Trash Panda Vegan, a Phoenix food truck, which doesn't serve Chinese food is in trademark battle with Panda Express to keep its name. 12News' Williams Pitts explains
Well, apparently they're pretty sure that they do own the word and all images of pandas, LOL. And they have the money to prove it. This is how capitalism operates. The folks with the money write the laws, pay the lawyers, and own whatever they say they own.
@@Odinarcade00 I know. I remember when McDonald's tried to force a Scottish pub in Scotland to change its name, even though the pub had been around a lot longer than the hamburger chain. It is shameful. And even if should could afford the attorneys and beat Panda Express in court, it would probably bankrupt her. Our Supreme Court has ruled that corporations are people and the politicians have written the laws to favor these "people." And don't blame one party more than the other; they're both guilty.
Actually, legally, they do. They trademarked the word Panda and paid the money for it. I did research when it happened to the other restaurant. And it's only to businesses opened after they paid to own the word for food business purposes
With a Panda Express franchise making $616,240 in sales annually, it's evident that Trash Panda Vegan, as a small business, poses no significant threat. Pathetic.
Same here since they changed away from actual panda meat 😂 whatever they use now isn't nearly as good as it used to be. At least KFC maintains original recipe 🤣
They're right. It damaged their business because now I don't like them for messing with this woman's livelihood. Not like I ate at Panda Express much anyway. I like real Chinese food.
True or possibly even ACLU or ACLJ ans others. Looks like a good probono case for some young new lawyers that need to make a name for themselves right out of school.
No, they own the image in the restaurant service industry. They will win the legal battle because they had it first. It doesn't matter if they don't serve Asian food. They're in the same industry.
@@bebdaumon3948if there were justice in this world, Panda Express should have to use a raccoon as their mascot and this woman gets to continue with the panda. 😂
I stopped eating at Panda Express long time ago due to their disgusting food.. Horrible!! Gotten tired of every time I frequented them I was always disappointed in quality of their food. They don't own the name "Panda" if that be the case then all the Zoo's that house and represent the animal should sue Panda Express for using all the Panda animals name and for profits. Vote me in.
We had a small restaurant called "Nicky D's" in our city for over 30 years. It was named after the owners son, Nicky, and their last name started with a D. A McDonald's opened up about 3 miles away. About a week after opening, McDonald's sued Nicky D's because the name was too close to Micky D's, which was trademarked by McDonald's. Nicky D's wound up closing. Note: The McDonald's corporation sued Nicky D's, not the franchise owner. The first the franchise owner had heard about it was when the local news showed up and asked him about the law suit. The franchise owner wound up having his franchise taken away from him by the corporation after he made a comment in an email to another franchise owner condemning the corporation for suing a long standing business over something so trivial.
I was under the impression that you can't patent, trademark of copyright something that exists in nature. Won't be buying from Panda Express anymore...
They Trademark "Panda" in the early 2000's not sure how it was allowed but it was. It is part of the brand. Buc-ees Trademarked the Beaver so same concept
Uh, I thought "trash pandas" were nicknames for racoons? Not.. pandas? If I Google trash panda, racoons come up. Just change it to a raccoon, an actual panda doesn't make sense anyway. Not that Panda Express had literally anything to worry about. Lame on both sides.
They already covered "trash pandas" meaning and why she chose actual pandas at 0:44 - 0:48. Panda Express and their "justification" for this action against this small business is a joke. And they should've left Panda Libré alone too.
I don’t understand why Panda Express has an issue with this. They are out of their minds. They don’t own the word panda.

@@timward3116 companies do this all the time. If she had money for legal fees she would probably win in court

They did this to another restaurant in Arizona like last year. I think it was an Asian Mexican fusion restaurant. Panda Express is trash.
Actually, legally, they do. They trademarked the word Panda and paid the money for it. I did research when it happened to the other restaurant. And it's only to businesses opened after they paid to own the word for food business purposes
The only thing hurting Panda Express is their disgusting food and nasty service.
Is their food and reputation so bad that when we see the words "Trash Panda" we immediately think of Panda Express?😂😂
The word "Panda" can not be trademarked or patented. It is the name of an animal, which cannot be patented under intellectual property laws.

Panda Express is bullying smaller business because they believe they own the word panda? The entitlement of this greedy company 😡
Me and my family and friends will never eat at PANDA Express NEVER AGAIN I'm going to 😂😂😂a local authentic Asian place
Same here since they changed away from actual panda meat 😂 whatever they use now isn't nearly as good as it used to be. At least KFC maintains original recipe 🤣
No you aren’t. There are no authentic Chinese food places almost anywhere in the states. Lol
Panda express now gonna go after everthing with "panda" in there name? Love to see them go after "kungfu panda"
They're right. It damaged their business because now I don't like them for messing with this woman's livelihood. Not like I ate at Panda Express much anyway. I like real Chinese food.

Panda express is bullying for sure, last time i'll eat there..
Another local business falling victim to Panda Express... They do not own the Panda image.
boycott panda express! spread the word!
For God’s sake, Trash Panda is 100% vegan food. Panda Express is not even close in every aspects.
Maybe we should boycott Panda Express.
The dont own all Panda's they have no standing. Outrageous!
"Panda is trash" is much different than "Trash Panda"

Screw Panda Express it’s not real Chinese food
Tell me where in the US you get “real” Chinese food?
Screw panda express.
They don't own the name PANDA
No more panda express for me
I guess Panda Express owns the word panda now🤣

Panda Express don’t want no one having panda in the name, funny😂
I'll check out Trash Panda next time I'm in AZ. As for Panda Express, this is laughable.
I identify as a panda and I’m going to sue Panda Express for using my species name. 😂
Bullys
First they go after Panda Libre and now a little vegan food truck? Panda Express is losing their mind.
If they don't sell Chinese foid i see know reason
Free Trash Panda
No Trash Panda is exactly that.. Trash. She needs to change the name ASAP
Well too bad there's also trash panda disc golf which has been around longer than her food truck as well.
Theyll be ok, it isnt close enough to be a copyright infringment
I get why panda is doing this. They don't want their name associeted with trash food
But the only trash food is Panda Express
Reminds me of monster energy drink sueing anyone with the word "monster" in the name they even tried going after Pokémon 😂😂😂🤣🤣🤡🤡

Panda Express is a loveless company. Cruel, corrupt and unethical.

The name says trash panda sounds hateful doesn't sound nice
They shouldn't have a say so uts America people
People “patronize us” is NOT A GOOD THING. LoL
Panda Express really isn't that great
Panda Express will win.
Panda Express 👎🏼👎🏼👎🏼
"Trash Panda Vegan"
Let me guess, that probably came from someone who probably has a useless Marketing degree...
Probably
Don Draper must be the commenter?

LOL 😂, going vegan isn't healthy. LOL 😂, just exactly what is a " vegan burger" ? 😂😂😂😂😂 I'll stick with real beef and real meat.
Exactly 😂
It's made with trash pandas. They trap them then slaughter them to make burgers.
She calls her food “Trash”, so I think she agrees.
Yea these are the same people to always tell black folks to pick themselves up by the bootstraps but look at what you run into when you do.
Everything isn’t about race. That’s just you.
