    Whats clear to me from watching this reenactment is that human memory is extremely unreliable and i dont think either recollection of events explains exacty what happened

      That's true, memory is very unreliable. Especially after some time has passed. If you look at the hard evidence though, it seems to line up with the officer's account of events.

      Because people realize it’s a worthless point anymore. Would be even more interesting to see ALL the other grand jury “witnesses” that had their “stories” proven completely FALSE (one of them wasn’t even IN St. Louis area at the time!) and the FEW that came forward and told the truth of what they saw. Sad day all around. Life lost and lives changed forever over what? Walking in the street and stealing cigars??

      @San Diago honestly, if you don't want to get profiled, don't do the crime. there is a disproportionate amount of blacks that behave badly that is giving other blacks a bad rap and i know that from experience. black golfers however, for reasons i can't explain are the nicest people on the golf course.

    Legally speaking, the use of deadly force is justified when five components are present: imminence, innocence, proportionality, reasonableness, and (sometimes) avoidance.
    If Michael Brown went for the gun, he was definitely posing an immanent threat of deadly force that any reasonable person would recognize, and to which a proportional response would encompass force up to and including deadly force. Thus the components of imminence, proportionality, and reasonableness are met.
    If Michael Brown did NOT go for the gun, there is an open question as to whether the struggle in the car represents a deadly level of force. In my opinion it still does constitute deadly force, as people die from pugilism all the time, but the question is actually moot unless you can PROVE that Michael Brown did not go for the gun. Because the defendant has the presumption of innocence, the burden of evidence is on the prosecution to demonstrate that this version of events is untrue. As far as I can tell, this was not sufficiently demonstrated.
    Officer Wilson, not acting as a civilian, had no duty to retreat, thus the element of avoidance does not apply in this case. What remains to be proven is innocence, by which we mean that the wrongful use of force was not initiated by the person claiming self-defense. While the confrontation was initiated by Officer Wilson, this was within the legitimate scope of his duties, and thus the element of innocence is also met.
    While we have satisfied all five components of justified use of force, we have not completely exonerated Darren Wilson, since the confrontation in the car is a separate confrontation from the one that took place outside of the car. As far as the law is concerned, the moment Michael Brown fled the car, the imminent threat to Darren Wilson ended, and so did his justification for use of deadly force. Up until this point, Darren Wilson has done nothing wrong (unless, again, you can prove Michael Brown never went for the gun).
    The question that remains to be answered is whether Michael Brown presented a second threat of deadly force to Darren Wilson when he turned around to face him. If Darren Wilson's version of events is correct, Michael Brown's actions can be (reasonably) interpreted as an (imminent) threat of deadly force (to which the use of deadly force constitutes a proportional response), which Darren Wilson did not initiate (thus rendering him innocent of incitement). Thus Darren Wilson's version of events meets all necessary components of justified use of force in the second altercation, as well.
    Once again, the law affords the defendant a presumption of innocence, which means the burden of evidence is on the prosecution to demonstrate that Officer Wilson's version of events is incorrect. Apparently the prosecution did not do so to the satisfaction of the Grand Jury. Were this case to go to trial, the prosecution would have a very difficult time proving that this narrative was untrue beyond a reasonable doubt. The decision not to indict was the correct decision based on the evidence that was brought to bare in these proceedings.

      Da Booser well that’s the thing, I know that obviously stealing cigarillos shouldn’t be punished by death, but whenever you make that decision to steal/rob, you may have to be cognizant of such risks. It’s like how some of the liquor store owners started going crazy and shot people for stealing candy bars and sodas, you never know what might happen when you make that choice to steal from somebody

      @@politereminder6284 Yes the police officer stopped them for walking in the middle of the road. It was then he realised one of them was holding the cigarillos. He didn't get killed for the cigarillos. He got killed for punching a police officer in the face and wrestling for his gun. If you think the killing was unlawful. Ask yourself this, what would you do if someone 6 feet 4 and weighing 292 pounds punched you in the face and then tried to take your gun off you.

