    Hi Arran
    For anzsco level 3 fitter general pathway to residence is the 1.5 median wage supposed to be paid throughout the 3 years that you are claiming points or when you apply for residence you are supposed be earning above 1.5 median wage
    Just need clarification there because median wage changes

    • @ImmigrationNZLaw
      @ImmigrationNZLaw  Před 4 měsíci

      A fitter under 323211 is a level 3 role so doesn't require the 1.5x median wage for the work experience. However, if you're using the pay for the points (instead of a qualification) then it is having the job or the offer of the job when you apply.

    Hi Arran. The English requirement is essential. This is NZ. Sick of getting on a bus or going to a supermarket and hearing nothing but confident, loud, foreign languages being spoken, I find it rude. "When in Rome comes to mind".

      You have a problem with any language that isn't yours? fyi your colonising british ancestors invaded this country in beat the maori language out of us.

    • @user-xb8tc3tc8t
      @user-xb8tc3tc8t Před 3 měsíci +1

      FYI, the colonizing british ancestors you refer to were not seen by our family as friends. The origin of my family was placed on a convict ship (for stealing some food, his family lived a very desperate life) and was shipped to Australia. Upon serving his time, he was offered a parcel of land in Oz, the poms way of settling people in Oz. He sold that land and got a ship to NZ. That is how our family started here. That was long after the brit/maori wars.

      It’s rude that people speak their own language? Think of that next time you travel to a non-English speaking country.

    • @user-xb8tc3tc8t
      @user-xb8tc3tc8t Před 3 měsíci +1

      You missed my point completely. If I travelled as a tourist to a non - English speaking country that would be expected. If I chose to live there, I would go out of my way to learn and speak that language. That's where the "when in Rome" quote applies. "New New Zealanders" many of them long term residents, and many who have gained citizenship can't be bothered (apart from the absolute obvious basics) to adopt the "when in Rome" expectation. That tells me a few things. No1 being, they have no interest in joining the NZ way of life, and have no interest in integration. That keeps them apart.

    Hi Arran,
    I am working as a dairy farm assistant in New Zealand from the beginning of March 2023. $28 per hour. This year (April 2024) I was promoted as herd manager, but it is valid from June 1, 2024. The salary has been increased. I have no dairy farming experience before coming to New Zealand. How will these new rules affect my situation? Many people like me are faced with this problem. I would greatly appreciate it if you could provide an answer to this. thank you

    Hello Arran,
    What would be options for a candidate where they are on AEWV and the employer liquidates the company and its not the employees fault at all. Do they have to leave the country immediately or can inform immigration and seek for some time while they look for another job to apply a new AEWV or job change?
    They cant get "Dismissal Work Visa" as it was not a dismissal in 90 days in trial as its been 5 months of their employer. Should they also apply for Visitor for the same or what would be their status during now and their new application? P.S. They have not been contacted by INZ yet asking anything, the employer just informed them that the company is liquidated and dont have any more work to give to the employees. Thanks!

    Hi there. I am a level 1. I have been here for 18 months. I see that my current rate is below the current green list rate. I am not sure if this means I do not qualify for residency or if I have options. I was under the impression at the time of applying for the Aewv that I would be able to apply for residency after 2 years of working here. Any advice would be appreciated.

    • @ImmigrationNZLaw
      @ImmigrationNZLaw  Před 4 měsíci

      Hopefully I understand the question. If you start employment at or above the median wage (remembering that the median wage for residence is currently higher than that for AEWV, though that only started in February this year) then under SR5.15 you will continue to be gaining exprience even if the median wage increases but your pay doesn't increase, as long as your pay does not reduce to less than you started at.
      I hope that answers your question.

  • @argenzealand

    Thanks for this video! Please one single question: I have a AEWV holder. I have this visa from march 2023 and it’s for three years.
    I’m not in tier 2 or green list… by the time, I’ll be affected to my residence application? Because before this changes anyone who worked 2 years at least medium wage could apply… do you know what happens with my situation?

