I didn’t know it was a crime to sell fakes. In NJ and in Chinatown, and midtown NYC you find fakes of all kinds being sold on the street. That rule in the USA would put a lot of vendors out of business.

The manufacture (which is hard to discover) and sell of counterfeit items is illegal. But the prosecution of such a crime is difficult, especially in a liberal city. So officers have to ask themselves if it is worth their time to take actions on that crime.
The U.S. destroys millions of counterfeit items every year. It's very much a crime here.
The vendors selling on the street are often selling replicas in the open- items that look similar to a big brand but don't claim to be real. They sell better quality counterfeits but only once you convince them you aren't LE.
