Hola Mayra. Gracias por tus palabras y enhorabuena por la aprobación! El 140 es la parte más complicada, por lo que te puedes relajar un poco. Aún así hay que estar alerta hasta el final . Si enviaste todos los papeles y nunca estuviste out of status no deberías tener problema. Cuál es tu campo? Tu sabes que pasa si envio mis documentos en 'concurrent filing' para EB2-NIW y I-485 para mi y mis dependientes cuando mi region no esta 'current'. USCIS rechaza los i-485 o los deja pendientes? (asumiendo que el I-140 es aprobado bajo premium processing) muchas gracias otra vez!
Hola, gracias por tus palabras! Respecto a la pregunta, USCIS rechazará el I-485 al no estar current para ti. Mejor no lo envíes salvo que quieras que tu petición pasee por el mundo ;) Saludos

No, that's no correct. You have to wait until your priority date is current to file an AOS
Hola Óscar, encuentro una página en donde mencionan un formulario (supuestamente necesario después de la aprobación de I-140) que no he escuchado en sus videos para la EB2 NIW. ¿Acaso es información desactualizada?: "DS-260 filing fee: $230 (if you are filing from outside the United States)." Hola Clandestino. Si, es como lo has leído. Hay dos partes principales del proceso. La primera es I-140 para todos, que es en mi opinión la parte más complicada e importante. Dónde evalúan si cumples los requisitos de NIW o no. Luego, si estás en USA haces ajuste de estatus (I-485) y si estás fuera te notifica el national visa center (NVC) para los siguientes pasos. Uno de ellos es que mencionas de la DS-260 , que es un formulario que se hace y paga online (o sea , mucho más fácil que todo el embrollo de la I-140), y más adelante te llaman para entrevista . Quizás en el futuro, cuando acabe la serie de I-140 podemos continuar por ahí. Saludos

They get approved separately but note that currently it's not possible to file NIW concurrently because of the visa bulletin
How long until u get ur green card if u are outside 2 years i140 then i1485 then i130 to receive green card 2 years if u are niw but if u are eb3 ? Can i file eb3 and eb2 NIW simultaneously incase I was rejected in niw or after 2 years since ill be studying master to qualify for eb2

Hola Robinson, por desgracia la EB2 NIW no es solo cubrir un formulario.Hay que montar un caso y enviar un paquete, del que forman parte el formulario I 140 y otro más, junto con cover letter, y multitud de anexos. On F1 status, if I 140 is filed, 485 is not yet filed, i want to travel abroad but no AP, will there be issue when i come back to the US? will it affect f1 status or the 140? thanks

hey Oscar, I am in USA with B1/B2 visa and my i-94 expires after 2 month. If I apply for concurrent together let's assume it will take 6 months to get the answers. Do I need to return to my original country or can I wait in the USA and wait for the answer?
You cannot apply concurrently right now, the visa bulletin doesn't allow you. There is more than one year of backlog
What if I-140 denied in concurrent filing 485 denied too? I have seen a case in concurrent filing I-140 denied and they filed 140 again and it get approved but still uscis denied 485 on bases of old 140
Of course. If you file concurrently in I-140 is denied the 485 will be denied too. They are linked to each other

of course, it is always easier if the nonimmigrant status is maintained. It is really important to maintain it at least until the I-140 is approved. During the wait for the adjustment of status, one could rely on the upcoming immigrant status. For example, if you are a student you could theoretically drop out of school. If you are a H1B worker you could potentially change jobs using the EAD card you would receive after the I-140 is approved and before the green card is fully granted. HOWEVER, this is risky, because if something goes wrong with the adjustment of status, you don't have anything to fall back on. Of course, individual situations may call for specific solutions and a lawyer is best suited to provide that type of counsel.
