- Builders and their sales staff usually try to fool the customer by saying that once token or booking amount has been given, and the application or flat-booking form has been signed by the customer, the booking cannot be cancelled. They put pressure on the flat-buyer by saying that if he tries to cancel his flat-booking, the entire token or booking amount, or 10 percent of the total consideration of the flat, will be forfeited by the builder.
This is not the correct and lawful position. Flat-buyers should understand that until and unless the builder-buyer agreement has been duly executed, there is no transaction, and therefore, the builder is required by law to refund the entire amount in case of cancellation by the customer.

I have booked a flat in dosti nest project of Dosti developer located in balkumbh naka but due to some financial issue i am not able to compleate the registration. I have given them the 1 lac token amount which i was not giving them i was asking 1 or 2 day time to think on my decision but they convince me to pay by saying its spot booking & you will not get this deal tomorrow.

I am a young independent woman looking for a flat for myself in Mumbai. Except for one broker, all the brokers forced me to lie to the owner that I would live with my parents. They also forced me to give all my documents at once without even disclosing any details of the owner. They even demanded higher token from me. The last broker asked me to pay the deposit straight away without even disclosing the name of the owner so that they could quickly generate my agreement. They made paying the deposit and brokerage compulsory before the agreement was executed.
