This judge always throws the book at everyone. She has zero empathy. None. I would disqualify her for my client’s cases. As a criminal defense lawyer in California we are allowed to request to “paper” (I.e., allege a judge is biased and request to be sent to another judge randomly picked by the court).
I don’t know why these defense lawyers don’t go to another judge. Maybe they don’t have that person in Texas?
@shawnmclean7932 guns are not required for self-defense. One may arm themselves with many things. If we are supposed to observe one part of the constitution, we have to observe the others. 10th amendment sets forth state rights. If someone lives in a state/locality, they are subject to those laws. Why be on the fence?

Just because you served in the military it is NOT a free pass to committ crimes and IF he is 100% disabled how is he able to work.

@@user-fp1uz7ur4l he is a veteran. If he was injured (mentally or physically) in the Marines, he is qualified for Disability pay from the Govt. This goes from 0 -100% of his base pay at the time he was boarded out. This does not necessarily mean he is Disabled in the sense he cannot work. It means he is being compensated for his injuries sustained while on AD. Given the fact he has 3 Purple Hearts and a Bronze Star for bravery, I am guessing he saw quite a lot of battle action. 3 PH means he was injured, more than once in battle.
I admire and honor all who served in our military but he can't use that as an excuse. If I were a judge would I give vets lighter treatment or sentences? Probably.

I wouldn't take the GPS off, just see how he gets all agitated in court wrenching his hands and such.
He does come off as lacking self-control and emotional regulation. He came back to court after this (I think it was a couple weeks later, but I’m not positive) and he was once again trying to get off GPS. He had all kinds of reasons/excuses. He was also upset that his pre-trial officer wasn’t nice enough to him. Both he and his lawyer were unnecessarily aggressive and constantly interrupted the judge. His lawyer even asked the officer “Did you call me a redneck?!” 😂 They’re both ridiculous.

I don't believe him. I don't think he was ever in the military, if he was he wasn't in for long. Most military vets would sit quietly and wait, he interrupts, makes excuses, and is fidgety. His excuses are mostly nonsense and are whiny. Smells like stolen valor.

So because someone was victimized causing them to have PTSD they should be punished and not allowed to own a gun?
On a side note I am not saying the person should not be punished but what I am saying is we can't say every person who has a mental illness or PTSD should not own a gun or weapon.
That was my thought also. Here in MA. there's a question on the licensing questionnaire have you ever been diagnosed with a mental health problem. If answered yes, you are denied. It's pretty simple and understandable.
Food banks - it depends on the place what they require; I have volunteered at several and there are ones that require you to provide a SS card for every person you are claiming is in your home.
There was one food bank I volunteered at as a teenager: we would have families that had like 10 people living together in one house; all of the adults would come together in vans and each one would separately claim 10 people so each one would get a big bunch of food. We would watch them load up the entire back of their vans full and have to put more boxes/bags of food on their laps. Then we would run out of food and have to turn so many other people away with nothing; it just wasn't fair so the director made it a rule that you had to show SS cards for every person you were claiming food for, and each person claimed was recorded for that day so we could make sure they were not passing the cards around and using the same ones over and over. We hated limiting what people could get, but it gave so many more people a chance to get SOME food rather than just a few people getting a ton of food and so many people getting nothing.
He looks frighteningly dangerous at times, just holding himself in. I never knew that marines were trained to de-escalate. I thought they were trained for missions and fighting.

If this defendant has PTSD he shouldn't have any guns as he's a risk to himself and others .. even threatening suicide! If he's found not guilty by a Jury, he should sue the prosector in his own capacity and have the Jury members testify as his witnesses in his civil suit against the state and the Proseuctor should be fired and ordered to pay this innocent man for his damages. If he's 100% disabled, he gets more from VA disability than I get from Social Security and I can't afford a car!!! so i'm homebound through no fault of my own.

I looked up our war hero in the Marine Corps Military Awards(MMA) database and got a “no records” return for him receiving a bronze star. I don’t know if he has the Purple Hearts or not. It’s an extremely common award compared to a bronze star, so it i At requires a records request compared to the public access database of the very short list of bronze star recipients.

Sometimes they will at a food bank & many I’ve dealt with will only give to an organization ( church , adult disabled home , shelters ) , many places require proof of income & ID …..

I'm sorry sir, you broke the law & were charged with assault with a deadly weapon. I'm glad that you served in the military but you do still have to obey the laws. You are still able to deal with going to your doctors, you can take your son fishing by asking for GPS to allow you to do these things. But it appears that you want to be relieved of the GPS to do whatever you want, whenever you want, not find a way to comply.

Yes I waiting to see if anyone had seen the other court appearance. Ya he violated his probation because he failed to appear after his GPS alerted the court for tampering and he and his wife refused to drive there to have his GPS checked. He’s such a baby. Each time I’ve seen him he just whines and takes absolutely no accountability for his actions.

I'm a veteran and my father was career military. This is going to be an unpopular opinion but from what I've seen the last several years I think claiming PTSD and retiring on the government dime in their 20's is one of the biggest rackets going. People like him take away from veterans who are truly suffering from PTSD. Either a lot of these people are flat out lying or the last two generations of Americans give new meaning to the term weak-minded.

You do need a social security card to go to the food bank. 100% Absolutely. It's disappointing that the courts don't know this. I hate to see someone penalized for such a ridiculous mistake. I had a friend turned down by three food banks in one day because her husband used the children's social security cards before she could. She was turned away without even a loaf of bread.
