SUCKS. PAINT ROLLING DOWN IT. THEY THREW AWAY MY CLOSET DOOR RAILS, PAINT IS PEELING IN THE BATHROOMS, I COULD GO ON FOR DAYS. I MIGHT BE SLOW BUT I'M FIXING ALL THE ISSUES. This was the worst. My son & he dad were at a motel & I was in a tent in the back yard with my dogs. It was hell for us

      @@1984nique no what i did was sent the CEO an email that showed I had pictures done daily all date & time stamp. I took pics everyday. Work or no work done. I had video's of his staff & all the crap they said & did. To top it off I had every Single text, email his crew EVER sent. To include all the times they lied. With in 3 days they settled with us. I now know never go through a fire management group. You do the work, they get the pay.

    POSSIBLY messed up- 50/50 call- My thoughts are Judge Judy would NOT have given the plaintiff her money back if the defendant spoke the truth that he told her there was a possibility he couldn't do the work.
    Judge Judy: "You pay for cheap, you pay for what you get. If he told you there was a possibility he couldn't do it, you shouldn't have chosen him."
    Judge Judy, from what I've watched of her, tells me this is all the plaintiff's vault.

    Ya know... I’ve seen a lot of these and it seems to me men are not the best at coming up with valid arguments with solid evidence. It’s so cringey to watch. They probably should’ve had a women look over their paperwork before going to court in national television. Would’ve saved them a lot of embarrassment. In my opinion.

      Not a con artist but a pup in over his head.
      What he said had the confidence in his labour abilities but lacked the understanding behind the management needed to run a company. It is common to see when a labourer acts in the thought "I have been a darn good journeyman and I don't think my boss should get a portion of my wage. I know I am good enough to start my own business."
      This often happens without understanding to manage said business, though his acceptance of the verdict also shows that he is willing to learn to do things right, just lacks the proper guidance.

    Wow. I've seen several cases where the defendant claimed they offered all the money back and the plaintiff wouldn't take it. This is actually the first time it was true. In other words there was no reason for this to come to court. She's got some issues.

    The work was supposed to start on 2/14, the co-op board got back to them on 2/15.
    Sounds like it isn't the defendant's fault anyway.

    The plaintiff is lucky the contractor gave her the $1900 back. Most would have kept it, delaying the work that they would do, or steal it all. This contractor only kept part of it not all.
    For everyone - be careful with contractors. Talk to family and friends and they’ll tell you.
