If I would define it will be a set of principle life with a faith of peaceful life in this world and after for ever.this religion we are adopting willingly without any kind of force. since it is a faith which is adopted willingly and any one find something not as per his/her choice can change any other set of principle life (Religion and our Constitution also gives as fundamental right of choosing or changing any region which is as per his / her choice.there fore there is nothing to interfere or talk about by politician or judiciary.

घर के wash room का इस्तेमाल क्या किसी दूसरे room की तरह किया जाता है ..... ?? नहीं। अपने wash room का इस्तेमाल अगर कोई drawing room की तरह करे तो उसे किसी डॉक्टर के पास ले जाना चाहिए। तो क्या घर में wash room होना ही नहीं चाहिए ...... ??? लेकिन wash room के बग़ैर घर मुकम्मल ही नहीं हो सकता। इसी तरह तीन तलाक़ का होना ज़रूरी है। इस का इस्तेमाल ज़रुरत पर करो न की ग़ुस्सा उतारने या बदला लेने के लिए।

एक दिन झुठे नबी मोहम्मद कि ढेर सारी बीबीयो मे से एक हाफसा अपने पीता से मिलने गई , तब घरमे सिर्फ हाफसा कि घरेलू नौकरानी मैरी अकेली थी, मोहम्मद तो था ही बेशरम और चुत पागल. मौके का फायदा ना उठाए फिर वो मोहम्मद कैसा , मोहम्मद को लगा कि हाफसा को आने मे देर लगेगी. तो फिर क्या मोहम्मद ,मैरी को हाफसा के ही बिस्तर पे ले गया और कुकर्म करने लगा, हुआ यु के जब मोहम्मद कुकर्म करने मे मशगूल था तब अचानक हाफसा आ पहुंची, और मुहम्मद को कुकर्म करते हुए रंगे हाथ पकड लिया. हाफसा को गहरा दुःख हुआ .
फिर मोहम्मद ने अरेबियन चांद मिया के नाम पे कुछ आयते नापाक कुरान मे डाली जो कि सुराह अत-ताहरीम मे मौजूद है (unholy quran 66 :1-5)👇👇
1 : ऐ रसुल जो चीज खुदा (अरेबियन चांद मिया )ने तुम्हारेलिए हलाल कि है तुम उसमे अपने बीबीयो कि रजामंदी की जरुरत क्या है
(जब मोहम्मद को हाफसा ने मैरी के साथ कुकर्म करते पकड़ा तो , मुहम्मद ने यह जताने कि कोशिश की की अरेबियन चांद मिया ने मैरी को उसके लिये हलाल कर दिया है और अब हाफसा को मोहम्मद पे उंगली उठाने का कोई अधिकार नही )

3 : और जब पैगंबर ने अपनी बाज बीवी (हाफसा )को एक बात राज रखने को कही और फिर हाफसा ने वो बात दुसरी बीवी ( आयशा )को बताई ।
जब आयशा को मोहम्मद के कुकर्म का पता चला तो मोहम्मद के घर मे बवाल मच गया. हाफसा और आयशा दोनो , मोहम्मद ने जो मैरी के साथ कुकर्म किया था उसका हिसाब मांग रही थी और मोहम्मद अपनी रंग रैलीया करने से बाज नही आ रहा था, वो मैरी से शारीरिक संबंध बनाए हुए था , लेकिन हाफसा और आयशा मोहम्मद का विरोध कर रही थी, फिर मोहम्मद ने हाफसा और आयशा का मुह बंद करने के लिए, अरेबियन चांद मिया के नाम पे अगली आयत पेश की
4:(तो ऐ हाफसा और आयशा )अगर तुम दोनो( इस हरकत से )तौबा करो तो खैर ,क्योंकि तुम दोनो के दिल तेढे है । लेकिन फिर तुम दोनो रसुल के खिलाफ एक भी हो जाओ तो भी कोई परवाह नही, क्योंकि खुदा और जिब्राइल और तमाम ईमानदारो मे से नेक शक्श उनके मददगार है और उनके अलावा कुछ फरिश्ते भी मददगार है ।
उपरी आयत के द्वारा मोहम्मद ने सिर्फ अरेबियन चांद मिया के नाम से ही नही बल्कि जिब्राइल के नाम से भी धमकाया, इतना ही नही बल्कि मोहम्मद ने हाफसा और आयशा दोनो को इस बात का भी अहसास दिलाया कि सारे मुसलमान भी उसकी ही तरफ है । ईतना ही नही और दुसरे फरिश्ते भी उसके मददगार है ।मोहम्मद ने हाफसा और आयशा का मुह बंद करने की भरपूर कोशिश की,

