    Official acts is ambiguous, providing no clarity on the scope of what’s categorized as official, the boundary between official and unofficial, the upper limits of official acts that encompass unconstitutional acts, and the extent to which immunity extends into high crimes and misdemeanors as a foundation for impeachment.
    It’s a problem that was created to carve out protections for one particular person who has sought immunity from prosecution.
    It’s a dangerous problem and one that cannot be remedied through historical, academic, or philosophical inquiry or analysis related to a liberal democracy and constitutional republic. It runs into an underlying inconsistency and paradox as related to those phenomena.

      Worse yet is in order for the precedent to be set to define an official act… a case has to be brought. Meaning in order to determine if a military coup by the president is an official act, the president first has to stage a military coup😂😂.     The idea that the President is totally immune from prosecution from anything he does in his official role as President is absurd. Taking money for a pardon or an ambassador position? Totally immune. Telling DOJ to go after his political enemies? Totally immune. Firing Cabinet officials for not following orders, even if those orders are illegal? Immune.
    And then they went even further and said that not only can the President not be prosecuted for "official acts" but the motives behind the acts cannot be questioned, and the acts cannot be used as evidence in investigations. Where in the Constitution does it say any of that?
    It's interesting how this court picks and chooses when originalism and textualism apply, and when it doesn't. If the Founders wanted the President to have any type of immunity, they would have said so, like they did with the speech and debate clause concerning members of Congress, but they didn't.

      @@jmartin5607No, it isn’t an acceptable ruling nor is it consistent with the constitution. It is incredibly dangerous for democracy. With this ruling, a sitting president could poison his political rivals, jail those of an opposition party, refuse to leave power, accept bribes, etc. without any sort of repercussions. Impeachment is a method to remove a government official, not hold them legally accountable. One is political, the other is legal. No matter how you feel about Trump or any politician, this is a dangerous ruling that opens the door to new forms of political corruption in this country never seen before.

      I would go further to say ANYONE has the right, under free speech, to question an election. That person, or any person, also has the right to "request" someone to take an action, as long as there is no threats or illegal repercussions tied to the request. Nothing there is illegal. Even if a president, or anyone, "requests" someone to do an illegal act, that is not breaking the law. Only if that requested person breaks the law under your request, then one can be charged as an accessory.

      Not at all!! The SCOTUS is not paid by the hour nor by the case decision made. They interpret the law. They get an annual salary. So no additional tax payer cost for them. Trump paid for his own attorneys so no tax payer cost there.
      The DEMs currently own the FBI and are blatantly using them to fight Trump and the GOP, that is the scary part; politicizing law enforcement which is why they were able to allege these supposed "crimes". The federal prosecutors/DAs/PAs are also on salary and they would be working on some other case if not this one so no additional tax payer cost there either.

    Isn’t this what is defined in our constitution? Please keep in mind that Robert also said No one is above the law. So, criminal case outside of official acts are still prosecutable. We all accept America can’t be kingdom. This is win for all Americans who believe in rule of law, freedom of speech and democracy. No authoritarian government!!       Hatch Act would say anything done in furtherance of campaigning cannot be an official act. The charges were related to poor interpretation of the Campaign Finance Laws, I doubt they can make a case this way. Its better to go on the overwhelming merits of a mistrial.

      Not so sure we want to be on this "IMMUNE from Prosecution" road. Maybe at most, DELAYED prosecution, until a Prez is out of office. Even though I'm a strong supporter of President Trump, not sure I like the idea of ANYONE in government immune from prosecution. My political views, admittedly support what President Trump has done and tried to do, but to say anyone in power is immune from Criminal Prosecution, is a road I do not think this country should stay on. There are easy to prove acts of Treason by democrats, Biden and their CCP loving mob and to allow such a ruling to stand means nothing can be done.

    Now the Presidency needs a Duty Statement so that it can be determined what actions are protected "official business" and which are not. Criminal actions cannot be considered immune "official business." All claims of immunity for questionable and criminal actions will have to be resolved in court, with the courts determining if the President's actions were "official business" or not. The SCOTUS decision is not a free pass for all Presidential actions. And now, the DOJ will have to charge a sitting President for criminal actions so that the courts can respond. Waiting for the end of a term can no longer be tolerated.
