    Hi! Great video, well informed nicely presented. I recently received my green card as part of NIW EB2 program. I was a PhD student with F1 visa. I would like to know as a PhD student what restrictions do I have as a GC holder? As a PhD student I was not allowed to work more than 20 hours, can I work more than that? Does it depend on school? Or is there any legal barrier that I have to work 20 hrs still? Thanks.

    • @RenatoDeVuono
      @RenatoDeVuono Před měsícem

      Hello! If you are a GC holder you have no restrictions to work. The restrictions ar based on ir VISA TYPE, not in your education program. So a F1 have work restrictions, a GC holder doesn’t. 😊

    There's one thing wrong here that I noticed:
    You can naturalize after 3 years if you got your green card via VAWA (spouse/child of USC, or spouse/child of LPR who was since naturalized) or if you are married to a US Citizen and:
    1. It's been at least 3 years since the date of your marriage.
    2. It's been at least 3 years since your spouse became a US Citizen.
    3. You've been an LPR for at least 3 years (as per resident since date since asylees get backdated a year from I-485 approval, refugees get backdated to date of entry into US).
    How you originally got the green card doesn't matter otherwise. You could for example be an F-4 derivative child (F43/F48) marry a US citizen a month after your entry/adjustment and be able to naturalize 3 years after your marriage date since that's the last one.
    Otherwise yeah 5 years.

    Are there any exceptions that may allow a Permanent Resident to avoid deportation for an arrest of Aggravated Assault? For example, if the individual had a documented mental condition or breakdown at the time he committedbthe crime & had never been arrested before & lived in the USA (with permanent resident status 30 years) as a productive member of society who even worked in law enforcement?
    Also if 1 of 2 foreign born biological parents (Mother) was Naturalized in 1992 & the aforememtiomed was a 12 year child would he have automatically became a U.S. Citizen or would the second parent (father) who became a Naturalized citizen when their son was over 18 still be considered a Permanent Resident?

  • @westlawpc
    @westlawpc Před 6 měsíci

    It is not correct that the 3 year versus 5 year waiting period before filing for naturalization depends on how you obtained your green card. One could obtain a green card via employment, and if that person is married to a U.S. citizen, he/she would only need to wait 3 years until naturalization.

    • @sassystulla
      @sassystulla Před 4 měsíci +1

      Yea it’s highly recommended! Remember, after receiving the 2 year conditional greencard, you will still have to produce evidence that you are still in a bone fide marriage when applying to remove the conditions on form I-751.
      With that said, you still need to accumulate evidence that all is well in your marriage -basically the updated versions of the same evidence you submitted for the first green card and ofcourse, anything else that comes up between those two events.