इस से यही साबित होता है कि मोहम्मद एक छुठा नबी था जो खुदा का नाम लेकर लोगो को डराता था और खुद की मनमानी करता था ।।

Divorce in islam can be of three types talaq when huband leaves the wife,fasakh when woman dissolves the marriage and khula is when they mutually decide to part their ways.talaq and fasakh are done when the partner is faulty.if the husband is bad, a woman can file for divorce.all the three types of divorce contain an iddah reconciliation period, witness,conscious state of mind and legal document.i hope i cleared your doubt

شوہر کے ممکنہ ظلم یا اس پر افتاد کی صورت میں مصیبت سے رہائی کی ایک صورت ’’ تفویضِ طلاق‘‘ بھی ہے۔ اس کا مطلب یہ ہوتا ہے کہ عورت یا اس کا وکیلِ نکاح جب نکاح کا ایجاب کرے تو اس میں یہ شرط لگا دے کہ شوہر کی طرف سے پیش آنے والی مصیبت کی صورت میں اسے اپنے آپ کو طلاق بائن دینے کا حق حاصل ہوگا۔ اگر مرد عورت کی اس شرط کو نکاح میں قبول و منظور کر لیتا ہے تو اس کی طرف سے کوئی ظلم و زیادتی ثابت ہونے یا اس کے لا پتہ ہونے پر بیوی کے مصیبت سے دوچار ہونے کی صورت میں اسے یہ حق ہوگا کہ وہ اپنے آپ کو طلاق دے کر آزاد کر لے۔فقہِ اسلامی کی صدیوں پرانی کتابوں - جيسے فتاوی قاضی خاں، ہدایہ، فتح القدیر ، نہایہ، تبیینُ الحقائق ، بحر الرائق، در مختار وغیرہ - میں اور اردو زبان کی معروف و مستند کتابوں - جیسے فتاوی رضویہ اور بہار شریعت وغیرہ - میں بھی اس کے بارے میں واضح تصریحات موجود ہیں۔ بلکہ اس کی بعض صورتوں کا ذکر تو صحیح بخاری و صحیح مسلم کی حدیثوں میں بھی ہے اور اس طرح اس کا تاریخی رشتہ عہدِ رسالت سے جُڑا ہوا ہے، ’’تفویض طلاق‘‘ کا معنی ہے ’’ طلاق کا اختیار سونپ دینا‘‘ چوں کہ ہونے والا شوہر عورت یا اس کے وکیلِ نکاح کے ذریعہ پیش کی گئی شرط پر اسے طلاق کا اختیارسونپ دیتا ہے اس لیے اسے بھی طلاق دینے کا حق مل جاتا ہے۔

The executive, judicial and legislative laws we are going though in these verses, they are the framework for any successful society, be it Islamic or un-Islamic. We have these principles to hold on to, the way these principles take hold in society is up for debate.
In other words, some people say we are going to bring back the khilafah of Hazrat Umer
(RA). Well, we are not living in the times of Hazrat Umar (RA) , the economy has changed ,sociology has changed, governments have changed, world nation relations have changed.
How these principles will take effect now is a different reality. How it took effect then was a different reality. The governmental structure between Hazrat Abu Bakr (RA) and Hazrat Umar (RA) went through dramatic changes. Several changes were made between these two khilafah then and now we are talking about centuries. The values don’t change but how they materialize depends on the age of the era we live in.
And if you get into a dispute regarding some matter then take it back to Allah and His Messenger(pbuh). In other words, take it back to the constitution.
So imagine the Islamic Supreme court in which two parties are arguing and both parties have their evidences from the Quran and Sunnah.
Now at that point if the judge is fair then he will look at his panel of experts who will look at whose evidences are stronger and then will pass a verdict.
So at the end of the day even though both parties are claiming to obey Allah and His Messenger but there will be just one verdict. You can’t each have your own interpretation. For collective matters we will have to go back to some kind of judicial authority.
So if you comply with these laws, not only is it good for you it is a sustainable thing that last for a long term.

In Shia Muslim section three Talaq has to occur in three separate sessions. Even if in one session it is uttered three times it will be considered one talaq. Both husband and wife has still chance to reconcile. If in three such sessions it is finally decided that they cannot live together then divorce occurs. On the other side if the wife wants to separate she can opt for Khulla which she can claim through court and court will decide, it is in one go.