    I'm not making any judgments. In my town I know that some of the cops are real a-holes and I'm white, middle-aged (well, if I live to 124). But this one cop who came WHEN I CALLED THEM (because I thought I heard prowlers but it was actually animals who had come down from the woods) treated me with such disrespect in front of my own house that I finally answered back with "Oh yeah, FU!" I thought I had really done it and would be taken in or worse, but they just kept on disparaging me. (We had about a 5-year history when my mother was going senile and kept calling them and telling them she was afraid of me and they believed her - and they were sick of dealing with us - until she really lost it and people realized that she really needed to be in a home and I was vindicated)
    So I understand what I did was stupid, knowing the cops in my town and I believe that many cops consider African American young men 'thugs' like a certain someone likes to say. But having said that, in the re-enactment the witness described fear of the cops, as in 'the cops are up the street, the cops are on the next block, be careful.' I'm just wondering why then, when the cop rolled up and they were in the middle of the road and told them (yes, probably very aggressively and with cuss words like the incident I witnessed myself) But I wonder why they just didn't get out of the road.
    Do you think it was a variation of my incident, where they were just sick of the treatment and wasn't going to take it any more? (Plus their masculinity could have been in question in their opinion and they weren't going to wimp out in front of this white cop) Who knows? But that was my only question. I can see it both ways. If you're afraid of the cops, just get out of the road when they tell you. But I do understand that after a while when you think you've been treated unfairly you just forget about the danger and just say FU.

      Michael Brown had just strong arm robbed a convenience store and then tried to assault and take the gun of a police officer. He was, by all definitions, a "thug". Obama administration's black attorney General did a massive investigation into this and found Darren Wilson innocent of wrongdoing. Multiple black witnesses gave accounts that said Michael Brown hit Officer Wilson and tried to take his gun.

    Nonviolent crimes should stay nonviolent. Yes Michael Brown had committed a crime but he didn't deserve to pay for it with his life. This cop escalated the situation. Here's how it could of gone differently : the cops stops the pursuit, Michael Brown gets away, the cops go and collect evidence from the store get a warrant to arrest Michael Brown. Brown gets his day in court, judge hands down punishment, justice is served. Nobody dies. All this cop had to was take the extra steps and walk away from a situation he knew he was escalating to conflict.

    Johnson's testimony was obliterated by the evidence. He said that the tires on the car were screeching, however, no skid marks were found on the road. He said that Wilson grabbed Brown by the throat and could see Wilson's muscles flexing as he was choking Brown even though Brown sustained no injuries to his throat and Wilson's DNA was not found on Brown's throat. He said that Wilson was attempting to pull the 300 lb Brown into the car window on top of himself (ludicrous) and that Brown never hit Wilson even though Wilson had bruising and swelling on his face and scratches on his neck. He said that Brown never touched the gun and that Wilson fired the first shot out the window and that he saw blood run down Brown's shirt, even though Brown had a close range graze wound on the palm of his hand, his DNA was found on the gun and the first shot was fired across Wilson's lap with the bullet becoming lodged in the door panel. All indicating that there was a struggle over the gun. He said that Wilson fired a shot at Brown as he ran, Brown then turned around after he felt the shot, put up his hands as he started to kneel stating that he didn't have a gun before the remaining shots were fired, even though the audio recording of the first 6 shots contains no pause after the first shot and that blood stains 22 feet east of the body proves that Brown moved towards Wilson and the position of the shell casings east of the body indicates that Wilson was backpedaling while firing to prevent Brown from reaching him.. Nice attempt by the creator's of this production to spin Dorian Johnson's testimony to appear credible. Dorian Johnson is a bald-faced liar and the forensic evidence proves it!

      +joshuaoha Of course the video is spinning the testimony to make Johnson appear like a credible, sympathetic character (and skipping some of his more ludicrous testimony). The prosecutor is also looking at him sympathetically and being curt with Wilson. The actual words may be verbatim, however, the actors can attach any mannerisms and inflections that they want to the dialogue. And, who said anything about media being "liberal"? The media may or may not be "liberal", but it was most definitely biased against Officer Wilson.

      I didn't try refuting all of the evidence..I'd only attempt to if I had access to the raw data and spent the time to formulate an analysis of what I thought happened.
      But even then, the physical evidence isn't fully conclusive, and you can't rely on witness testimony on either side..but you gotta keep it real.

      +Jon Smith Yeah, the physical evidence is as conclusive as you can get without actually seeing the event on video. The fact that every piece of evidence corroborated Wilson and the witnesses that backed him up, tells us that he was telling the truth. Conversely, it is a FACT that the EVIDENCE made it perfectly clear that Johnson, et al, were a bunch of bald-faced liars. You can go back and study the evidence and compare it to the witness statements, if you want, however, just read the DOJ report that did the same task and came to the same conclusion that Wilson was credible based on the evidence. He could not be indicted because there was not one shred of evidence that contradicted his testimony or one credible witness who could be relied upon to testify against him.       It was a screwed series of events, hard to deny that. That being said the number of shots is something I know comes across as shocking to a lot of people. In any military or police training I've received I was taught to fire until the threat ceases, but that you're almost guaranteed to never fire only one. You'd be surprised how many hits a person can take and still keep going. Not saying who's right and who's wrong, just trying to give a bit of insight.

