Guess he isn't completely stupid, because simple assault is usually only a misdemeanor, but if he destroyed it, then it would likely be considered felony theft and destruction of property. Since it's valued at over a thousand dollars in the majority of the US, except for 6 states, which have a threshold of two thousand or more to be considered a felony. It’s been awhile since I’ve looked this stuff up though, so there could be some states that have raised or lowered their threshold since I've checked.
