Sub : Non fallowing the laws, Non implementation of the Orders of the Supreme
court of India, Issuance of illegal circulars by the EPFO and non action by the Govt
of India and consequently, injustice with the senior citizens of the country .
Dear Respected sir,
It is, the most humbly and respectfully brought to your kind notice that the provision of
higher pension of EPS 95 , a welfare scheme of Govt of India, is not implemented by the Employees Provident
Fund Organisation , EPFO , since last 20 years , by issuing various illegal circulars , one after other. Brief details are
as given below.
1) That by issuing illegal circular dated 01-12-2004, circular dated 20-07-2006, and
circular dated 31-05-2017 , the Employees Provident Fund Organisation, EPFO, did not allow the Employees to
exercise their options for higher pension under proviso to para 11 (3) of the Employees pension scheme 1995 and
deprived the Employees from the higher pension benefits . All these circulars are held illegal and arbitrary by the
Honorable Supreme Court of India , vide above referred orders/ judgement dated 31-03-2016, dated 12-07-2016,
dated 04-10-2016 and dated 04-11-2022 ( order of larger bench). However, in spite of all the above
mentioned judgements/ orders, the employees are not being allowed for the benefits of the higher pension by
playing very dirty tricks of issuing illegal circulars, one after other and entanglement in legal litigations.
2) That the EPFO has not been accepting the joint options of employees, for higher
pension under proviso to para 11 ( 3) , since 01-12-2004 on the name of cut off date . This " cut off date issue" is
finally decided and settled after the judgement of the Honorable Supreme Court of India, dated 04-10-2016 in
R C Gupta case. The Honorable Supreme Court India in above Orders/ Judgements in 10 SLPs held that
the EPFO has no power to fix up any cut off date for option and there is no time limit for giving joint option,
under proviso to para 11 ( 3) of the pension scheme. Now, it is very surprising to note that the EPFO , itself, had not
allowed and not accepted the joint options of employees, since 1-12-2004 till the judgement in R C Gupta ( 04-10-
2016) and now , it says that the employees should have exercised their options prior to their retirement who retired
prior to 01-09-2014. This is very strange and illogical on the part of EPFO.
3) That the EPFO, now after declaring all earlier circulars illegal, issued two new circulars
dated 29-12-2022 and dated 25-01-2023 saying that the employees those who retired prior to 01-09-2014
were required to give option prior to their retirement. During their service period, they were not allowed to give
option, and now, it is said that they should have given the said options prior to their retirement. This is a grave
injustice with the Employees & senior citizens of the country. This is nothing but cheating and fraud, by the
authorities of the EPFO. Moreover, theses circulars dated 29-12-2022 and 25-01-2023 are in contradictionto all the orders/judgements of the Honorable Supreme Court of India mentioned above, in the reference.
However, the authorities of the EPFO issue such illegal circulars ( without any approval of Govt of India), because no
responsibility is fixed on such official by the Govt. of India, MOL & E.

Very good statement ....EPFO is the most Enemy since a long time, why did Option time limit was given for a very short time to make us fool. We didnot get any information for contribution of PF beyond the ceiling rate per annum of Rs.500, Rs.6500,though deducted our PF contribution above the said ceilig amount but EPFO.did not raise any objection n notice to concern deptt that is why did deducted , contributed without Option Form submission, the questions arise for Highet Pension have to submit Option form signed by employee n employer, is it possible present authority of our Deptt.to sign on our Option form ? EPFO have played very very Non-sense Tricky towards us. Telengana eps95 committee members did a excellent job stating the Inner truth of blackmail by EPFO.towards us and am very thankful, satisfy clarfying black. n white . Also Hon.Cabinet Minister, Hon.Chandra Babu Naidu also seen with eps95 pension so pray n hope we will get justice now. Many Many Thanks to Reporterjee as you have clearly clarified to us.

If Sri Chandrababu Naidu takes the EPFO 95 pensioners issue he can demand at present as the case genuine when compared to pension given to Ex MLAs and MPs .Old aged pensioners problem is true . Funds enquiry from 75 years and unclaimed funds in PF , FPS and EPF all are to be investigated by Rtd Chief Justice .
They are not ready even to meet King Makers Demand. So he is very upset.
EPF 95 pensioners problem is life and death at the age of 70 above for survival of old couple who are in precarious condition . When a MP or MLA given highest pension for a service of 5 years without any contribution, having done more than 20 to 35 years service with contribution in their service EPFO 95 pensioners given RS 500 to 2500/- per month . This is brutal towards Old aged pensioners.

Naidu Sir please look into the such injustice done by Modi a business man PM, who void of sense of social security, as the against the intrest of corporate..Now Modi will try put the blame to EPFO, FM, LM are only his rubber stamps

Respected Chandrababu Naidu garu, Honble CM, Govt.of AP Sir, Please peruse your good offices with PM to honour the Apex Court's Judgments dt 4.10.2016 and 4.11.2022 as early as possible, as every day, hundreds and hundreds of senior Eps95 pensioners aged above 80 years and more are leaving this world. Your help will atleast be received by the living poor eps95 senior old age pensioners serving with less than rs.1000/- pension as on date. May the Almighty gives you all health and strength to serve this decades old neglected eps95 pensioners of a.p state.
