Defense Opening Statement - Jose Baez
An Ohio doctor was charged with 25 counts of murder on Wednesday for allegedly prescribing lethal doses of fentanyl to dying patients. Franklin County Prosecutor Ron O’Brien said that he has never seen a 25-count murder indictment in his career, adding that the doses Dr. William Husel allegedly ordered in the 25 deaths “could not support any legitimate medical purpose.”
Husel, 43, was a doctor for the Mount Carmel Health System; he was fired at the end of 2018 after an internal investigation found wrongdoing.
Husel faces a potential sentence of 15 years to life in prison for each count - if convicted.
Husel’s lawyer Richard Blake claimed that, actually, “this is not a murder case.”
“I can assure you there was never any attempt to euthanize anyone by Dr. Husel. At no time did he ever have the intent to euthanize anyone,” he said.
Mount Carmel Health System, for its part, has said in a statement that it “will continue to implement meaningful changes throughout our system to ensure events like these never happen again.”
The Columbus-based healthcare system also fired 20 other employees after an internal investigation found that patients received exorbitant amounts of Fentanyl. Even though nurses doled out-and pharmacists filled-Husel’s prescriptions, the focus of the criminal investigation remains on Husel, according to prosecutors.
Mount Carmel President and CEO Ed Lamb said at the time of the investigation’s conclusion that “regardless of the reason the actions were taken, we take responsibility for the fact that the processes in place were not sufficient to prevent these actions from happening.” He added, “we’re doing everything to understand how this happened and what we need to do to ensure that it never happens again.”
The State Medical Board of Ohio suspended Husel’s license in January because the doctor failed “to meet acceptable standards regarding the selection of drugs, violations of the minimal standards of care and failing to cooperate in a board’s investigation,” the board said.
Mount Carmel has settled at least five wrongful death suits since it fired Husel. Two of the suits that were settled involved deaths of 73-year-old women. Sherry White died in 2014 after receiving two, 100-microgram doses of fentanyl within 16 minutes of each other, the suit alleged. But White’s death certificate said that she died of septic shock from a urinary tract infection (UTI).
The suit in the death of Peggy Francis alleged that she died six minutes after she was given a 200-microgram dose of fentanyl. The death certificate said that Francis-who was being treated for kidney cancer-died from septic shock caused by a UTI.
Each of the lawsuits allege that health care providers ignored excessive painkiller warnings from an electronic medical system or that the system failed to work in the first place. After Mount Carmel fired Husel in December, the health care provider updated its guidelines that a usual adult dosage of fentanyl should be between 25 and 100 micrograms, according to an Ohio Department of Health inspection report. Husel faces an additional 19 wrongful-death suits after another eight were settled, according to NBC.

How does anyone even think it can be anything else BUT comfort care? I can not comprehend.
I saw my stepdad die gasping for air after being taken of the respirator. it was the most horrific experience I ever witnessed. The suffering was immense and I wish he received the comfort care of Dr. Husel. Nobody should die like this. These traumatic memories have taken over the good memories I have, they always creep in when I think of him. It has been 7 years and they are as vivid as if it happened yesterday.
That’s terrible. So sorry. You’re right that he would have been better cared for by Husel. Give me Husel, God.
This trial should be stopped. Charges dismissed. Malicious prosecution.

Thank you. I'm dying from complex regional pain syndrome. 17 years the disease went after my heart ablation and implant. Spinal cord injury shoulder replacement. I've been drugs long time. I finally found non narc. The trial drugs stop my heart. So there is alot drugs that can kill and it doesn't have to be narcotics. I was on very high levels of narcotics the pain bleeds thru. The pain will kill me if I'm no on high level my BP 200 over 120. Who wants pain that cause that. Thank you nurse your a smart wemon. I also have centralized pain and peripheral pain with terrible inflammation. I know the pain meds keeps me alive. I'd been suffering with severe pain.

I too am a former ICU nurse. I stand by this doctor as well.
As someone who is on pain medication daily, this doctor did nothing wrong. Many patients in ICU are extremely ill and have been. Many have likely been sick and on pain meds for a long time. Every person will develop a tolerance to these drugs, requiring higher and higher doses to control their pain.
I concur! I know 5 patients who killed themselves bc Drs cut back on pain meds. I so wish I could. I too, am dependent on them to hobble.

I did not think Baez would ever be anything but a performing joke. He is doing exremely well in his opening. I am a nurse but even if I were not I would understand what he is saying. This is s dishonest Catholic Hospital who are not really into compassionate care.

