In Cleveland, Ohio it is illegal to catch mice without a hunting license.

Even in Canada we had some territorial laws that were on the books for a while. In Calgary, Alberta there's a law on the books that says when you are released from prison you are to recieve a horse and gun with which to leave town

One old timey law in TN states that, if 10 or more women inhabit a building, it is to be considered a brothel. It would be interesting to see that law enforced in a modern high-rise apartment complex.

Speaking of Montana Territory, the numbers 3-7-77 have a very significant relationship to law enforcement, posses and citizenry that lives on to this day on the shield of the Montana Highway Patrol .

When I was a teenager in Vegas I had this weird dream about being forced to join a posse. I must have heard someone describe that old law and misunderstood it.
Curiously enough, after I had that dream, and did some research and discovered that it came from old Scottish law, when posses would be formed by mixing part time gendarmes with the caste of full time gendarmes, called the Fyne. The signal to form into a posses was a man riding around on horseback with a torch of sod and turf burning on the end of a lance.
I find it fascinating how similar the Old West and historic Scotland were. Especially how similar the cattleman and shepherds were in their daily lives, and their response to banditry, rustling, and homicide.

in 1995 the Tombstone weapons law was repealed after being challenged in court.so someone fought the law and they won.

Thanks Santee. The "lawless " West was never really lawless. The law was thinly stretched in large areas before the 1880s. By the 1880s, a county seat had both a Marshal and a Sheriff. Even casual viewers of Westerns have seen a trial with a travelling Judge in a saloon or the inquest. Three marks of a county seat were a grand saloon, grand hotel( 1 at least) and the county courthouse.
True. But the law was stretched thin, especially when you look at all the lynchings.
All of those territorial laws banning the carrying of firearms in certain cities not only violated the 2nd Amendment but also The Northwest Ordinance, officially titled "An Ordinance for the Government of the Territory of the United States North West of the River Ohio," which predated the Bill of Rights by 4 years. It was passed by the Continental Congress of the United States in 1787. The Bill of Rights was ratified in 1791. Just like the 2nd Amendment, it prohibited the banning of the people's right to own and carry firearms, in this case specifically in the territories.

It's sad how often the 2nd amendment is being violated. However if you look at the founding fathers they put up with that stuff for a long time until they tried to completely take away the 2nd amendment. So it's only a matter of time.
The Second Amendment (Amendment II) to the United States Constitution protects an individual right to keep and bear arms and the right to a well-regulated militia.
Arms include firearms, knives, and axes. The definition was upheld by the Supreme Court. For states concerning knife laws, the most liberal (as in freedom) is Arizona while strict in Texas and New Jersey is not the most strict but it has the heaviest penalty of a felony for breaking a knife law.
Knife Rights organization is the knife version of the NRA. Of which I am a card-carrying member. Poor poor axes no one is batting for them. Sniff.
@@TheMidnightModder It's interesting how gun laws have been a hot button issue forever. In my research it's not so much preventing people from having guns as they wanted to prevent people from killing each other. It was a business decision. If you're running a boom town on the frontier and you have a bunch of drunk miners or prospectors in town suddenly kill each other then you're losing not only bodies to work the mines but people to spend money in the town. So they banned the carrying of guns in town as a measure of peace keeping not cause they hated guns.
This is why people like Wyatt Earp didn't kill a lot of people while he was marshal. He actually perfected the art of the pistol whip. If you watch in the movie Tombstone both Wyatt and Virgil use a pistol whip to knock someone out. This was because you didn't want a guy killed for being a drunken idiot. So knock him out, put him in jail till he sobered up.
The last thing I will say is that you need to separate your 21st century views on how things were viewed in the 18th century. As a person who writes historical based fiction you need to remove your present day bias from how people conducted themselves in the past. So it means referring to Native Americans as Indians. Because that was the norm of the day.
@@ryanmedina5090 The government has been trying to take away arms from the civilians ever since there was corruption. An undefended populace is a lot easier to kill than a defended one. And relative to this conversation your last paragraph was useless information. And you need to look deeper than just a town level. There is a lot more money to be made from taking guns away from the entire country rather than just a few cities and towns.

You can't go breaking the law Santee! :p I'm glad you mentioned Tombstone. A friend of mine was actually set to be in the production of Tombstone but when they switched directors his part was cut but since he was on the prop team he got to stay and work on the film.

If you burglarize a house at night there is an expectancy of someone at home. Burglarizing a home during the day you did not expect to find someone at home. That's why there is a difference between the two. This is still current in many states.
Not here. "Second degree burglary is different than first degree in that there is no weapon used during the burglary. Third degree burglary is entering any residential or non-residential property in order to steal." But you are correct for other states. Now folks know how that law came about.
The Miami chief Little Turtle in I believe 1794 or 95 went from Indian to Philly to meet with George Washington to ask if he would make a law for Europeans or whites not to sell rum or alcohol to his people I think he did and I don't know if it still stands today,I should see if I can establish that fact,all that information came from a book written in the 19th. Century which I no longer have,but the fact you brought that law up has peaked my interest again on that subject.Thanks for sharing your knowledge on history.

Except for Louisiana most states derive their legal tradition from the old English Common Law with some over lay from the Spanish legal codes in the Southwest. In the Southeast there are still laws on the books for dueling and mayhem which was gouging out eyes and dismembering body parts in a fight; a common practice in the rough and tumble frontier.

Years ago in elementary school i had a book called wacky laws it was an abridged version of the book entitled the trenton pickle ordinance

Hollywood has done it's best to create & perpetuate a vision of a western Yeehaw! utopia in which everyone in a saloon is wearing a gun and that they're all anxious to use 'em. We all love it, but the truth is much more tame due to city ordinances in towns of any size and you were more likely to be dry-gulched than face a man in the street at high noon. And.....find a waste can! LoL

In Detroit, Michigan, it is illegal for a man to scowl at his wife on Sundays; it is illagal to let your pig run free in the City of Detroit unless it has a ring in its nose; and Putt-putt golf courses must close by 1:00 A.M. I don't see a law about what time golf courses can open, so why not open them at 1:01 A.M.?
The law against allowing a drunken horse to walk on the sidewalk is still on the books in certain Georgia towns, mine included.

Here in Tucson, Az there is a law that dates back to the 1870's(?). It states something like: All men of age 18 and older, may not get any closer than 6 feet of a naked woman walking down any street or sidewalk within city limits. ( I don't remember what the punishment was, but i THINK the fine was $1,500.00.) There are medical reasons why this law was drawn up. Especially because of women going through the womans monthly cycle. The summer is particularly tough for women, even to this day! Guys can't sight see, everywhere! 😳

The territorial laws in Montana had some real strange laws some of which they got rid of when our state constitution was redone in the 1972 (?). It was illegal to curse in front of women and children. It was against the law to go out in public if you were sick, even with a cold. It was illegal for married women to go fishing on sundays. Unwed women were not allowed to fish alone. We had our own 2ndA in Article III, sec. 13 of our first state constitution. Seven or more Indians were considered a war party or raiding party and it was legal to shoot them. Some strange laws are still on the books.
Have to get to that state one weekend

The Camel "law" is intriguing. I was just reading about the feral camels that roamed the SouthWest for a few years.

I read a Texas law that a gun in the bed of a wagon was
considered in the possession of the driver. I guess if
the driver was on the ground and the horses got away
with the wagon, that they were in possession. Laws
