      Yes, it is illegal to walk in a bike lane if there is a sidewalk which can be used safely. See Section 1156 of the NYS Vehicle and Traffic Law
      Section 1156. Pedestrians on roadways.
      (a) Where sidewalks are provided and they may be used with safety it shall be unlawful for any pedestrian to walk along and upon an adjacent roadway.
      (b) Where sidewalks are not provided any pedestrian walking along and upon a highway shall when practicable walk only on the left side of the roadway or its shoulder facing traffic which may approach from the opposite direction. Upon the approach of any vehicle from the opposite direction, such pedestrian shall move as far to the left as is practicable.

      @graphicism Před 5 lety +13

      @@ActionKid Ah ha, well just like some bike lanes are blocked, some pedestrian walkways are blocked, and so the saga continues. Almost all instances it's an unassuming pedestrian stepping out onto a bike lane to cross the road or to go around an obstructions that gets an angry cyclist projecting on them. It's pretty ridiculous considering how many cyclists ignore road rules all together. Have you ever run a light on a bicycle? Have you ever ridden on a pedestrian walkway? - I know you have. You have to see this is a personal bias and understand the position from all aspects. You're never going to get the lane to yourself, work with it, don't be confrontational and be nice to those around you.

    • @ActionKid
      @ActionKid  Před 5 lety +101

      @@graphicism People can "be nice" by respecting and yielding to traffic which have the right of way. Being ignorant of the rules by being an "unassuming pedestrian" is not an excuse to endanger the safety of others. It is understandable if there are obstructions which require traffic to go off course to avoid the danger (i.e. There's a bridge which is commonly iced over after a snowstorm. After the snow finished falling, the bike lane cleared up better than the pedestrian lane, so pedestrians walked in the bike lane. However, there were cyclists who yelled at those pedestrian even though the pedestrian lane was hazardous and full of ice. I don't agree with the cyclists in this instance as the roadway must be shared here.) The traffic law allows for flexibility, hence the wording of my previous quoted Section 1156 (a) states "Where sidewalks are provided and *they may be used with safety*" , and Section 4-12 of the NYCDOT Traffic rules states: Whenever a usable path or lane for bicycles has been
      provided, bicycle riders shall use such path or lane only *except under any of the following
      situations:
      (i) When preparing for a turn at an intersection or into a private road or driveway.
      (ii) When reasonably necessary to avoid conditions (including but not limited to, fixed or
      moving objects, motor vehicles, bicycles, pedestrians, pushcarts, animals, surface hazards)
      that make it unsafe to continue within such bicycle path or lane.*
      Yes, I have gone through a red light while cycling, have cycled on the sidewalk, and jaywalk frequently but I wouldn't attempt to do so without looking for traffic or yielding to traffic with the right of way. If you're going to break traffic laws, I'll be happy if it's just your life you're putting at risk, but often times that's not the case and innocent parties are put at risk as well. We all have to be diligent and share the roadway with accordance to the rules of society. I ride a bicycle in this city on a regular basis, and I'm respectful and nice to those around me who are respectful to others.

    • @peter1062

      It's not a real problem to walk on a dutch bike lane, as long as you know what you're doing. i.e. stay on the side, be aware of traffic and behave predictably. Main problem are people in Amsterdam (read: tourists) who don't have a clue what they're doing and wander off into a bike lane without watching where they're going.
      They're the ones that get to experience our excellent medical facilities.
      Please remember: Amsterdam is not a theme park, it's a city.

    I know a lot of people are going to dislike this guy's attitude but try to see it from his perspective. He's probably a perfectly nice guy that bikes literally every day and probably has to deal with all the stuff you see in these videos over and over again. it would wear anyone down and it's a good way to end up crashing or having a pedestrian get run over. All it takes is for people to use a little situational awareness, it's not hard to see a bike lane, and it's just as bad as someone randomly walking in a road when traffic is coming. Don't do it. Everyone has a place they should be. Pedestrians on a sidewalk, bikers in a bike lane, cars in the traffic lanes. People walking just get impatient and think if it's crowded it's fine to walk where you shouldn't.

    We all want to get to our destination! I've done a lot of biking, driving and walking. It seems so ironic that I will have my right turn signal on, no bike lane, and someone on a bike tries to shoot past me on the right. Discretion is the better part of valor. Back in the 70s almost no one rode bikes where I lived, in Palm Beach County, but still, most people just drove past me, no big deal. And some people would scream at me, throw things, spit on me, they were different than the thousands of people who just went on by. But we tend to notice the jerks! At first I would scream back, squirt them with my water bottle, but that got old. Now I just smile and wave like they are old friends, and it totally confuses them.

    I love the example of safe cycling. Of course that's when the other parties involved use that turn signal. I've been cut off and even clipped by ones who didn't, so I'm always anticipating it.
    I've even had this one woman come up from behind me, while using her right turn signal, then come up to the side of me, and then try to make the right turn. She took me down, but no injuries or damage to my bike, because I saw what she was attempting to do and braced for the impact.
    She still tried to say it was my fault, ( drivers always say it's the cyclist fault ) because she had her turn signal on. I got on my bike and rode away. She had to pick up her broken passenger side rear view mirror from off the street. The truth is she wasn't paying attention to what was on the right side of her, and she knew it.

    When they say that Americans cycle inspite of good infrastructure it is very true. As a Dutchman I have to applaud the determination of the brave souls willing to cycle in those conditions.

    I read somewhere that the mind does not register bikes on the road even when they see them. That goes for Motorcycles too. Yes, the pedestrians are rude and the cars too.
