@@hsc4life The name of the court case that delt with this is "Pennsylvania VS Mims." It basically states that an officer can ask you(and or your passengers)to step out of the vehicle at any point. Because it was handled in Supreme Court it's covers all 50 states of the US.(not 100% sure if it was in SupremeCourt or not..)(Disclaimer I AM NOT A LAWYER. I have just seen alot of content surrounding law and law enforcement. The only reason I know of this specific case I have named is from Donutoperator )
Is asking for the passenger identification a reasonable request for a traffic stop?
I had a situation where me and my brother drive out to Beverly hills to work Uber eats food deliveries. (Him in his car and me in my bicycle) At the end of the night, I pack my bike into the back seat/trunk of the car so we can make our way back home. We crossed paths with Beverly hills PD and instantly knew, (2 Latinos, nice neighborhood, non German or Italian car, and visible bike) that he will pull U-turn and pull us over. Sure enough he did.
As a passenger I did not cooperate when asked for identification. They asked a bunch of questions about what we were doing and where we were going. Me believing we were wrongfully pulled over I did not cooperate.
The officer didn't want to answer why he pulled us over till the end. He gave us a warning that one of our lights was out. After the situation was over I checked the tail lights and all were working.
Did he have probable cause? I don't believe he did because he would have to prove probable cause of us having committed a crime to investigate right? I'm thinking racial profiling, but in your opinion what do you think?
Hypothetically, if bicycle theft was common in the area would that be enough probable cause? And if so, can they investigate without disclosing the nature of their investigation? Then give false traffic violation warning?

However, if the cops have RAS, they don’t have to provide the basis for it to you upon request. They can withhold their reasons until a court hearing if they want.
So, refusing to ID, because you think they don’t have RAS is a gamble. If they had it, you are guilty of failure to ID when legally required.
In other words, if you think the cops are lying and/or want to ID due to a power trip mindset, you better be sure.

If me and you got pulled over for a legitimate traffic stop, and you’re the driver and I’m the passenger, and I have my seatbelt on and haven’t commited any traffic infractions, the cops can’t legally ask me for my ID unless they have reasonable articulable suspicion. They have to provide you a reason for arrest, detainment, and reasonable articulable suspicion you have committed, in the process of committing, or are about to commit a crime

No, they don't. They are required to HAVE reasonable articulable suspicion. They don't have to inform you of the reasons why they stop you at the time of the stop. Nothing in the legal precedent requires officers to explain their reasons during the incident.
The only time cops are required to say why they stopped someone, meaning what evidence led them to have RAS, is in court.
And if they have RAS, don't inform you, and you don't cooperate while attempting to flex your 4th amendment rights, you are going to jail for failure to ID.
Not saying that you absolutely have to obey cops when they give orders to you. Just saying that you better be sure before you risk your freedom.
Some states may require all passengers to show ID depending on circumstances.
Refer to your state laws for more information.

What if he’s driving a car that matches the general description of the car in question and genuinely doesn’t know why he’s being arrested? Turns out two nurses were murdered and a witness said they saw his car. He says he didn’t know the two women. Cops never said the nurses were women, and now you “know too much”.
Easy way to avoid that. Fifth amendment.

No they won't. I've been pulled over multiple times for various things. Most were for stuff like a brake light was out or a tire looks flat. Once I was asked to leave the vehicle because I had some mud covering my license plate and the officer just had me do a quick alcohol test because my pupils were not properly dilating because I was at the eye doctor and they did some tests. Nothing went wrong. She was polite and thorough. Just comply with the cops. If you did something wrong just take the penalty.

Happens all the time, actually. The police generally don't enjoy a bunch of random people hanging around a scene unless they need to be there, it's never a bad idea to ask if you can leave as long as it's not blatantly obvious that you aren't free to leave.

If they chose to arrest you for something, you can speak to a lawyer, and potentially get paid for damages if they wrongfully arrest you. If they don’t arrest you, then you don’t have to answer any of their questions. You’re either let go or arrested.

I was just pulled over earlier today. It was just to remind me my tabs are due, and the cop was very nice. But I had my registration, and license and insurance ready, I didn't have to reach anywhere that the cop couldn't see. I had my car turned off and the keys next to me in the passenger seat. I was very respectful, and very cooperative with him. He was very nice and just said he wanted to remind me about my tabs.

Bro these legal tips make you sound so suspicious, the cop is talking to someone who isn’t you and you ask if you’re free to leave, if he says no then you invoke the fifth you sound like you have something to hide. As someone with a lot of experience with law enforcement, working with not the other one, they find that stuff so suspicious. If the cop says no then don’t say anything, if they start asking legal questions then whip out the fifth.

You should also mention that there are some limitations to an officers power over passengers on a state by state basis, like michigans supreme court ruling that officers cannot search passengers without consent.
