Few years ago I used to think that Congress n other parties might be corrupt but they would at least don't go against the interest of the nation & I had a very high regard for judiciary, I didn't even know the shortcomings of judiciary. But when congress n other parties opposed article 370, i was disillusioned. How openly these parties oppose decisions of national interest without fear & people don't even question them. It's shocking that even judiciary is playing with the interest of the nation. Why the heck they're wasting time on this topic, any person with common sense would say 370 was temporary. Judges behave like British lords, nobody can question them.

With article 368 of Indian Constitution, sovereign people of India has every sovereign right to amend any part of the Indian constitution in the interest of the welfare of the people of India. (Including article 370)....✊

The amendment is not through 368 but through 370-3.. so the question is whether the part of amendment where contituent assemble of j and k rises like phoenix (through lok sabha with no respresentative of j and k) , proposes for amendment and then dies.... was this process constitutional...
The question of it being a temporary provision is unambigous .. it was temporary because the clause of special provisions was later added to the chapter of constitution..

Point 1 - the preface of the provision says temporary.
Point 2 - constituent assembly is required to change 370, which is formed only in the beginning and can't be convened again. It's the legislature that will be formed if they are elected and it's the governor if there is no legislative assembly.
Point 3 - any constitution must be a live document and not a static one, its common sense that things that were legal 20 years ago is not legal now as we evolve there need to be a constitution that evolves. Surely you don't want the constitution to be be a book like Gita/Bible/Quran which are books that can't be amended.
For people's sake, may God put this logic into your head.
I see an immense pressure by Sibbal on the CJI. If the govt were different then he would have ruled against the govt.
Even Kashmiri people accepted and welcomed the removal of Article 370.

According to Art. 368 Parliament may in excercise of its "constituent power" "amend" by way of addition, variation or repeal any provision of "our constitution" that's also include special privileges given to state..
Because those privileges are not basic structure pf our constitution but the need of any special law for special purpose and for specific time..

Art.370 was temporary only till the Constituition of JK was framed & finalised [1950-57]. That was the only window open for its abrogation. Once the Constituent Assembly of J&K ceased to exist upon freezing of its Constituition, the window for abrogation of art.370 closed permanently.
Ok Mr Law expert. There is nothing permanent. Even constitution can be amended from time to time , this 370 debate will be put to rest forever after this case

Why not you are putting it in proper way, as the constitutional assembly ceased to exist this article automatically ceased to exist as it was temporarily in nature. So the principle has gone why there should so the subordinates should be. Article 370 which was a temporary provision of the constitution shall not be permanent in nature as in the chapter also its been part temporary provision, so you can’t say this temporary provision will continue till the constitution of India exists because constitution assembly already dissolved any they had only right to take decisions but they never took a decision whether affirmative or negative it means they have already a consent for yes.

We the people of India - elect the legislative. They have the highest power as in a democracy. The constitution can't be a rigid framework that is un ammendable .that in it's very nature is against the will of the people