Thank you for your service to humankind... You know, the case with Anthony he was good at what he did but she should have been found guilty but the prosecution didn't present all the evidence and I am sure they had to agree on what could and couldn't be presented since it would prejudice their client. Here, Mr Jose Baez is doing a very professional, clear cut, presentation as to what REALLY occurred and how Dr. Husel ended up on the hot seat as well as used as an escape goat.
It seems so. Unfortunately, Baez is using co-counsel as a barking dog, and she's not really been able to intimidate most of these witnesses. I trust this jury to see past all of the shenanigans, even perhaps those of this judge 🙄
I like that Mr. Baez uses visual cues such as the charts to compare evidence. A picture is worth a thousand words.

Watched him today, and many of us think he’s allegedly drinking or on something. That doesn’t mean it’s true, just a lot of personal opinions.

This judge reminds me of a bad dream. Like you end up in a poor dunk town and the only judge is the one who will find you guilty just because you are not from the area or just bc he can. He has sided way too much with the prosecution instead of being a judge. Wonder if Mt Carmel is giving him kickbacks too like the prosecution?
It is ridiculous this was made a criminal matter. These patients were actively dying. He spared them a painful death, which is the entire goal of palliative care. If he is found guilty, this will have such a negative impact on the practice of palliative extubation.

I have been a Nurse in Long Term Care since 1987. When our old folks are dying, we call in Hospice. They are awsum. When the patient is suffering, in pain, can't breath they administer morphine to ease the pain and suffering. It's not murder, it's compassion so there is no suffering. Why would you want to watch your loved one struggling to breath, or thrash around in a bed unable to breath, their eyes saying ..please help me. You may say, put oxygen on them, too late, try Tylenol, too late. There is no other option,. You accuse him of murder, no, just Compassion to die without screaming in pain or struggling to breath. I SUPPORT HIM .

This is perhaps the most deranged case ever. It's clear he didn't murder anyone and the prosecution is insane.
There is such a thing as bad death. It is horrific to witness any thing like it. Gasping! Drowning in your blood, phlegm. God bless Dr Husel for stepping up to end the torture. These people are never going to be alive and have a life. That is not going to happen! Help them move on with as little misery as possible. I pray I am relieved when my time come.

A doctor cannot choose to end someone's life. He is not God. I would agree if that's the patient's wish or a close family members' permission.
I never knew how shady prosecutors can be until I started watching so many trials. This is another one. This Dr is not guilty.
Go get those prosecutors Mr. Baez. This is an injustice to Dr. Husel. Get this amazing compassionate doctor acquitted. My prayers are with you!

Truth! I just recently witnessed (for my second time) that the hospital Pharmacy causes A LOT of issues; they deny doctors and RNs with Doc’s approval, they ignore patient allergies and intolerances and override the doctor. First I experienced this was in 2011 when I had bilateral hip replacement; they continued to try to force Vicodin on me when my doc told them I have a negative reaction to it. My surgeon was renowned and they played a dangerous game with him.

So confusing. They fixate on the dose of the palliative care drugs, why? There's pts that are placed on palliative care all the time... Some get massive doses of drugs bc of distress and agitation some don't. How can they accuse this guy of "giving too much" when every pt is so different...
And if they are so concerned about the "opioid epidemic" as the mainstream media would have you believe that this case is about, then why the concentration on patients so close to death? If I am that close to death, I don't care WHATSOEVER what they give me. It's the living that need care for opioid addiction.

What do you think after today’s showing? Or when you watch it, I hope to hear. I went from your position to defense today. I hope the jury saw what many of us did today. This case is squirreled, the judge is a hot mess, Baez is one of the best defense attorneys to date, prosecution are receiving bias by the constantly interrupting judge. 🤦♀️ Pharmacy calls the shots, they can override attending doctors. I just witnessed this myself. I had two pulmonary embolisms. I am very sensitive to most medications and the pharmacy left me in pain from early morning until 8pm. IMO Dr Husel is a scapegoat.
@@Fb33EYE I agree. I have completed day 9 of testimony so far, and I have thought from the beginning that this case seems to be a “sue the Little guy cuz it’s easier” case. I keep thinking it should possibly be a malpractice suit if anything, but I agree that so many people were involved in the inter workings of everything that happened. I just don’t think he intended to murder anyone. When listening to some of the witnesses so far, i keep falling back to not guilty. I am interested to see how the rest of the trial plays out. Lots of trial left, so maybe something will come up. 🤷🏻♀️
Prosecution is mixing apples with oranges and can't do their juggling act beyond a reasonable double due to probably kickbacks from Mt. Carmel. I'm sorry, did I say Mt. Carmel? If they want to start prosecuting doctors for this kind of stuff, someone should really consider looking into what the hospice nurses do 🥴
Hospice nurses don’t prescribe medications, Lindsay. They work in care teams and in highly regulated environments centered around informed consent. Hospice patients and families are educated about their options when not in crisis and they make collaborative decisions about pain management, usually putting things in writing via advance directives. They are not one man show ICU doctors loading someone up with drugs that will kill you because that’s what they thought was best. Just wanted to make sure you knew these were 2 different jobs entirely, because it does not look like you do.

