  • Dismissed on probation? What are your options, if any? I am regularly contacted by employees who are dismissed while on probation, and they want to take action.

    I just got fired yesterday while I'm on Probation. I had a hard time adjusting to the work culture at the company I work for, it's pretty intense and I don't mind this outcome because I really wasn't happy. So I am okay with moving on.

    This is very common in IT companies. They hire people to build web or mobile apps(which can take 3-6 months), and once the project is finished the developers are fired without any excuse. So please be careful. Find out more about the company you are going to sign the contract with. Also, keep the knowledge to yourself. Don't help junior people. Because if you do, the company won't need you any more. Another important factor, is the nationality. If you are a foreinger, then you have more than 95% to fail the probationary period. The last company I was working for was hiring peope from southern European countries, and was firing them after 3-4 months.

      I was hired by an IT company in france and fired after 5 months, i don't know what i have done, because of this kinda companies we lost and treat all companies as shit in future.. No,human values anymore

    Very useful thank you i have just recieved an email from my establishment that i need to attend a probabtion meeting review and sickness review . I have been there 7 months in next week dec 10th 2023 . Im terrified .

    I was on an extended probationary period for 2 months however 2 weeks into it i was suffering from mental health so i got a sick note and i have been off sick for 2 months. They have decided to pause my probationary period. What is the most likely outcome. Can they dismiss me.

      Anything is possible but there is no way I could predict the most likely outcome without knowing how you have performed to date

    Hi , I got exited from a company on training period just 3 weeks in it !! The reason they say is my training period assessments/tests until now were not up to the mark !! I am on a contract basis . Is this legal ? As it is not mentioned in my appointment letter regarding laying you off during training period

    Im watching this vid after having a terrible week starting off as a pharmacist in a hospital 😂 Ive come from working in community.
    But dont want to give up - Im determined to see this through to the end, however I feel like im seriously back at university (i.e. student) learning in a different environment. Think i have a 3 month probation period

    To work as an DMV employee u need to pass a 1 year probation, I got fired during probation, kick me out like a dog 🐕

    I recommend everyone move to other countries in europe particularly germany, france, spain. From what I am reading here, employment laws in Ireland seem barbaric. To much like the UK and their "zero hour contracts". If you are Irish then you have the right to freedom of movement, if you are qualified in something...why are you still here? Money? That doesn't work out because the difference extra you make working here in Ireland verses spain is swallowed up in rent and generally higher living expenses. So all you are left with is the same money but worse weather.

      Then it may be possible to bring a claim on discrimination grounds-that is, that the dismissal was related to a disability. I would need to know all the facts, though, and the person would need to contact me outside of CZcams as I do not give legal advice on CZcams, or anywhere online.

    Greetings from Ryan in Hong Kong. I was hired by a company with a 3-month contract which included a 1-month probation period. I was dismissed after the probation period. The contract says “At the expiration of this period, we will either confirm or otherwise determine your appointment in writing.” However, they were silent and did not confirm my appointment at the expiration date. Two weeks later, the employer terminated the contract , asked me to leave the office and refused to pay the notice money.
    The contract does not contain anything allowing the employer to extend the period. Hong Kong Labour Law does not have any description on probation either. In this case, what should I do? Do you think I may win in the labour tribunal court?

    I would like to whistleblow, when is a good time while on probation, when you feel the boss will dismiss you. Whistleblow immediately or wait it out?

    I was in a car Accident a month before my probation finished . (6months) I've been given a letter to go into a teams meeting to discuss probation or to extend. If they choose to go down the road to fired me , is it illegal because it wasn't my fault I was in a car Accident? my sick note ends on the end of October?

      When on probabtion they dont have to give a reason as to why they are letting you go. Although, I think everyone deserves to know why that way everyone could work on whatever it is they need to work on for an upcoming position.

    What about defamation as reason or contributor for the termination ?

      Not sure what you are asking. But if the employee is on probation and defames a colleague then it is unlikely he will pass the probationary period.

    Im not harm to society in my 19 birthday i was heading to my house at 2 am I was really tired and lil drunk I wanted to go to my house so bad I was falling sleep i accidentally crash to someone got down ask person he was good got into my car and just waited till police show up . I got arrested and later the charge where DUI and bruce knuckles
    I didn't leave the scene and stay there to make sure i was gonna respond for my acts 2 days in jail I paid my bong. got out after 6 months i got probation 2 years and DUI with the chance to clean bruce knuckles from my record , I was already 2 years working at store name heb a month ago i honestly got tired how racist was the environment or just disrespectful with me i should have report it but it was almost half store employee so me against store nvm im just like i didn't kill no one i stay in the scene that happened in 20 October 2018 its 25 January 2020 im still in probation now I own 1,350 of honestly don't know i just need one more hour of community services to complete the 40hrs and Have moved so many times cuz honestly im not establish paying all the gas the money to probation office

    You cannot discriminate people but come on there is no hope for some people in this world in certain jobs espeacially when working as a team when you have peoplw who have just came out of prison is there?😕😏🤔

    What about if you get fired from Big 4?
    Say ur in ur 30s and 2 months into a new Big 4 they fire u because u prioritized studies over work, meaning ur studies (professional certificate) impacted work. What to do in that situation?

    Hello Sir!
    My probation was terminated after two months at work at the same store I did my internship for three weeks. I’m very sure they signed me b’se they liked my abilities.
    I disagree with my dismissal, first I have anemia which makes me weak and slow sometimes depending on how I eat and other things. The other thing my boss never introduced him self to me which I think he didn’t like me because of my skin color.
    I got to know him the day he wanted me to sign the dismissal papers.

    Hi Terry question what do you think about a probationary period has been suspended, do you think this is fair and is there anything I could read that would help me with this? The employee is still working just been asked to suspend the probationary period. Any thoughts? Sorry the probationary period will commence at some time into the future, just asked to suspend it temporally.

      Frank, it is a bit unusual and I am not sure that this decision would not be beyond challenge in the future if there was any dispute before the WRC. If I was in the job for over 12 months I would be arguing that the probationary period no longer applied to me, suspension or not.
      I think a WRC adjudicator might arrive at the same decision-for example if you were in a job for 18 months but the employer claimed the probationary period was suspended for the first 7 months. I do not think this would stand up to scrutiny, to be honest, I could be mistaken, of course.

      I already finished my probationary period at work but they (my employer) didn't showed me any letter saying that I'm done with my probation. is that legal?

      @@richardmill5282 It depends on the letter or document. If you have passed probation you do not need a letter to that effect if there is no controversy between you and the employer. In any event, 12 months' service is a far more important milestone.

    I'm on probation because a girl kept messing up the customer order and she raised her arms up and shit mad at him. But since I'm new it's my fault , fucking bullshit!!!