    The series faltered with this one. Sticking with the transcript verbatim is what makes the concept so compelling. Interspersed text shots, flipping back and forth between witnesses, and dramatic music, are best left to the activists. That said, the topic chosen was a good one. This performance really demonstrated why the Grand Jury reached the decision it did. There were conflicts in the accounts, and only one side was contradicted by evidence, therefore the testimony of the false witness, however sympathetic, was rightfully disregarded.

    After listening to the testimonies on this case, I realize that this was not about one incident, but about poor police-community relations over a long time. That young man lost his temper after years of community harrassment by the police. That day, he was just fed up. The police officer began the whole interraction with rudeness and aggression. Whereas Brown should not have returned that aggression, twelve shots is a lot.
    Edit: I have learned that people in headlocks with restricted Airways have an adrenaline rush that causes flailing and involuntary movements similar to a drowning. Brown could have been having such a reaction when the cop thought he was attacking

      You want this cop to be in the right so badly. the DOJ wrote a damning report on police culture and practices in fergeson after this incident. they did an intensive investigation into Police brutality, racially motivated behaviour of police, and poor priorities on the part of the department that led to the uprisings in Fergeson.

    Acting in the film, Uzo Aduba before we ever really heard of her. Excellent. As to the shooting: well, that escalated quickly. One minute? BTW, Wilson was 6 ft. 4 inches and weighed 215 lbs, so he wasn't a little guy. "Big Mike" was bigger, but he didn't have a gun.

      Nobody ever talks about Wilson’s size, ever.. appreciate this.. not only was Wilson a big man, but had 10 years on Mike (grown man strength), and was a trained officer, so there’s a certain level of physicality to his life that is more than the average human, and for him to say the punches in his face almost killed him seen pretty far fetched considering he face had not blood or bruises on it

    The indifference to robbing a small business and aggressive and intimidating demeanor of Brown shown in the tangible evidence directly prior to the incident with Wilson, kind of makes me hesitant that Brown and his friend were merely talking about life goals and dreams innocently walking down the street. Okay, maybe goals of how many blunts they’d smoke that day..

      According to Wilson it was threatening and intimidating. But what would be the difference if they were actually talking about smoking blunts etc? I lived in Ferguson/Jennings MO when I was 22 and spent plenty of time discussing plans to smoke with friends that night. Yet somehow I strongly suspect that if it was me, a young white person seen engaging in that behavior (which is nearly ubiquitous in that area) Wilson's interaction with me wouldn't have ended up with me shot like a dog in the streets. Whatever TF they were or were not talking about while walking should have zero impact on an officer's decision to not only use deadly force but extremely excessive deadly force. But even if they manage to refrain from shooting your that police force is NOTORIOUS for targeting young people, especially young men and especially young black men and taking all manner of interactions way too far with physical force.

    I am going to make a comment, and I am respectful of both sides, so my purpose is not to offend anyone involved with the case.
    I believe that humans are culpable, and that it is very easy to misinterpret another person’s intentions. We all have our own mannerisms, and our own way of expressing our emotions. These differences make it very easy to misunderstand a person’s true intentions, and this fact is exacerbated by preconceived notions such as “guilt by association”. This is a factor that leads both sides to become defensive, and to assume the worst. Ex. The officer might assume that he is going to have trouble with a suspect based on their appearance, or body and verbal language, which might cause the officer to associate this person with another suspect that the officer had previously encountered, which had a negative outcome. The officer might associate the suspect with drugs due to seeing that the suspect is holding a handful of cigarillos.
    And the same can happen with the suspect that the officer is encountering. The suspect may have had what they considered to be an unfair interaction with a police officer, so the suspect automatically assumes that this police officer’s intentions are nefarious as well, simply because they are in uniform and belong to the same association, “law enforcement”.
    There are so many factors involved with a police officer and a civilian.
    I think that when both parties clash, lines get blurred, and it’s almost impossible to conclude who is at fault, when in fact, both parties share fault.
    To me, the most important factor in the entire incidence is “intention”. Intention is a huge factor!!!
    People are imperfect creatures, yet they all want to justify their actions.

      McMatthew99 yes, you are right. Unfortunately we live in a world where there are ALWAYS “bad apples”. I honestly don’t think this cop was one of them. I live in suburbs of St. Louis and by freak chance I have a “source” at corners office. We were told there were no “rear” entrance wounds on this poor kid and to this day I don’t know why the County Police didn’t provide this info to the public. It doesn’t make sense to this day. This grand jury had a ridiculous amount of “witnesses” put in front of them and 95% of them were found to be not credible. One was even in ATLANTA the day of this shooting! The reliable and credible wittiness ALL said the same thing. Fight in the car, gun shot IN car, kid ran away then turned and “RAN” back at the car. It’s a loss of life that just didn’t need to be over something stupid. People just need to respect people, regardless of race, job, or whatever.
      Last thought. Statistics show that 95-98% of police officers will go their whole career without ever firing a shot.