    • @ImmigrationNZLaw
      @ImmigrationNZLaw  Před 4 měsíci

      Before the changes, people couldn't apply on two years of experience, that was just those in Tier 2 or with an industry agreement. For the rest, it was SMC6 which may require up to three years of experience based on what other points people got.
      To know your situation we'd need a lot more information and would need to be engaged to assist.

    Hello Sir! I recently subscribed to your CZcams channel and I'm reaching out to inquire about the recent updates to the AEWV eligibility, particularly the new English test requirement. I'm curious if INZ accepts "English certificate as the medium of instruction" from college or tertiary institution in the Philippines to exempt from this English test requirement. My occupation falls under ANZSCO Level 4/5, which now mandates passing an English test with a minimum overall score.
    On the INZ website, it mentions exemptions based on the so-called "English-Speaking Background" as an alternative way to prove English proficiency for various visas, excluding Resident Visas. However, as a Filipino, I'm unsure if this applies to the new English language requirement for AEWV eligibility, given that I completed my primary to tertiary education in the Philippines, a country not listed among the accepted English-speaking countries - Aus, NZ, UK, US. (This information is detailed in one article).
    Under the AEWV's new English language requirement, it specifies "English-speaking background" as an exemption criterion, but only for those listed English-speaking countries. This means the Philippines is not applicable, and therefore, I would need to take an English Test. (This information is detailed in a separate article).
    To clarify further, here's the logic behind my inquiry:
    • English-Speaking Background: Accepted or listed countries are not specified, suggesting that I may be able to use my Philippine English certificate as medium of instruction in college to prove my English language proficiency. (Separate article in INZ)
    • New changes of AEWV in terms of English language requirement: English-speaking background can be used, but only for those accepted or listed English-speaking countries. (Also a separate article in INZ).
    Could you please provide clarity on this matter, Sir?

    Hi Arran, thanks for the informative video. I've a PhD degree from Nz University, graduated in 2023. I now hold a contract agreement which makes me all qualified under skilled Migrant for residency. However, I've few doubts. What if my company say has the Accredirion license valid upto halfway through this year (which means they'll have to renew at that point). I don't know how this applies to me but I'm just overthinking/being critical with every point as I've had bad memories with immigration in the past for renewing my student visa even when I didn't leave the country since 2019. I've the wage i. e. More than 1.5 times as per the Immigration rules. Just wanted to know if there'll be any impact on residency applications too as I don't want to lose my hard earned money finally Immigration saying sorry. I'd appreciate if you can respond. Cheers.

      Hi. Under SR3.20.b, the employer needs to be accredited either when the application is made or decided. So, if you submit now when they are accredited then that requirement has been met, even if they are no longer accredited when the application is being decided.

    Hi Arran. Thanks for the informative video. My husband is currently in NZ holding a work visa but will expire soon so will be applying for AEWV soon. He's been working as Caregiver in NZ for almost 4 years now but got just got his NZQA Level 4 qualification last December 2023 and was paid $28.25 per hour fulltime. In immig website, Aged care is 1 of 6 roles recognized at Skill level 3 if he meets specific skilll requirement, does that mean he does not need to take english test?

    • @ImmigrationNZLaw
      @ImmigrationNZLaw  Před 4 měsíci

      Hi. If his role is skill level 4 then under www.immigration.govt.nz/opsmanual/#82333.htm an English test is required on a new application. While aged care is in Appendix 7, this relates only to the old SMC, and not to AEWV. However, it is IELTS 4.0 which is a lot less than the IELTS 6.5 we see for residence applications.

      Level 2 jobs fit in to the 1-3 range, so won't have the 3-5 requirements, but will still have the skills/experience requirements to meet.

    Hi there ,If anyone applied AEWV before 7th of April 2024 and after June -2023 ,is this visa duration will be 5 year ? Or visa duration will be 3 year ??

      The visa duration will be on the visa. For those between 21 June 2023 and 6 April 2024, paid at or over the median, it should have been a 5 year duration.
