    What is this post tender negotiation?
    In public sector with an open procedure negotiation is not permitted without enabling Public Contract Reg 32, which is only available given specific conditions.
    So post tender negotiation is not a standard opportunity in public procurement

      I love how you look at it from The Public Contracts Regulations 2015
      You are right about Public Contract Reg 32 (Use of the negotiated procedure without prior publication) which is applicable in U.K
      PTN is not a full negotiation it is actually used to “make a deal better” after you have selected a supplier from tendering but haven’t actually awarded a contract… think of it as final way of making a deal even better
      But with the regulation you are talking about, the assumption is that tendering process was not used…as in contract was awarded on the basis of negotiation alone and you see how that can result into issuing of public contracts without being fair. So the Act in this case is supposed to regulate issue of public contract without using open tenders
      The regulation is not really about Post Tender negotiation BUT rules regarding public contract award via negotiation if tendering is not used

      @@ZeriteNetwork appreciate your time and effort taken to respond. So sticking with public procurement regs, there is simply no option to engage suppliers for PTN that I am aware of, or seems to be common practice.
      Is there a specific example of evidence you can provide that confirms this is a permissible situation as I wouldn’t want to be letting them off if the option is available to me.
      I have colleagues who work under light touch allowances which allow exactly that, but over threshold procurements (previously OJEU) do not allow negotiation beyond tender submissions in the view of my public sector employer?