TRIPLE TALAK:
Gone through the BILL. Good attempt. However there are many lacuna and ambiguity and defects in it. It is Incomplete, like earlier acts. Many aspects are either ignored or inadvertantly overlooked while finalising draft , may be in a haste. Requires many changes . Even name of the proposed ACT is also required to be changed.
It appears that without proper research and without considering earlier enactmants/ legislations , the present Bill is drafted. It is not comprehensive. The law Ministry can codify a very good and salubrious ACT on the subject , which is need of the hour as well as ignored so far.
The Bill should go through , but not in present form. There will be ANARCHY if it becomes law without nessesary corrections, amendments and additions besides being possibility of challenge before the CONSTITUTIONAL bench of COURT of Law. Needless to say what repercussions it will have on the muslim community. Courts are already overburdoned with litigations and it may add further. Many sections needs corrections and some new sections are required to be added. Pro and anti , all are going in wrong direction. Only objections are raised and debated in media and parliament BUT nobody is giving SOLUTION / REMEDY.
Triple Talack is invalid-illegal-najayaz. But it is valid-legal-jayaz also in the circumstances of MUBARAAT( i.e. divorce by mutual consent ) and in the case of KHULAA ( i.e. when wife demands talak ). These important aspects are totally ignored.
Wife can approach court for divorce under various grounds mentioned in section 2 of The Dissolution of Muslim Marriage Act, 1939. The husband is authorised to pronounce talak without going to court. BUT many times the husband instead of giving talak in three tuhur ( i.e. three menstrual cycle ) and which is legal-jayaz -valid ,subject to the conditions that wife should not be pregnant and in that tuhur period ( tuhur period means the period between two menstrual cycle ) the husband has not had physical intimacy with the wife . But sometimes the husband insted of pronouncing such oral talak validated by The Muslim Personal Law ( Shariat ) Application Act, 1937, the husband wants to approach court of law for talak. However no such law is ever enacted or codified to give rights to the Muslim husband. ( the present Bill is also silent on this important issue . The Bill should have clarified the procedure to be adopted for giving talak ). The defination of talak and talaq-e-biddat is neither diffrentiated nor defined in the bill. Even the section 2 (c) of definition of talaq and section 3 of the Bill are inconsistent to each other and vague and do not convey the proper message rather creates confusion and fear. It is not possible to achieve object of the enactment by passing such type of ambiguous bill . I hope Honerable President of India shall not give his assent to the ABSURD Bill to make the Act in its present form.
Hence the complete, comprehensive and effective law can be enacted considering all the aspects of talak- various forms of talak , such as talak - e - hasan, talak-e-ahsan , talak-e-baain , talaq-e-biddat , Khula and Mubaraat.
The present Bill is not comprehensive. It has not considered all the points. So what purpose / object will be served in passing such type of unpolished and ineffective Bill.
If the Government realy wants to help Muslim women / community , they shall come with good, perfect and salubrious provisions of law.
At the cost of repetition let me submit that : kindly correct, alter , amend the present BILL and also add some new sections, exceptions, explanations , sub clause, obstinate clause , provisos in the BILL. Kindly reassess and take sometime to finalise it.

احادیث نبویہ یہاں تک کہ احادیثِ صحیح بخاری بھی شاہد ہیں کہ تین طلاقیں دینے سے تینوں واقع ہو جاتی ہیں، قرآن حکیم کا فرمان بھی یہی شہادت دیتا ہے اور اسی پر ہمارے چاروں مذہب کے اماموں - امام اعظم ابوحنیفہ، امام شافعی ، امام مالک اور امام احمد بن حنبل رحمۃ اللہ تعالیٰ علیہم - اور اُن ماننے والے کروڑہا کروڑ بے شمار مسلمانوں کا اتفاق و اجماع بھی ہے اس لیے اس کے خلاف کوئی اقدام مسلم پرسنل لا میں صریح مداخلت اور نہ صرف ہندوستان ، بلکہ ساری دنیا کے بے شمار مسلمانوں کی دِل آزاری ہے اگر کچھ خواتین اس طرح کی آواز اٹھاتی ہیں تو اربابِ فہم و دانش کو انھیں سمجھانے کی کوشش کرنا چاہیے۔ معاشرے میں سب یکساں نہیں ہوتے، اللہ نے پانچوں انگلیاں برابر نہیں رکھیں، اس لیے ہماری حکومت اور ہمارے فاضل جج ان باتوں پر ٹھنڈے دل سے غور فرمائیں ۔ باتیں سب کی سنی جاتی ہیں مگر فیصلہ وہ کیا جاتا ہے جو اربابِ دانش کے دل کی آواز اور بالخصوص مذہب آسمانی کا پاسبان ہو۔
