- DAY 14 - WI v. Jessy Kurczewski | A Wisconsin woman is facing life in prison if convicted of killing a friend in her care by poisoning her with eye drops. Jessy Kurczewski, 39, is charged with one count of first-degree intentional homicide and two counts of felony theft in the 2018 death of Lynn Hernan. Opening statements began in the Waukesha County court of Judge Jennifer Dorow.
Prosecutors say Kurczewski killed Hernan, whom she was caring for, and staged the scene to look like a suicide by drug overdose. Hernan reportedly died after drinking a water bottle mixed with 6 bottles of Visine.
Kurczewski told police Hernan was suicidal and “had been trying to kill herself by drinking Visine in vodka,” according to a criminal complaint. Investigators say, in total, Kurczewski stole $290,210.06 from Hernan before and after her death.

The mother took Lynn’s new Jeep! She claimed that Lynn told her she could have it if she died! Jennifer Flowers is as evil and vile just like her daughter Jessy!
Absolutely despicable.
If they get the conviction on Jessy I think they should try to convict her mom. Problem is, police fumbled this from the jump. Everything about the scene screamed weird and suspicious. They should’ve saved everything within arms reach. Should have started investigating her banking information and they would’ve had video and surveillance to back up what they are claiming now.
I can’t figure out how the scene even appeared to be a “ suicide”
The handful of friends that Jessy had pushed away from Lynn should’ve made it a point to go see her and check up in her knowing that she wasn’t acting like herself and she had been in and out of the hospital.
So many people failed Lynn and that’s why it was so easy for Jessy to take advantage of her and ultimately take her life. Even if she didn’t mean to and didn’t think the eye drops would kill her she was sneaking them into her drinks to keep her good and sedated.why else wasn’t she able to get to the bathroom. Was pooping herself. Not leaving the house! Jessy wanted to keep her completely out of it and she died as a result.
The states case has a lot of circumstantial evidence and hopefully that will be enough!
I agree, the mother is culpable too but it’s too late now. Let’s hope the jury gets this right. They have been as of late In Wisconsin

Lynn went out to lunch with one of her close friends one month before her death. She saw Anthony on that day. They said she was doing okay, she was still struggling with back pain , and was complaining of stomach issues . Jessy ramped it up in the next few weeks, giving her more eye drops, making her really sick….Jessy isolated her in those last few weeks, controlling her everything!!! Jessy and her mother made sure Lynn didn’t get any phone calls….I believe the last time Lynn went to hospital Jessy thought Lynn was sick enough to die in the hospital. I sincerely believe Jessy planned on Lynn dying in the hospital! I believe Jessy was still poisoning Lynn in the hospital. But Lynn didn’t and Jessy had to come up with another plan.she gave Lynn the massive dose of Visine and staged the scene trying to make it look like a suicide. Jessy wanted Lynn to die in the hospital. Lynn’s friends did try to get in touch with her in those few weeks, Jessy never informed any of Lynn’s friends that she was in the hospital! I pray that the Jury convicts Jessy on all counts!
@@5thdimension954 They are working on it. She might not knew about homicide but theft and forgery - I think that oh yes. Prosecution had to focus on Jessy first. I hope there is still enough evidence to charge Jennifer Flowers too. The guy who gave a loan to Jessy can still testify that it was person who looked like Jessy's mother and not Lynn that day. Let's keep hope.

Mixed feelings for this lawyer. She does not need to be little people when she reprimands something that they should not be doing. Out of respect you do not talk down to people. That I do not like from her. No matter what Jesse knows right from wrong and knows that visine was used for a different intent other than the eye. The stealing and keeping her away from others just shows you the control she was having on this woman. Pretending to be a caring friend and caregiver all the while deceiving her. You put visine in anybody's drink no matter what there is no other reason than to do harm, Not knowing how much harm it will do You still know it will do harm. She sits there like she's some kind of lawyer, What are you writing down and what does it matter... She needs locked up and they need to also arrest the mother They were both in on it.

