    I agree with Sam. If you operate a religious establishment such as a church - and I say this as a gay man - you don't have to perform a gay wedding. Fine. But if you choose to operate a commercial establishment subject to secular law, such as the law against discrimination that the cake case was based on, then you should be expected to follow that law, or have consequences - just like every other business.

      The trouble with this is that we fall into their rhetorical trap. We shouldn’t even engage with their red herrings. No church is going to be forced to marry a gay couple just like no church can be forced to marry anybody else. Churches are already free to discriminate against people of other religions and even other races, not just gay people. Let’s stay focused and not fall for their rhetoric.

      A huge problem is that hospitals and insurance companies are allowed to discriminate because of religion and deny contraception and other reproductive services. How is that right? Much of state taxes goes into hospitals.

      Go the French route! The only legal step for marriage is at the registrar at city hall (or whatever the proper English translation is of this that I had French friends explain to me), whatever happens in churches are a purely ceremonial proceedings only to the congregations and their gods with no legal impact. Proper separation of church and state.

      To play devil's advocate: in the case of the baking of a cake for the gay couple, shouldn't that be allowed? I've had this idea that it was wrong, but a guy once challenged me on this by telling me that it should be allowed because it's a private business. I countered by saying that the refusal to bake the cake was still wrong, to which he replied how I would like if somebody got to dictate how I handle my business. Given how I am an artist, the idea of me doing a commission of something I didn't like, and still having to do so because I should respect the person giving the request doesn't strike me the right way. If I like to draw girls and a person commissioned me to draw hairy muscular gay men (not that I discriminate against people like that, I'm just not interested in drawing them), wouldn't that be the same thing? Is this a fair comparison? Somebody once used the argument that it's wrong precisely because he finished the cake and _only_ upon discovering that it was for a gay couple he decided to not proceed with the payment, but that strikes me as non-sequitur since it doesn't adress the core issue. Anybody care to help me out? Thanks.

      tbf, a lot of religious jews were persecuted by the USSR for their religion, forcing them to abandon their religion and cultural heritage, even banning Hebrew. of course nothing that happened was as bad as the Spanish Inquisition, but historically there are examples of atheistic countries trying to impose their lack of religion onto the citizenry. not to say that's happening in the US, the US isn't forcing religious ppl to give up their faith, but it is a bit disingenuous to pretend like no country has ever tried to force atheism onto the citizens, when the USSR is a pretty clear example of such a thing occurring

    thanks for the video. here in Israel we have a whole government of Ben Shapiros. one of them just took the role of overseeing all extracurricular stuff that may enter schools and he is eying the curriculum itself - aiming at removing all reminders of non heterosexual families, cancelling gay parades, etc. so maybe it is good that the USA version of Ben Shapiro (i.e. theocrat) is not someone who walks the halls of power...

    Religion in the Soviet Union was actually very intricate, the CZcamsr Lady Izdihar does some great videos on exclusively that subject, Stalin actually lead the Religious Thaw later in his time in office and Religion continued to be Liberalized for the most part after; the main reason for the appearance of the persecution of Religion initial was that Lenin thought it could be abolished through education, but mostly because Religious institutions were being used, much like we see in the United States, as a radicalizing recruitment ground to promote terrorism against the government; the White Army was very religious and leading pogroms and clandestine terrorism against the Soviet Union, stomping them out required the government to be stringent with those Religious institutions that were aiding them.

And most of the Islamic regions had a decent relationship with the Union. Much of the "Anti-Religion" hype about the Soviet Union is done by Far Right Reactionaries who need to keep this propaganda up for the Religious populations in their home country not to be inquisitive about Socialism.

Not saying it’s right or wrong, but so much of conservatism IS essentially the idea that, life has objective truth to it, whereas progressives often feel life is whatever anyone subjectively defines it as.
      The reason I bring that up is, to a conservative, the idea that life, including family, is “whatever you make of it” is nonsense, but to a progressive, the idea that “life has an objective meaning to it, with objective structures such as the nuclear family”, a progressive sees that as authoritarian and oppressive.

And it's also objectively true that many times the person or people playing parent(s) can't be the biological parents because shit happens. These radical rightwingers who people call conservatives aren't trying to conserve or go back to an existing status quo where every family is biological father, biological mother and their children born from the mother from their father's seed. And this isn't even such an old idea, this comes from the 50s after WW2 ended. Not even SCOTUS has any business pulling interpretations out of their ass whenever they feel like, because it's not their job to MAKE laws, but to _settle unadressed matters_ around them that Congress didn't get to in the first place. If it was _solely_ up to them to interpret laws, then they could just declare themselves rulers of the land just because no one could tell them otherwise; That's just not how that works.
      By all means, they have an obligation to _follow_ the law, that is to say, follow the leads from Congress and the Presidency. These are lifetime appointments, and not actually voted on by the general public. By that very nature, leaving it all up to them as having first and last say on the law in spite of the country completely misses the point of our politics and Constitution in the first place. "A government Of the people, By the people, For the people" cannot be something that just casually leaves THE PEOPLE out whenever it feels like.

