What if while waiting on your logo or brand name to be approved by the USTPO, you begin selling items with your logo and/brand name on it, someone sees your logo and/or brand name and copies your logo and/brand name and starts selling items with your logo and/or brand name on it?

Hi, though this is two years old, does the rule still apply for color of the logo? Start in black and white, and add color later?