@TP-jt2cm I know how it is. I am 75 years old; but my Granddaughter refused to help me when she found out I used to be in charge of the computer room in the 70's. She would make me watch youtubes videos to solve my phone and computer problems. I live alone, and her and her Mom live in the Palisades in California. I have to honestly admit it was the smartest thing that could have happened to me. There are so many times when online is the only remedy available. Rare when you can actually speak to a real person. I retired from a major law firm, Akin, Gump, Strauss, Hauer & Feld, and everyone was integrating towards work directly on a computer or laptop, and secretaries were focusing more on just administrative duties. Thank goodness I was able to retire at 52 because I was fed up with so much technology. Have a great weekend and I look forward to Monday.
First of all that lady is still kicking it and for her age and doing a damn good job. Hence they keep trying to reprimand her because she's a thorn in their side...I think she has done a great job. As far as technology a lot of the technical issues are the courtrooms misconduct not hers.They set up the equipment.. All she can do is speak up when something isn't going right on her end That does not make her not tech savvy. I'm not saying that Jesse is innocent by far I'm just commenting on Mrs Cooper the lawyer has done an outstanding job And she is very polite. She has a lot of patience to put up with being talked down to by the judge and the state's attorneys. I'd hire her in a minute. Great work Mrs Cooper!

No one who knowingly drinks Visine would go to the doctor to complain about the constant diarrhea! She didn't like some drugs because she was allergic or had a bad reaction, so she stopped using them. She would have stopped drinking the Visine had she actually known she was ingesting it. She was desperate to find what was wrong with her. People who are suic*dal don't go to the doctor constantly for help.
She would also found a new home for her beloved cats.

These are arguments. Just because a client is guilty and everyone knows it, doesn’t mean the defense can’t construct an argument from incriminating evidence.

Is the defense trying to say the jury cannot pick and choose which evidence they want to consider. She’s trying to convince the judge you can’t pick and choose which of the lie. She told her and her interrogation that you can use.
That is the Jury’s job! To listen to the evidence and decide which is true. The Jury has to pick and choose who is more believable!

How about a roommate just boiled water with eye drops that created a chemical reaction. "Thank goodness it wasnt with tea". It took 2hrs for it to hit me before i felt nauseated and had diarreah and frequent bladder spirts.

Technically speaking there’s no fool-proof evidence, neither for homicide nor for (assisted) suicide. The medical exam resulted in “undetermined”/The toxicologist couldn’t confirm in how far THZ contributed to Lynn’s death…. If it is that Jessy has indeed tried to kill Lynn, she used the opportunity very cleverly. If she’s lucky, she might be guilty of theft “only”.

Manner of death: homicide. It was Dr Thomas employed for the defense who after just 14h of working in the case made a conclusion ,,undetermined" - she didn't say it was a suicide as defense wanted. She admitted that she didn't have time to do any research on THZ in contrast with Dr Biedrzycki and Dr Kacinko who spent 1 year on the case before giving their opinion. Dr Thomas nevertheless listed THZ as a drug who participated in Lynn's death and her answers during cross-exam by prosecution in my opinion helped the case.
Bad work Judge -
Such an neurotic judge. All I see is someone barely maintaining self control, let alone control of the process. She was actually yelling at the defence last week, which, if they are smart, would be item number one for an appeal.
She survived Daryl Brooks trial. She is a great judge. She had to stop defense as they were lying about evidence which they put in record by themself objecting to prosecution question about that and saying that they have never seen it before. Trying all the time to mislead jury - she had to stop it. What defense was doing in this trial was violation of the low many times and victim trashing and blaming. They have ethical and professional responsibility when they do their job. Judge warned the defense before many times without presence of the jury to stop their shady tactics because she will have no option but react in their presence. That's why Judge Dorow said ,,stop!" in the presence of the jury finally.

The defense is backed in a corner, and they don't know what to do. It is frustrating to me, so I imagine that poor judge that has to go thru more than we do. And I'm not defending the judge. It's my first time watching her on tv.
Taking on high media cases hence she wants attention.
In case the case were to get appealed, judges have to make very specific findings on the record so the higher courts know the entirety of what was considered prior to a decision or order.

What has come out in the trial is that visine does not cause any highs.
But Visine is tasteless, it doesn't give you any high, and it only gives you bad symptoms. Weakness, stomach issues (something we know Lynn hated), breathing problems, blood pressure and heart rate issues, etc. There is nothing to like about it.