      @@MrMarket1987 You're technically right as a matter of law, but practically speaking, there is no constitutional mechanism short of impeachment (like that's ever going to happen again) to overrule SCOTUS. As a result, their collective power is comparable to that of a monarch, only ultimately restrained by the potential loss of political legitimacy and the threat of revolution. That said, I don't think the current court, as crazy as it has become, would overrule the Respect for Marriage Act. Sure, I can imagine Alito and Thomas and perhaps Barrett voting that way, but even the conservative justices fall along a continuum of ideology, and most have at least a little regard for the law, if not precedent. Now give Trump or DeSantis another term or two and Mitch McConnell or his successor an opportunity to game the system to pack a few more conservatives onto the court, and I think anything could happen.

    Shapiro is a clearly very intelligent which is why it's so odd he's reached the wrong conclusions from simple set ups. Put simply he posits a hypothesis based on his political position that he finds unalterably true and then when facts contradict this he warps and cherry picks outcomes to reaffirm his hypothesis. If you did this as a scientist you would be instantly dismissed. It's annoying because he's clearly smart enough to know what he's doing but deliberately ignores it because it's inconvenient to him. In the same vein he supports white nationalists despite being an observing Jewish man and he must also realise they hate jews. They chant it at rallies. At Charlottesville. What is he actually hoping for? He appears to support theocratic nationalism (which in the US means evangelical christian) so if his "friends" got what they wanted he would be first on the pyre. He's a Quisling but with no real reason to be so. I'll give him credit because he must be aware of his position but I think he's dug his hole so deep now that he can't climb out and the only thing he can do is keep doubling down.

I suppose my point is that he's intelligent enough to be aware of facts and ultimately accepts them but he has to tie himself in knots to fit his political position. This is what annoys me about him. He's established a stance and even though he's fully aware that all the evidence contradicts it he can't let go of his original position. He's a conservative Orthodox Jew, and that's fine, difference of opinion and constructive debate is what liberty is all about, but he's so incredibly entrenched that he can't change his mind even though I think he largely agrees with opposing positions. He lacks any ability for contrition or humility. Some times we're just wrong and we have to accept it, understand why and move on. But he can't, for some reason. But he so obviously knows he's wrong and still can't move on from that. That's my issue with him. He's not a "true-believer" as such and is a rational thinker but he won't let facts, common humanity and decency or even civility shake him from a position he's staked in the ground that he clearly knows is false.

Sam and Emma cite the polls, which overwhelmingly support what Ben Shapiro calls “the liberal agenda” because Shapiro is lying about the general support for these things. I couldn’t say exactly where Sam’s views come from: whether they come from Judaism (which, with 83% of Jews supporting same-sex marriage in 2013, is ahead of the general populace when it comes to accepting LGBTQ people and same-sex marriage) or from his progressive worldview or some combination.

    Whether they're married or not there have always been gay relationships of sorts going on. Often traditionalists find it more acceptable when it's a homosexual relationship between two people of different social statuses.

    If secular society forces people not to be religious, doesn't that defeat the point of secularism? Isn't secularism supposed to be a blanket term for a society made of religious and non-religious people, therefore allowing people to express religious beliefs to respect the 1st Amendment's expression clause?
    Cause if not then it defeats its own definition and is unconstitutional.

    The "culture war" whatever the hell that means is not mean to be "win" is mean to be a fabric of non problems and outrage. I mean, what they try to do? Not long ago the right clutched the pearls due to a 2 seconds lesbian Kiss in a kid's movie. It was Doomsday for them, now think about this, Let's Say someone at Disney watched Ben Shapiro saying that those 2 seconds of wokeness will bring the end of times and the company cuts it out to never see the light of day ever. Then what? What problem that cut solved? Are they going to take victory laps saying that Disney unwoke themselves? Are they going to Buy 100 copies of the DVD? Of course not.
    The right craves for this shit, they wait desperate for the next lesbian Kiss in a series, for the next trans person in a Public office, for the next actor who comes out of the closet. Cause they run on hatred and NEED new targets every day.

If they can't bake you a cake because of their religious beliefs, how long before they can't abide you working at their job or living in their neighborhood? How long before they expand it to banning you from their city or state or their country because of their religious beliefs? How long before they don't want you on the planet ... and then, who will be next?

    To be fair here... Sam seems to be ignorant of history when he says that nobody anywhere was ever persecuted by a secular government and society for the crime of being religious... This is untrue. Russia and China both at times in history have famously done exactly that. And particularly against Christianity.

      You are talking about the USSR, not Russia, and even in the USSR people weren't persecuted for being Christian. They were persecuted for being the wrong kind of Christian.
      Also, the USSR and China aren't really secular. Communism is a religion all it's own.