      In most police shootings, when adrenaline is pumping and their lives are in danger, their actions are so quick that they can’t fully process it until it’s over. There are times where officers think they fire around 4 shots when in reality they emptied their clip due to being scared for their lives. It’s pretty common and there’s not really anything additional training can do about it

      Lol, but not the same weight. Mike Brown was 290 pounds vs Darren Wilson 210 pounds. Also, Darren Wilson was sitting in the driver's seat of his patrol vehicle which puts him at a disadvantage. One of the biggest problems with factual crime content is its reliance on fictional crime editing and scoring styles. Dramatic non-fiction content should be left alone, otherwise it's manipulative.

      The physical assault may explain the first shot, but the series of rounds after he's already wounded seems a bit uncalled for.
      Police are trained to deescalate and disarm people carrying weapons without shooting them. Brown did not have a weapon, and was already shot and seriously wounded. Do you really think it was ethical and justified to unload the rest of the clip after that? Why didn't the officer stay in the vehicle after they ran away and waited until backup if he felt physically unmatched? I think the officer let his anger, which doesn't necessarily have to be racially charged, get the best of him and now a young man lost his life and the murderer is walking freely.

      Yes it was ethical for Wilson to "unload" on Brown. All law enforcement officials and military are trained to shoot until the threat stops and can shoot 13 rounds in under 4 seconds- An average runner can cover 25 feet in 3 seconds. The officer was only physically unmatched when disadvantaged in his car and called for back up once outside on foot. The officer is charged with the duty of also pursuing unlawful individuals not necessarily to physically take them down, but also to keep eyes o them instead of letting them run free, putting other officers and citizens at risk. Michael Brown chose to gamble his life against Officer Wilson's conscientious duty, even though he knew he was in the wrong , and lost.

    This case should have gone to trial! Bob McCulloch should have assigned another prosecutor to the case, seeing as though his father was a police officer killed by a black man. It is not a stretch to say he had bias in this case.

    It makes no sense for someone who has just been shot, to turn and run back towards the person who shot him. I mean, no gun, no vest,... no nothing. I'm a military man. I've been wounded. I know how it feels to get shot as well as shot at. Once a person is hit, the pain is so intense that you feel as if you're going to pass out.... I can honestly say that, unless a person is mentally ill, or high off of PCP, it's extremely unlikely that the officer's recollection of the events of that day are in fact true. The officer lied.

      He was shot in the hand during the struggle for the cops gun inside the vehicle. Brown taunted the cop that he did not have the guts to actually shoot. I think Brown was used to getting his own way but intimidating anyone that confronted him. There are witnesses that were in a position to see what happened, in a car on that street at the time it happened, that corroborate the cops account. There are witnesses that were in a poor position to see and only saw part of the situation that support the friends testimony that say Brown never reached into the car, there is DNA in the car, and that the cop stood over Brown and shot him six times in the back, the autopsy proves otherwise.
      The 10 shots that the cop fired while Brown was rushing him transpired over less than 4 seconds, audio evidence. During the time that the cop commanded Brown to stop 3-4 times, Brown was closing on him. Between being hit twice by a 6'5", 300 pound man, and adrenaline, I would be surprised if the cop DID get all the details right but it was still more accurate than the friends testimony. The friends adrenaline was up due to the fear of being arrested for stealing and appears to almost have a PTSD after being shot before. Answering to the best of your recollection is not a lie but that does not mean it is true.

      Except for the fact that all of the bullets were in the front of Mr. Brown's body. He was never shot in the back, so why would it even matter if the officer shot all his rounds right away or in two series of rounds.     If nothing else, this was a case of pretty good witness preparation. Both sides had their ducks lined up nicely, with the testimony corroborating the evidence.

      Znwarp Dorian Johnson testified that Mike Brown hadn’t grabbed the gun but that is pretty conclusively disproven by forensics.

      Actually no. All of the evidence proved that the the friend of Mike Brown was was a complete liar. At 1st he said that Mike Brown was shot in the back. Then he said he had his hands up as as in "my hands are up don't shoot." All of the forensics and all of the other eye witnesses proved that he was lying.

    I know I’ve seen this guy playing Darren Wilson before, maybe a Lifetime movie, lol....all great acting. Especially Crazy Eyes and the guy playing Dorian Johnson....sorry, haven’t found their names anywhere.

    Ya right they were talking about the Bible study they were heading to when all of the sudden the cops showed up and shot us .