You are so correct Lindsay. People die every day on the operating table but it's from their illness or injuries not all the meds they had to use to keep them comfortable.

This man is not a true judge. Today’s showing was worse. Many of us felt he could allegedly be on something. He was rude, constantly interrupting, biased to prosecution (even asking someone to have lunch with him because, “I miss you”, was reprimanded by the court to control his facial expressions. I have never seen such a ridiculous spectacle in court.
@@Fb33EYE A ridiculous spectacle is exactly what he's making this trial. His behavior is unreal at times. Just finished watching Day 11, and at the end of cross, the judge actually started to say "Sustained!" before prosecution had even objected (to which they did, about 5 seconds later..) I've never seen a less impartial judge act more inappropriately. His "Sometimes us judges have these judge things we've gotta take care of" speeches, interjected at the oddest times, along with his daily comedy routine, bewilder me every single day. I don't think there's been a witness yet he hasn't cut off to bark "Relax!" at...
If I were a family member of Dr Husel, I would be extremely concerned that this guy's antics could very easily sway a juror.
And if I were a patient's family member, I'd have the same concern that any conviction will be overturned down the road due to those same antics.

@@freedomrings5270 I think the most mind blowing part for me is that the judge seemingly doesn't even care that his prejudice is on full display. He makes no attempts to try and hide it. You can see his eyebrows raise and his arms cross as the defense steps up to the podium, more so with Mr Baez than Ms Menashe. I almost get the feeling that he came into this trial already not liking Mr Baez.. maybe bc he feels there's only room for One 'star' in his courtroom, and that role is clearly already filled by him.

I have no issue with this Drs actions if these patients wanted this given to them, but Anthony is a completely different situation, she deserved to rot in prison.

I always go back to the jury for the Casey Anthony case. I remember a juror saying "the prosecution did not prove without reasonable doubt". That has always stuck with me. In the Anthony case, I believe it is more of what the prosecution didn't do, than what Jose Baez did. I still get angry about that case as if it was yesterday!!

Why would a doctor try hurt his patients? He's not a psychopath? Putting myself into the 👞 of a terminal, suffering patient, being given the choice of a dignified way out doesn't sound like a crime to me

So true that a seriously ill patient in hospital has numerous med professionals caring for them - all doing shifts. If this doctor was killing patients they'd have known.

This is a Pandora Box case that will be precedent for many Medical Law cases. As you well know as an anesthesiologist, with a failing system as Mt Carmel had with the scanning of control substances not registering with the pharmacy, the system was the failure not a doctor in Palliative Care and Comfort. They would rather blame it on a highly qualified ICU doctor than admit blame for the system they had created. Witch Hunt indeed.

I'm a lawyer from Pakistan, I'm a big fan of Mr Jose Baez due to his famous case of Casy Anthony.
I was waiting since 2018 for the beginning of the trial of Dr William Husel. This case is same as if a lawyer lost a murder case and his client sentenced to death penalty then his lawyer or Judge can never ever be held responsible for his death.
Dr William also doing the same, he was trying to save their lives but unfortunately they expired...
To prove someone guilty of murder it is much necessary to prove the intent or motive for the same of the accused....
Actually, far worse than garden variety ambulance chasing. I hope Husel’s civil suits bankrupt Trinity.

If the pharmacists originally determine the maximum dosages and you'd at least think determine a time basis too, then it's a wonder what the prosecution would allege (probably in their opening statement) is the catch. However, nobody making accusations until AFTER people became deceased despite seemingly being aware beforehand. And such medication even aiding such as hyperventilation before death, it's currently difficult to really want to harshly criticize Dr. William. Att. Baez always seems to try to make enough effort to prevent the jury from bringing out their proven guilty beyond a reasonable doubt calculators as he prices together a solution quite methodically, right in front of them.

Interesting case here..... I read some reviews on this hospital, eye opening to say the least. Just from the reviews alone the staff at this hospital is sketchy... especially in records dependent. Hmmmmm... my attention has been grabbed.

This case is a shady, irresponsible hospital throwing one dr under the bus to save themselves while using the war against pain meds to do it. This dr didn't do anything wrong. He did what he had to, all he could do, to ease the suffering of his patients

I agree! I hated him from that day on! He helped a liar & manipulator get away with murdering her own daughter so she could be free of responsibility! I can't respect anyone that can do that!!

@@bradr1913 yes, they do! Many people buried their babies near their home to keep them close...She was not looking for her missing daughter until her mom called the police! No normal mom would ever do that!! You would call the police immediately!! I'm a mom, I would know!!
