    Premium processing is not really overrated, and definitely does not trigger RFE. I wanted premium processing for peace of mind and so I can plan ahead, coming from abroad. I got my response in 8 days. A winning case is one that is coherent, that satisfies the requirements and that has a great cover letter.

    Thanks for the informative video. About PP; we are discussing if it is an advantageous or not. I agree with you but someone pointed out of the importance of DQ date. If you have earlier DQ date you can get a visa interview date earlier than the other who has the same PD.

      That's a valid point. However, it's again a matter of each person deciding if the $2,805 are worth the difference (especially when there's cases nowadays adjudicated in 4 months, not like in the old times)

    But if you get an RFE for your case, isn’t it better to know right away and have a lot of time before the bulletin becomes current? Otherwise it could be that the bulletin is current but I just learned about the RFE and so I can’t submit the adjustment of status yet?

      It's always good to know but from a timeline perspective even if you get an RFE , with the current processing and visa bulletin times, you are still likely to obtain your final decision before you are able to submit an adjustment of status . Keep in mind you generally have only 60 days to respond an RFE and USCIS is quite fast to make the final decision after the response is submitted

      hi, there's not much more to say. You can either submit I-907 together with I-140 or later whenever you want. The way to fill out I-907 varies slightly and on my course I explain it in detail.     Great video, as previous ones, Oscar! Thanks, indeed! Just one quick question, please. Do you think it is better to use first person or third person sentences if we are self-petitioning? In terms of formal language, third person seems better for me. Does it really matter?

      Thanks a lot! Regarding your question, I do prefer first person when it comes to self petitions but it's my personal preference. Nothing wrong with either of those choices

    Hi Oscar! Thank you for all the amazing videos that you make.
    I am planning to file Eb2-NIW in a month. My spouse is on H4 visa.
    1) Can I file for H4-EAD concurrently with the I-140 petition?
    2) If I go for premium processing then will the concurrent H4-EAD if allowed will be processed with premium processing?

      Thanks! I don't think you can file concurrently, but you can do your own research on it just in case. As far as I know, you need an approved I-140

    If someone is on TPS (temporary EAD), does knowing the approval of I-140 help to extend the EAD? While still waiting on the status adjustment to be current.

    Hi Oscar could you make a video about being current? I don’t understand why we have to wait if we have an approval? And if we apply for I485, we get the working permit while waiting greencard adjustment right??

      Hi Elisabeth, it's quite simple. The US Congress imposes a limit on the number of green cards that USCIS and State can give out each year. So even if you have an I-140 approved, you can only get a green card if they (these agencies) have a visa number available. If there are more applicants than the limit imposed by Congress, you have to wait. You are "current" when there is a visa number available, which you can check using the visa bulletin (priority date earlier than final action date on the bulletin).
      Yes, if you file I-485 then you can also request the work permit

    If someone having B1/B2 and wants to apply for EB2 NIW, then can he apply for adjustment status direct from B1/B2 to EB2 NIW? Or need another status like F1 then Apply for EB2 NIW?

    Oscar, please make a video about how this EB2 NIW will go through this whole fiscal year for the ROW. In my point of view, If the dates go like this, then it will probably need 10 or more years for the people having PD in october 2023 to be current 😢

    Hey 👋 I have a different question supposed to say I am an agriculture scientist having PhD worked 15 years back home than seven years ago moved to Canada, since than I am not working in my field , am I still be eligible for EB2 NIW

      you can try, but it is going to be hard to convince the USCIS officer if it has been so long. To give you perspective, I typically recommend that reference letters are less than one year old. But like I said, you can try, especially if you had very significant achievements in the past

    I filed my NIW application in end of July 23 under regular processing and waiting. The thing is that I need to know adjudication results before end of this year. Did you think it is wise to wait more or apply for premium processing? The more I wait the more I feel hesitant to apply for premium processing 😅

      Hi Mohammed, it is very hard for me to answer that. I wish I could see the future and I could tell you do one thing or the other...but I don't know. If you absolutely need to know (for whatever reason) then you can consider it

    Hello Oscar, thanks for the video. I work as a professor and I have sponsorship from them. They already obtained my labor of certificate. The Form ETA 9089 is here, however now I am approaching step two (i-140) and step three (i-485), but they are not going to pay a penny. The attorney that the university is working with is asking for too much as legal fees to file my case. Can I file these two steps (i-140) and step three (i-485) by myself? If yes, what are the pros and cons of doing this? Thank you so much in advance for your help.

      Hi, in this channel I discuss green cards without sponsorship. It seems you are working towards a different type of green card . If you want to do it yourself, look into EB2 NIW or EB1A and see if you can qualify. You don't need the PERM for those two categories. Other than that, I don't provide individualized advice.       You can travel if you have a valid visa stamped on your passport, if not, you cannot travel until you enter the adjustment of status phase AND you get your travel authorization card.

      the best way is that someone you know in the US buys a money order from USPS and mails it to you to include in your petition package

    Man I wish if i used premium processing. It's been 7 months since I submitted the case. I took the chances based on your video but it the standard processing is clearly a hit or miss

      It does depend on the case, as I usually explain. However, what it's sure is that your priority date is still not current , so even if you had spent the $2,500 (now even more) you would be waiting for the visa bulletin. Fingers crossed for a quick decision on your case. And by the way, you could have upgraded to premium any time you wanted
