Literally all you need to prove is
      1) you are no longer employed, doesn't if you quite or fired due wages are due each state varries but they have a prompt periodthey are allowed to send it, some states mandate that at terminationof employment ALL due wages are paid immediately (within 3ish days) some others allow for remainder to go on nxet pay period. (timesheets would prove that unless they are lying about that and faking numbers in which case you have a larger lawsuit on your hands)
      2) That they didn't pay you your final wages (once again, the pay records crossed against timesheets would prove that unless once again they are faking that as well.)
If both of those points are true, and both can be verified by both company records and your timesheets and pay stubs they are breaking laws. You don't have to prove anything, they are legally required to follow the law, it's literally that simple for a reason.

Exactly. The employee is better off being let go than quitting unless they have something else lined up.
Voluntarily resigning forfeits any right to unemployment compensation whereas certain terminations will still cover the employee for unemployment benefits.
Termination with cause (eg performance issues) do not qualify the employee for unemployment though the employee can challenge that claim in labor court.
I’ve done it & was awarded unemployment as it was determined an unlawful termination (the employer lied about it being a performance issue & I was able to prove that) despite being in an at-will state.

@@87Ahoff87 Incorrect in many states. All it takes is making the offical documentation state a cause for firing you and that automatically disqualifies you from unemployment eligibility, even if it's fraudulent or retaliation because it then becomes *YOUR BURDEN* to prove to the state that the claims made by your previous employer were lies, and that's IF the state will even hear your appeal. I was fired upon discovering my boss had been embezzling from her own company and defrauding the state of sales tax for years and had hoped it was a bookkeeping error or maybe something I didn't understand, but no, and my wishful thinking gave her time to formulate a whole built up lie that I could have easily disproved but the state never even gave me an opportunity to appeal the automatic denial.

I used to work at a bar 2 years back as a highschool gig. I got this job at a much better place full time and put in my two weeks (which in my state, you can just quit…two weeks is just a formality) and my boss excepted it. The day before quitting day, my boss tried making his yes man inform me I was still working the full weekend. I went to my boss and he told me “oh no, the two week notice starts the week AFTER you put the notice” keep in mind I was already working at that full time job at the time as well. I called his bs, he got mad, begged me to work the weekend, I said maybe and didn’t return for the days they tried bullying me into. Maine is the only state that allows people at 17 to work in places that all a minor to sell booze, and most bars won't let anyone under 21 in. I think you aren't telling the truth.

They probably figured he wouldn’t quit because he had stayed, and didn’t want the new hires to quit when they were already short staffed. He put in his two weeks and then when he went to work to see they scheduled his last two weeks with horrible hours and mostly consisting of the only thing he hates doing, he told his manager he wouldn’t be coming in the next day, or any other day. Then he texted his coworker groupchat saying bye and then left the group before they could kick him out, as they always do when someone quits. Petty, but kind of legendary

Important lesson to do your homework when you quit.
I'm leaving my job in March most of the supervisors know that I'm changing careers to go to school.
One of the higher-ups at the company that I worked at heard when that I was leaving and told me that I would never find a place that could make as much money while I go to school.
Then I also explained how my pension, vacation time, lieu days and sick days legally had to be bought out upon my leave as a full-time worker. Which was equivalent to a half-years salary. And explained to him that because I was hired from the union and not by the company, I could be hired back as a fill-in for the summer when the majority of people are on vacation.
The look on his face when he realized he had no legal decision in this was priceless.

I gave him a 2-week notice and they tried to withhold my pay after the two weeks saying that because I didn't work there anymore I wasn't entitled to the money that I earned while working there still during those two weeks. I brought up every single code that they were violating which happened to be actually seven due to the type of work I was doing and I gave them a quick calculation showing that if they didn't pay the roughly $1,900 that they owed me for the two weeks worth of work that I did. It would almost triple by the first week that they didn't pay me and there was already stacking interest due to them not paying the first week worth of pay. They ended up having to settle for $2,700. All because they want to be spiteful that I left because they were hiring new people on that had no prior experience in the field for more than what I was making as someone who had been there and was taking on managerial roles.

French here and quitting my job - in France we have two main ways of leaving a job: quitting in a dry manner, like "hi here is my official request, you have 2 months to deal with that, at the end of these two months I'm OUT", and there's the "amicable" quitting that involves a sort of severance package + makes it easier to get social help to have the time to find another job. Except ofc the average employer will push for the former quitting to not have to pull money for the quitting employee.
My advice in that situation is to go for the second style of quitting, they have a month to get shit done + the employee can have the assistance of a union to make sure the employer is not fucking around and negotiate the amount of money to get more than the legal minimum on top of providing legal advice. Anyway, that's your sign to unionise.

I'm also neurologically and psychologically disabled. I have medical certification from specialists and letters of disability but have been repeatedly denied any disability assistance. 40 hrs/wk is very physically demanding for me but I do it because I have to. And I'm the exception, not the rule, for being able to make it even this far with how difficult everything has increasingly become. I’m 29, and worked many jobs due to bad management and not wanting to run the store on minimum wage. I’ve managed many and even started businesses and sold them to make cash. Long story short, the two weeks and the three days technically aren’t even legal laws. You can leave that day. Best yet you technically don’t have to tell them. It’s common decency to do so, and give notice so they can find replacement but it’s absolutely not mandated of you depending on your state. My state they can fire you for no reason, yet you are told you need to put a two weeks in if leaving…. But I’ve never given any company unless I truly loved them the chance to know or hire. Why? Because they didn’t give the number of employees I’ve seen fired the chance to find a new job. They can’t decide what they want and don’t want but treat their own workers differently. 😂 I’ve ran my own business now for over 3yrs and haven’t worked for the “man” in over 5yrs.

FYI, 2 - Week notices can also backfire depending on whether more people are performing your duties.
In my department where I work, after a person submits their two week's notice, the employment is immediately terminated on friendly status. In some states, the company has to pay out those two weeks, but not in Texas.
Of course, there is a valid reason for this. Our company has a lot of information they don't want going to competitors. As such, once they know a person has submitted their two weeks, they get them out of the building to prevent any possible theft or destruction of company data.

Let Granny pipe in. The two week notice thing does not apply to you. You are what is called an "at will" employee. You have no contract. Meaning, you can quit at any moment without repercussion. This is why they can fire you on the spot. However, if you are maybe an office worker, that signs a contract with that company, you are bound in the contract to give notice when you are going to quit. This way they have time to fill an actual position. They also have to give you notice of being fired, in most cases. Unless you pose danger to other employees. Then, they can just tell you to leave. So, if you work fast food, Walmart, or a mall job, two week notices don't apply to you.

This may be country dependent (maybe state?) but I've NEVER been with or heard of a company in the US that has to give employees notice that they are being fired, and I've been working in a corporate office setting for many years. Quite the opposite in fact, if you are being fired, they can have your access shut off while you are in a meeting with your boss & HR telling you that you are being let go, and you just walk out (sometimes with a security escort). One the other hand, I've never signed an employment contract that requires me to give two weeks notice, it's just what you do so you don't burn that bridge and they give you a good reference.
Now I'm not talking about layoffs which usually happen differently, but unless it's a massive layoff situation, they still aren't required to give you notice then either.
