  • Once a celebrated Chief Justice of India, many of his former colleagues and those within the legal fraternity question his wisdom of accepting a Rajya Sabha nomination within just 4 months of his retirement. However, he is not the first one to do so. Bisbo brings the event in context.

Such post retirement jobs of judges truly erodes our faith in the judiciary since they are the guardians of democracy. Such instances pose question on the controversial/ hot debate judgements even if these decisions were taken in the right spirits. Why cant govt. bring a law which says upon post retirement, judges should not take legislatures role for atleast 5-6yrs ? This would help us to harness their expertise as well as bring in more confidence in the system.

Correction : Justice Krishna Iyer did not join politics post retirement, we was politician earlier who joined judiciary post leaving politics.
    1. He became the first minister of law, justice, home, irrigation, power, prisons, social welfare and inland navigation in the first communist government in Kerala headed by E. M. S. Namboodiripad that came to power in 1957.
2.He was appointed a judge of the Kerala High Court in 1968. He was a member of the Law Commission from 1971 to 1973 where he drafted a comprehensive report, which would lead to the legal-aid movement in the country.[3] He was elevated as judge of the Supreme Court of India in 1973.
3.He retired as a judge on 14 November 1980. He stood for the nation's President in 1987, as the Opposition's candidate against R. Venkataraman, the ruling Congress's nominee who won.
So Justice Iyer remains the only SC Judge who earlier had a career in politics and later a career in judgeship.

Like Justice Joseph wrote a separate judgement in Rafael case, which agreed with rational of overall judgement, but he gave his own reasons too.
Also Ayodhya Judgement could have created communal atmosphere, so the court handled it in a way that would not create any controversy.

Judiciary must keep a safe distance from executive and legislative worlds. This will help them work without partiality. At the verge of retirement ,the top bureacrats and judges seems to be more interested in clearing their way for transition to politics rather than working impartially.
This appointment looks like a reward from the political masters.....

What a shame without knowing full facts persons are making videos & just like me people are watching because we all are interested in the controversial topics & always ready to deliver our judgement on the character of the person standing in front of us.
Yes I agree that post retirement job should not be given but if you do so so many tribunals & commissions will go vacant because of the criteria that they should have retired judge. So we must demand for cooling period for the jobs.
If you think judiciary is not independent & Ranjan Gogoi sir has been compromised then you should know the fact he didn’t taken a single penny as a Rajya sabha member.
He taken up the seat just to give the opinion of judiciary on the laws framed by the parliament.
Just think twice before you judge someone

Very nice video. But please correct a mistake. Justice krishna Iyer was politician/advocate first, only later he became a nominated judge in SC. He did not took post retirement. He is one of the greatest judges in India.

You don't have to proof everything! Sometimes silence is the best thing you can do!
To fight ba rule you will have to pick up the swords, this is not the 1st time such things happening very similar event happened in Congress time you are just a google away!
